YOU SPELL IT STARTS WITH A C. YEAH OR IS IT A K? I DON'T KNOW. ANYWAY MR BROWN WILL NOT BE HERE TONIGHT IN HIS STEAD WILL BE OUR INTERIM ASSISTANT CITY MANAGER, MR DAVID. HE'S SITTING IN HIS STEP. AND SO LOOKING AT THAT. I THINK THAT'S ALL THE HOUSEKEEPING THAT WILL NEED TO BE DOING SO WITH THAT, MR KEYES AGENDA THANK YOU. MARIAN COUNCIL START WITH ITEM FOR A CONSIDER THE MINUTES FOR THE FOLLOWING CITY COUNCIL MEETINGS. SEPTEMBER 5TH 2023 REGULAR COUNCIL MEETING SEPTEMBER 19TH 2023 REGULAR COUNCIL MEETING IN THE SEPTEMBER 25TH 2023 SPECIAL CALLED ME. CHANCE TO REVIEW THOSE. THE ITEM FOUR B. CONSIDER A RESOLUTION FOR AN OFFER OF A HOTEL OCCUPANCY TAX GRANT FOR THE FISCAL YEAR 23 24 BUDGET IN THE AMOUNT NOT TO EXCEED $60,000 TO THE GREAT AMERICAN SHOOTOUT. THIS IS OF COURSE, THE GASSO TOURNAMENT THAT WE KNOW COMES IN ANNUALLY BRINGS IN A LOT OF, UM SCHOOL LEVEL PLAYERS AND COLLEGE COACHES LOOKING AT THOSE PLAYERS . MR GARCIA'S HERE YOU HAVE ANY QUESTIONS ABOUT THE GRANT AND THE TOURNAMENT? IT'S SO. ALRIGHT I DON'T FORESEE. CONSIDER A RESOLUTION AUTHORIZING THE FIVE YEAR ENGAGEMENT FOR PROFESSIONAL AUDITING SERVICES WITH THEO BROWN AND HILL LLP WITH AN ANNUAL ANTICIPATED EXPENDITURE OF $56,500, PROVIDING FOR A TOTAL ANTICIPATED EXPENDITURE.$282,500 OF COURSE, WAS BROUGHT AS A RECOMMENDATION BY THE AUDIT COMMITTEE COUNCIL AUTHORIZED THE STAFF TO GO AHEAD AND MOVE FORWARD WITH NEGOTIATING CONTRACT. THE FIVE YEAR CONTRACT IS WHAT IS BEFORE YOU WITH ALL OF THE AMOUNT OF 282,500 MR BALDWIN IS HERE IF ANYBODY HAS ANY QUESTIONS ABOUT SPECIFICS ABOUT THE ENGAGEMENT WITH THIS COMPANY. THANK YOU. RIGHT FOUR D CONSIDER A RESOLUTION APPROVING THE INTER LOCAL AGREEMENT BETWEEN THE CITY OF DUNCANVILLE AND DALLAS COUNTY TO PROVIDE HIGHWAY ACCIDENT INVESTIGATION SERVICES AND AMOUNT NOT TO EXCEED $59,000. THAT'S SOMETHING WE'VE BEEN DOING FOR QUITE A WHILE, WHILE POLICE OFFICERS TOO. AH GET BACK TO SERVING THE RESIDENTS OF DUNCANVILLE RATHER THAN HAVING TO DO A PROLONGED INVESTIGATION OF HIGHWAY CRASHES . UH IS AN AMOUNT THAT THE DALLAS COUNTY SHERIFF'S OFFICE DOES CHARGES FOR THIS CHIEF OF IGNEOUS HERE IF THERE ARE ANY QUESTIONS ABOUT THE SERVICE OR THE AGREE. FOUR E. CONSIDER A RESOLUTION AUTHORIZING THE NOTATION OF SIX IN CAR DIGITAL VIDEO RECORDERS, DVR AND ACCESSORY EQUIPMENT AND 65 BODY, ONE CAMERAS AND ACCESSORY EQUIPMENT. KENNEDALE POLICE DEPARTMENT AND THE HUDGENS POLICE DEPARTMENT. AGAIN. PEOPLE CAN PROVIDE ANY SPECIFICS. THAT COUNCIL IS REQUESTING. BUT THESE ARE ITEMS THAT ESSENTIALLY FOR OUR POLICE DEPARTMENT HAVE BECOME THIRD PLUS, GIVEN THE UPGRADE TO THE CAMERAS AND THE IN CAR THAT THEY'VE GOTTEN DUE TO THE SENSITIVITY OF SOME OF THE WHAT THE CAMERAS CAPTURE. UH IT REALLY MAKES THEM UNAVAILABLE TO AUCTION OFF OURSELVES TO PRIVATE INDIVIDUALS. SO THIS IS A GOOD WELL. DEAL ON OUR POLICE DEPARTMENTS PART TO HELP OUT SOME OTHER POLICE DEPARTMENTS IN THE AREA FOR THAT. OH CHEAPER VICTIM. I GUESS MY QUESTION IS HOW DO YOU DETERMINE WHO THOSE GO TO? OR IS THERE A NEED ESTABLISHED OR WHAT'S THERE WAS THERE WAS A NEED THE YOU KNOW, THESE DEPARTMENTS HAVE REACHED OUT TO US AND AGAIN. THESE CAMERAS WERE ON THEIR LAST LEGS WHEN WE WERE PROACTIVE AND WE, UH, FUNDING PRETTY GOOD CAMERAS THAT WE USE CURRENTLY. SO UM, SO THERE WAS JUST A CONVERSATION AND WE TREATMENT, STORING THESE CAMERAS, AND WE NEED TO DO SOMETHING LIKE OKAY. THIS IS A GOOD OPTION. OKAY THANK YOU. I THINK I WAS GONNA SAY IT'S COMMENDABLE ALSO THAT THESE ARE STILL USABLE EVEN THOUGH THAT WE HAVE UPGRADED TO BE ABLE TO
[00:05:02]
REPURPOSE THEM WITH OTHER POLICE DEPARTMENTS WITHIN THE THANK YOU VERY, VERY GOOD. THANKS TO ALL THE FINANCE AND POLICE DEPARTMENTS WERE INVOLVED IN THAT PROCUREMENT. MAKE THAT HAPPEN. SO THANK YOU VERY MUCH. IT'S A GOOD MOVE. THANK YOU FOR F CONSIDER A RESOLUTION APPROVING THE TERMS AND CONDITIONS OF A MULTI USE AGREEMENT BY AND BETWEEN THE CITY OF DUNCANVILLE AND THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE INSTALLATION AND USE OF THE LICENSE PLATE READER CAMERA ADJACENT TO THE ROADWAY. ANOTHER POLICE I DON'T THIS IS SOMETHING THAT HAS ALREADY BEEN APPROVED BY COUNCIL FOR THE PURCHASE OF BUT WE REQUIRE BECAUSE OF WHERE IT'S GOING TO BE PLACED ALONG A HIGHWAY SERVICE ROAD. WE REQUIRE AN AGREEMENT WITH THANKS DEPARTMENT OF TRANSPORTATION IN ORDER TO PLACE SPECIFICITY AS I AS I READ, IT WAS JUST BECAUSE IT'S GOING TO BE A HIGHWAY 67 THAT BLANC TEXTILE BROTHER BEING WITHIN THE METROPOLITAN AREA THAT WE STAND IN. IT REQUIRES A SPECIAL ARRANGEMENT WITH TECH START TO PUT THAT CAMERA PLACE, CORRECT. OKAY. OKAY. THANK YOU. ITEM FOUR G. CONSIDER A RESOLUTION AWARDING A BID AND AUTHORIZING AN AGREEMENT WITH CALDWELL COUNTY CHEVROLET FOR CHEVROLET TAHOE AND EXPENDITURE AMOUNT OF $49,235 ATTACHED HERE TO AND INCORPORATED HERE IN AS EXHIBIT A WARNING A BID AND AUTHORIZING AGREEMENT WITH DEFENDERS SUPPLY FOR VEHICLE UP FITTING. IN AN EXPENDITURE AMOUNT OF $9307.70. ATTACHED HERE TO AND INCORPORATED HERE AND AS EXHIBIT B FOR TOTAL EXPENDITURE AMOUNT OF $58,542. BELIEVE THIS IS FOR THE ASSISTANT POLICE CHIEF KERR. THERE WAS WE HAVE BEEN WAITING FOR QUITE A WHILE TO GET ONE. WE HAVE A LEAD WITH ABOUT ONE ON A LOT, AND SO MR BROCK AND OUR PROCUREMENT OFFICE HELPED US WITH AN EMERGENCY PURCHASE OF THE VEHICLE COMING TO COUNCIL ASKING FOR AUTHORIZATION OF SPENDING MONEY. QUICK QUESTIONS KIND OF DECIDED. IS THE. PAINTING IS THIS GOING TO BE A WHITE ON WHITE OR WHAT WAS IN THE WHITE HOUSE WHITE IS THIS A WHITE ON WHITE? WELL, BLACK AND WHITE. BIG SO THAT AGAIN, THIS WON'T BE A MARK VEHICLE WILL BE SOME LIGHTS JUST IN CASE. UM THIS IS CHIEF EVER FINDS HIMSELF IN A ROADWAY NEED TO BLOCK TRAFFIC. THAT WOULD BE COVERED.UM. NOT NOT EVEN NOT WHITE. IT'S JUST GONNA HAVE TAX EXEMPT PLATES ON IT. AND EXACTLY EXACTLY, AND THIS HAS ALREADY BEEN FUNDED WITH POSITIONS FUNDED A LOT OF PROBLEMS. FUNDING I'M JUST ASKING ABOUT THE APPEARANCE OF THE MEDIA ITSELF, OKAY? 48 CONSIDER A RESOLUTION AUTHORIZING CHANGE ORDERS EIGHT THROUGH 12 FOR F B 21 00 TO DANIEL BELL ROAD, STREET RECONSTRUCTION AND SUBSURFACE UTILITY IMPROVEMENTS PROJECT USING PROJECT CONTINGENCY FUNDS FOR TOTAL EXPENDITURE AMOUNT OF 103,775 SETS. I BELIEVE IN THE STAFFER.
THERE WAS A TABLE THAT INCLUDED THE CHANGE ORDERS, MR MCBURNETT. THANK YOU. ONE THING. I'M KIND OF CURIOUS ABOUT ON THIS PARTICULAR ISSUE. IS THIS HAS BEEN A LONG DRAWN OUT, UH, PROJECT AND MY UNDERSTANDING IS THAT THEY ACTUALLY OWE US MONEY. SO I'M CURIOUS OF WHY WE'RE I THINK THIS WHERE WHERE IT SHOULD BE ABLE TO ADJUST OFFSET MISS COLTON. ACTUALLY I'LL DO FIRST TO MR ELTON ON THAT QUESTION. I DON'T REALLY HAVE THAT RIGHT ANSWER FOR THAT. OKAY SO THE QUESTION IS THERE ARE LIQUIDATED DAMAGES AS A PART OF THE CONTRACT. DUE TO THE DELAYS AND SO COUNSELOR AND MATT BURNETT WAS ASKING IF AH, THERE COULD BE SOME LIKE EXCHANGE OF FUNDS AT THIS POINT. GENERALLY. THE LIQUIDATED DAMAGES OR ASSIST AT THE END OF THE COMMITTEE. ONIONS AND SO THEREFORE WE HAVE TO PAY IT. NOW THE PROJECT FUNDED AND THE CONTRACT HAS TO BE AMENDED TO REFLECT THE ACTUAL COSTS. AND SO THAT'S WHAT YOU'RE DOING, AND THEN THEY'LL BE TRUE AT THE END OF AN OFFSET DURING THE MIDDLE OF CONTRAST, THE RETAINERS RIGHT JOINT TODAY DAMAGES BECAUSE YOU HAVE TO ADMIT IN THE CONTRACT NEED YOU ALSO. STATIONS THAT OKAY, OKAY, YOU KNOW, ALRIGHT
[00:10:04]
BEFORE I CONSIDER A RESOLUTION AUTHORIZING EXECUTION OF CHANGE. ORDER ONE FOR HEART BE 23 DAYS.0003 SWAN RIDGE DRIVE RECONSTRUCTION AND BEAVER CREEK AND SHADY TREE PLACED WATERLINE.
REPLACEMENT EXPENDITURE AMOUNT OF $51,260 AUTHORIZING AN APPROPRIATION OF $78,571 IN ADDITIONAL FUNDING TO ESTABLISH PROJECT CONTINGENCY FOR THE EXECUTION OF FUTURE CHANGE ORDERS. FOR A TOTAL CONTRACT AMOUNT NOT TO EXCEED 2,726,004. AND UNDERSTANDING IS THAT THERE WERE ADDITIONAL, UH NAMES THAT WERE IDENTIFIED AS THIS PROJECT GOT UNDERWAY. STAFF IS ANTICIPATING NEEDING TO MAKE THOSE CHANGE ORDERS NEEDING TO AH, ADD SOME FUNDS, AND SO THE CONTINGENCY FUND REQUEST IS TO COVER THOSE AS THOSE COME UP WITHOUT THE BRAIN PROJECT. KIND OF ON THE SIDE, RIGHT? TELL ME WHAT'S HAPPENING TO THE I WAS IN THAT AREA ABOUT A WEEK AND A HALF STRUCTURE WAS STILL UNDERWAY. SO ARE WE CLUED IN IDEA OF WOODWARD CLOSE TO COMPLETION ON THAT PROJECT I IT'S MY COMMENT IS. PERTAINING TO THE ITEM THAT IS NOT ON THE ITEMS, SO IT'S JUST KIND OF LIKE THE CURIOSITY OF HOWARD COUNTY PROJECTS COMING WITH THIS CHANGE THIS ONE REACH PROJECT WILL BE EARLY PART OF NEXT YEAR. SO OKAY , THAT'S ONE JOB. BUT MAYOR I WOULD LIKE TO MAKE THE COMMENT, TOO. THE FIRST GOOD THINGS ABOUT THE PROGRESS HAS BEEN MADE THERE. CITIZENS OVERALL, HAPPY WITH 80? YEAH I LOOKED AT IT MYSELF, BUT WE CAN HAVE THIS MAJOR MAJOR WORK. CHEERS THANK YOU, POOR J CONSIDER A RESOLUTION AUTHORIZING THE REGULAR COURSE SERVICES AGREEMENT WITH THE TRINITY RIVER AUTHORITY OF TEXAS FOR LAB ANALYSIS OF WATER AND WASTEWATER ANALYSIS, INDUSTRIAL INSPECTION AND SAMPLING SERVICES FOR ONE YEAR TERM, EFFECTIVE OCTOBER 1ST 2023. THROUGH SEPTEMBER 30TH 2024 WITH THE OPTION TO RENEW UP TO FOUR ADDITIONAL ONE YEAR TERMS AND AN ESTIMATED CONTRACT THEM OUT NOT TO EXCEED $180,000, SUBJECT TO APPROVED BY CITY COUNCIL AND AUTHORIZED FUNDS. AH TRINITY RIVER AUTHORITY PROVIDES WASTEWATER ANALYSIS AND CHEERS. THE CITY MAINTAINS DRINKING WATER QUALITY AND COMPLIES WITH T. C Q. REGULATIONS FIRE RENTAL PROTECTION AGENCY WRITING REGULATIONS AND THE FEDERAL CLEAN WATER ACT QUESTIONS ON THIS ONE. OH, I'M SORRY. SORRY. IT'S COMMON. IT'S REALLY ABOUT A FEW ITEMS. AND SO I'M LIVING TERMS EFFECTIVE OCTOBER 1 MILK TERMS EFFECTIVE OCTOBER 1 WHEN I LOOKED AT, UM, ADAM OH, THERE WAS ANOTHER OCTOBER DATE. SO I GUESS MY GENERAL COMMENT IS.
COPIES. MAKE THE EFFECTIVELY PRIOR TO BEING PART OF A GENERAL. COMMENT. LOOK ABSOLUTELY. OKAY ANYTHING ELSE? THERE'S NO ISSUES WITH THESE CONTRACTS ACTUALLY GOING INTO EFFECTIVE RIGHT. THE FIRST RIGHT . OKAY OKAY. START WHEN THE END SUPPORT EXACTLY RIGHT. THAT'S AN INTERLOCK AGREEMENT, AND THE CARD AGREEMENT EXPIRES AT THE END DECEPTION. ITEM FOUR K.
CONSIDER A RESOLUTION AWARDING RFP 23-00 TO 3. INVISIBLE ANNEX BUILDING ROOF REPLACEMENT TO ALTA VISTA GROUPING TO REPLACE THE ROOF AT THE MUNICIPAL ANNEX BUILDING, LOCATED AT ONE OF THREE P. SWEETLAND ROAD THROUGH THE CITY'S COMPETITIVE BID PROCESS, AND THE TOTAL ESTIMATED EXPENDITURE AMOUNT OF $150,000. WE DO CURRENTLY HAVE SEVERAL STAFF THAT WORK OUT OF THE ONE OF THREE ANNEX BUILDING AND THE ROOF IS APPROXIMATELY 40 YEARS OLD AND ENTIRE NEED OF REPLACEMENT. WHY WE WENT OUT FOR THIS R P MARKET TO REPLACE THAT. OKAY? YOU. ITEM FOUR. L CONSIDER A RESOLUTION AUTHORIZING THEIR PROFESSIONAL SERVICES AGREEMENT WITH STEPHEN C. MILLER E FOR ENGINEERING CONSULTANT SERVICES FOR ONE YEAR TERM, EFFECTIVE OCTOBER 1ST 2023 THROUGH SEPTEMBER 30TH 2024 THE OPTION TO RENEW FOR UP TO FOUR ADDITIONAL ONE YEAR TERMS AND AN ESTIMATED CONTRACT AMOUNT. NOT TO EXCEED $165,000 AND AUTHORIZING THE INTERIM CITY
[00:15:04]
MANAGER TO NEGOTIATE EXECUTE PROFESSIONAL SERVICES AGREEMENT AFTER APPROVAL WAS PERFORMED BY THE CITY ATTORNEY, MR MILLER WAS A FORMER EMPLOYEE OR FORMER EMPLOYEE OF THE CITY. WE'RE CURRENTLY SHORT AND ENGINEERING STAFF WERE GETTING CLOSE TO HOPEFULLY. RECTIFYING AT LEAST ONE OF THOSE POSITIONS. BUT WHILE WE'RE SHORT FOR THE ENGINEERING STAFF, AND I THINK WE'RE SHORT ABOUT THREE RIGHT NOW, UH, MR MILLER STEPS IN TO HELP WITH SOME OF THE ENGINEERING THAT WE NEED DONE AND PLAN REVIEWS FOR COMMERCIAL PROJECTS. COMMENT I THINK WE'RE FORTUNATE TO, UH, BE IN A POSITION TO HAVE SOMEONE. WITH THE FAMILIARITY REMEMBER HAS WITH THE CITY BECAUSE THAT'S UH PRICELESS IN TERMS OF WHAT YOU CAN ACCOMPLISH FOR US. IN ADDITION TO THE ENGINEERING SERVICES HE PROVIDES BACK THEN, AND I'M GOING TO CONCUR WITH THAT SAME THING VERY SOLID IN TERMS OF THE NOSE. DUNCANVILLE APPLAUD THAT IMPORTANT. AND I HAD A QUESTION, I GUESS AND SEVEN UNDERSTANDING WHY WE'RE DOING THIS COMPLETELY RATIONAL.DEFEND WITHOUT AN ENGINEER, BUT SOMETIME I REMEMBER WHEN OUR FORMER ENGINEER DID RESIGN, SO WE'VE BEEN OUT WITHOUT AN ENGINEER SINCE THAT TIME, SO FOR THE AS YOU SAID, WE'RE SHORT AS WE ARE ABLE TO HIRE INDIVIDUALS INTO THESE VACANCIES. THOSE MR MILLER'S TIME WITH US CLIMB OR DO WE CONTINUE TO USE HIM AS A SIDE CONSULTANT? IF WE BRING PEOPLE ON FULL TIME IN THE ENGINEERING ASPECT OF OUR CITY PURPOSE OF HAVING IN THE AGREEMENT WITH HIM IS TO FILL IN THOSE GAPS, EVEN IF WE DO BRING ON ONE OR TWO STAFF MEMBERS. OBVIOUSLY ONCE WE BRING THOSE ON WE HAVE TO TRAIN THEM. WE HAVE TO TRY AND GET THEM FAMILIAR WITH DUNCANVILLE. MR MILLER CAN BE BENEFICIAL AND THAT IS WELL WITH HIS KNOWLEDGE OF THE CITY AND HELPING TO TRAIN ANYBODY THAT WE WERE DOING AND THE VITAMIN R PACKAGE DOES INDICATE SOME EXTENSIONS ON A YEARLY BASIS. IS HE REALLY GOING TO BE AVAILABLE FOR THOSE EXTENSIONS, OR WE'RE JUST COVERING OURSELVES UP FOR EFFICIENCY? WELL, THE EXTENT OF THE EXTENSIONS ARE YEARLY, AND SO IF HE'S NOT AVAILABLE NEXT YEAR, IF WE DON'T NEED HIM, THEN WE WOULD LIKE TO GO SOMEWHERE ELSE IF WE'RE STILL NEEDING THOSE TYPES OF SERVICES AT THE PRESENT TIME HE FEELS HE NEEDED. HE WOULD BE AVAILABLE EXTENSIONS, OKAY? ITEM. FOUR M. CONSIDER A RESOLUTION AWARDING BIDS ARE F B 23-00 TO 2 SUMMIT PUMP STATION GENERATOR AND AUTHORIZING A CONTRACT WITH TEXAN MUNICIPAL AND INDUSTRIAL FURNACE AND INSTALLER STANDBY GENERATOR FOR THE SUMMIT WATER CONVERSATION, THE CITY'S COMPETITIVE BID PROCESS AND TOTAL EXPENDITURE AMOUNT. 579,469. THIS OLD. OKAY ALLOW US TO SECURE BACKUP GENERATOR IN CASE ANY POWER FAILURES. ANYTHING LIKE THAT. WE CAN KEEP THAT PUMP STATION GOING, MR MATT BRYANT AND MR DAVID DONALD, PROBABLY THANKFUL FOR BRINGING THIS ONE THROUGH THREE YEARS, AT LEAST THAT I KNOW HAVE PROBLEMS. SOME STATES SUMMIT STATION POPE WHATEVER ITS SUMMIT PUMPS STAY THAT ONE DAY THAT I'M READING IT. OH, AH, SO TO SEE THIS COMMENT. IT'S A BIG IT'S A BIG STICKER, BUT WITHOUT THIS WEEKEND IN DIRE TROUBLE AS A CITY, SO THANKS FOR THE THIS IS COMING TO FRUITION. WHAT'S THIS IMPLEMENTATION PLAN? LEAD TIME ON THIS THING? DO WE HAVE ANY IDEA? LET'S NOT ? THAT'S NOT HERE? I'M NOT DON'T NOTICE EXACT . I DON'T HAVE TO WAIT UNTIL THE GENERATOR COMES IN BEFORE IT CAN BE INSTALLED. IT'S AN AS BUILT. THIS ISN'T SOMETHING ON THE SHELF. YES, YES, SIR. THANK YOU. YEAH. I DON'T FOUR IN CONSIDER A RESOLUTION AWARDING DID BE 23 DEATHS, 0017 STREET MILL AND OVERLAY PROGRAM TO ANDERSON, ASPHALT AND CONCRETE PAVING LLC FOR MILL AND OVERLAY STREET IMPROVEMENTS TO THE CITY'S COMPETITIVE BID PROCESS AND AUTHORIZING CONTRACT FOR ONE YEAR TERM. EFFECTIVE OCTOBER 1ST 2023 THROUGH SEPTEMBER 30TH 2024 , BUT THE OPTION TO RENEW UP TO THREE ADDITIONAL ONE YEAR TURNS AND THE TOTAL ESTIMATED EXPENDITURE. I'M OUT. NOT TO EXCEED $1,600,000, AND THIS WILL BE FAMILIAR AND OVERLAY THROUGH
[00:20:05]
SEVERAL STREETS THROUGHOUT THE CITY AND DEFINE BYRON PUBLIC WORKS DEPARTMENT AND THERE ARE ANY QUESTIONS ABOUT SPECIFICS ON THAT MISS JACKIE AND HER TRUTH AND ANSWER THOSE I JUST WANT SIDE COMMENT FOR THOSE NEW TO THE COUNCIL. IT WAS BEEN, UM. FOR A COUPLE OF YEARS. A QUESTION WAS ASKED IF WE WERE TO UNDERTAKE. THE REPAIR OF OUR ROAD SYSTEM THROUGHOUT THE ENTIRE CITY DOING AT ONE TIME. WHAT WOULD BE THE ESTIMATED COST THREE YEARS AGO? THE ESTIMATED COST WAS AROUND $30 MILLION. THAT'S WHY WHAT WE'RE DOING. WE TAKE THIS THING IN PIECES AND PHASES AS BUT CAN ALLOW SO IT'S VERY, VERY IMPORTANT THANKS TO PUBLIC WORKS AND LOOKING AFTER THIS IS PROGRAMMING AS WE GO THROUGH THE CITY TO PREPARE THESE THESE ROADS, AND AS WE GOT A BRIEFING LAST WEEK, THAT INDEX OF THE INDIVIDUAL USERS TO LOOK AT OUR CITIES AND PREPARE THAT SO JUST THESE ARE THE ONES TODAY TOMORROW AND FUTURE, SO THIS IS VERY IMPORTANT AS WE FACE THIS STUFF. THANKS TO THE PUBLIC FUNCTION AND PROCUREMENT FOR THAT. I DON'T CARE. MAN AND SUPERINTENDENT OF STREETS KILLING THANK YOU FOR ALL THAT. THANK YOU. I DON'T 40. CONSIDER A RESOLUTION ADOPTING REVISIONS TO THE CITY OF DUNCANVILLE CHARITY CARE POLICY, AS REQUIRED BY THE STATE OF TEXAS AMBULANCE SUPPLEMENTAL PAYMENT PROGRAM. CHEAP PRODUCTS HERE. THE POLICIES THAT IN ORDER TO PARTICIPATE IN THE PROGRAM THAT ALLOWS THE CITY TO WRITE OFF CERTAIN AMBULANCE CASES TO CHARITABLE CAUSES THAT 100% WE DO HAVE TO ENTER INTO THIS AGREEMENT, AND THEN I THINK THE STANDARD FORGETTING THERE'S SOMEWHERE ABOVE. THE POVERTY LINE REPORT. 100. SO THIS IS SOMETHING THAT I THINK IT'S COMMENDABLE BY OUR FIRE DEPARTMENT AND ENTERING INTO THIS AGREEMENT BECAUSE I THINK IT ALLOWS US TO AVOID CHARGING CERTAIN RESIDENTS AND DUNCANVILLE FOR AMBULANCE SERVICES IF THEY DON'T NEED A CERTAIN THRESHOLD INCOME. REMEMBER THAT ON THIS PARTICULAR ONE, TOO, I NOTICED THE DATE WAS OCTOBER 1ST 2022, AND AS SO I GUESS MY QUESTION IS THIS IS THIS BACK DATE. YEAH I DID THAT AND WHAT THAT WAS BECAUSE WE HAVE A POLICY. AND SO IT REALLY AMENDS THAT SO IT'S JUST THE AMENDMENT THAT CARRIES BACK TO THE INITIAL APPLICATION. WE MADE MINOR TWEAKS. IT'S ALMOST TO GET THIS IN, BUT BUT IT'S BENEFICIAL. BREATH AND LAW. YES SIR. YES. FOUR P. CONSIDER A RESOLUTION AUTHORIZING THE EMERGENCY PROCUREMENT OF A HORTON TYPE ONE SOUTHERN EMERGENCY AND RESCUE VEHICLE SALES LLC, LOCATED IN COMANCHE, TEXAS, EXPENDITURE AMOUNT 345,760. BEING A NATIVE TEXAN, I HOPE I PRONOUNCED COMANCHE CORRECTLY. GOOD DEAL. COLEMAN SHEEN, A, UH THIS THIS IS FOR THE EMERGENCY PURCHASE OF AN AMBULANCE. WE DO HAVE TWO ON ORDER FOR FIRE DEPARTMENT. THEY'RE CHOMPING AT THE BIT. TO GET THOSE. HOWEVER IT'S ANTICIPATED THAT THOSE WON'T GET HERE UNTIL FALL OF NEXT YEAR, AND IN THE MEANTIME, WE'RE WORKING THROUGH SOME ISSUES WITH OUR CURRENT AMBULANCES. THIS WILL ALLOW US TO BRIDGE THAT GAP . THANK CHIEF ROHDE TOLD ME THAT THE THIS IF WE APPROVED THIS COULD BE HERE. MAYBE BY DECEMBER OF THIS YEAR, WHICH WOULD ALLOW US ALMOST A FULL YEAR COVERAGE WITH THE EMERGENCY PURCHASE.COINCIDENTAL WITH YOUR BRIEFING TO US, BUT WAS LESS THAN THE COUNCIL MEETING BEFORE YOU TOLD US THAT THIS WAS A POSSIBILITY THAT YOU AND CHIEF CHANGE SHOULD ALWAYS KIND OF LOOKING FOR THINGS AND THIS ONE. THIS ONE CAME UP AS AN OPPORTUNITY TO SEIZE IT AND WRITE THAT CONTRACT TO GET THIS ONE ON THE FOCUS IS A GOOD MOVE TO SO YEAH, MR MCBURNETT? YES. SORRY COMIC KIND OF PIGGYBACK ON THANK YOU ALL FOR BEING INTELLIGENT WITH THIS BECAUSE I DEFINITELY APPLAUD THIS. BEING DONE. TML CONFERENCE . I TALKED TO THE FIRM THAT WAS THERE DID PARK. UM AMBULANCES AND FIRE TRUCKS, AND I SAID RIGHT NOW, THE DEMAND AND LEVELS 30 MONTHS TO 48 MONTHS TO GET TRUCKS. I MEAN, IT'S JUST IT JUST KEEPS GETTING WORSE. AS WE'RE GOING, AND THEY'RE SAYING MAYBE IN TWO YEARS, THE DEMAND WILL START. THAT'S WHERE IT IS, BUT THAT'S HOW MUCH FURTHER WE ACTUALLY NEED TO PLAN. TO MAKE SURE THAT WE'RE TAKING CARE OF THE HEART. OUR FOCUS AND OUR CITIZENS. THIS IS RIGHT ON THIS IS GOOD. KEPT HER U A W ON STRIKE. SO, UH, I THOUGHT THAT
[00:25:07]
WAS RUDE. MAYBE IN THE LAST TIME I HEARD THEY WANTED PLANS FOR US STRAIGHT ACROSS THAT AND SOME OF THOSE PLAYERS OF THE GET INVOLVED INTO THE ACTUAL CHASSIS IS THAT WE NEED TO DRAW THAT OUT. MORE THAN 48 MONTHS, SO WE REALLY HAVE TO BE DILIGENT. THINK DOWN THE ROAD ON PURCHASING SOME OF HIS DEATH AS WE GONNA GET WOULD LIKE TO THANK THE CHIEF RODEO ECHO THIS ALSO THANK MR BROCK AND OUR PURCHASING DEPARTMENT AND HELPING STEER SOME OF THESE EMERGENCY PURCHASES THAT ARE HELPING OUR PUBLIC SAFETY FOLKS GET THESE CARS. IN A TIMELY FASHION SO THAT WE CAN CONTINUE TO OFFER SERVICES TO THE FOLKS IN DUNCAN. ALRIGHT, ALRIGHT AWAY. PERSON PURCHASE, BUT IT IS COVERED BY THE TWEET REPLACEMENT. CORRECT? YES, SIR.BORROWING MONEY SOMEWHERE ELSE. NO, SIR. THANK YOU. ALRIGHT I DON'T FORK YOU CONSIDER A RESOLUTION AUTHORIZING THE PROCUREMENT OF ONE STRIKER POWER PRO TWO STRETCHER AND ONE STRIKER MTS POWER LOADING SYSTEM FROM STRIKER CORPORATION FOR TOTAL EXPENDITURE AMOUNT OF 65,000. 0 $3.27 7 THURMAN. AH SIMPLY PUT THE EMERGENCY AMBULANCE THAT WE TRYING TO PURCHASE. GOTTA FIT IT. SO WE NEED A STRETCHER AND POWER LOADING SYSTEM TO GO INTO THAT EMERGENCY. VERY GOOD. ADD THESE TWO SYSTEMS RIGHT HERE. I'M REALLY NECESSARY FOR THOSE ANSWERS FOR THE FACT THAT IT CUTS DOWN A LOT OF OUR WORKERS, COMP CLAIMS AND INJURIES, SO THIS ONE WOULD GO IN THE BACK OF HIS NEW AMBULANCE, SO IT'LL WILL STILL BE ABLE TO KEEP THOSE INJURIES DOWN THE MINIMUM. TO GIVE A LITTLE MORE ELABORATION OF WHAT SHE WAS SAYING IS THAT YOU DON'T UNDERSTAND WHERE THE INJURY INJURY OUR PEOPLE. FOR E. M S S IN TERMS OF HAVING TO LOAD AN INDIVIDUAL THAT SAY THERE ARE Ā£3 100 POUNDS Ā£400. IT'S NOT A PHYSICAL LOAD. THIS IS THE POWER LOADING SYSTEM THAT ALLOWS THEM SORRY. MESSES MTS, OUR DOCTOR FOR THEMSELVES, HAVING TO TAKE CARE OF INDIVIDUALS THAT HAVE SOME SOME WEIGHT. SO IT'S VERY, VERY IMPORTANT THAT WE HAVE THESE THINGS. YEAH. I DON'T FOR OUR CONSIDER A RESOLUTION AMENDING THE FY 23 24 MASTER FEE SCHEDULE FOR PLANNING AND NEIGHBORHOOD SERVICES. UH THINK, UH, THERE'S JUST A MINOR TWEAKS TO THE FEES THAT AH PLANNING AND NEIGHBORHOOD SERVICES WERE DOING MOSTLY HAD TO DO WITH FOOD VENDORS. AND YES, THERE WAS THREE. I THINK THREE FEES THAT ARE BEING CHANGED, WHICH ARE IN THE PACKAGE. THE ONLY ONE THAT I DIDN'T GET APPROPRIATELY ADJUSTED. ONE MOMENT YOU THE FEVER RESOLUTION, SO WE'RE COMING BACK. SCHEDULE COMMENTS I'VE HAD FROM CITIZENS AND THEY HAVE TO BE $25 MYSELF. CAN BE FUN. 25. YEAH. IT'S ONLY IMPORTANT. I SAID, WELL, SO ALL YOUR STUFF AND VALUE KNOW THAT WE ARE KEEPING ON TOP OF BEFORE IT NEEDS TO BE DONE IN OUR CITY, SO IT JUST ISN'T FAIR. YEAH FAIR. I JUST WANTED TO KNOW NOTHING ABOUT 25. YEAH. THEY ARE . THEY COMPARISON TO THE OTHER SURROUNDING CITIES AROUND AROUND THE SAME PRICE AS THESE SURROUNDING CITIES. MOST OF OUR FEES ARE IN LINE WITH THE SURROUNDING CITIES ARE DOING THERE ARE VARIANCES WHEN YOU GET INTO ACTUAL SQUARE FOOTAGE OF COMMERCIAL BUILDINGS OR RESIDENTIAL HOUSE THINGS LIKE THAT, UM, SO YOU'LL SEE VARIANCES ACROSS CITIES. BUT FOR THE MOST PART, SOME OF THESE STANDARDS FEES WERE TRYING TO BRING OURSELVES TO THE LEVEL THAT THOSE CITIES ARE AT SO THAT WE'RE COMPETITIVE AND NOT PUNITIVE. MR COHEN'S COMMENTS.
SO THE SO. DRUG SALE PIECE ABOUT THAT IS THAT'S THAT IS NEW. CHANGE AND. I GUESS I'M JUST WONDERING PRACTICAL SENSE SO NEIGHBORHOOD SERVICES FORCES SAYS YES SO SOMEBODY. WHAT IS THE ENFORCEMENT LOOK LIKE? SOMEBODY'S HAPPY. BROAD SALES PERMIT. SO THERE SHOULD BE A PENALTY CLAUSE BUILT INTO THAT, BUT NEIGHBORHOOD SERVICES CAN ISSUE A NOTICE OF VIOLATION FOR NOT, UH, GETTING A PERMIT TO DO THE GARAGE, BUT WE CAN DEFINITELY LOOK UP THE ORDINANCE
[00:30:02]
AND MAKE SURE WE GET YOU THE FULL INFORMATION ON WHAT ANY PENALTIES OR FINES MIGHT BE IF THEY'RE DOING A GARAGE SALE DEPARTMENT PROVISIONS GET DOUBLE DOUBLE THE FINE DOUBLE PERMIT.TO GET A LATE PERMIT, RIGHT? I GUESS WHAT I NOTICED FILING I GUESS WHAT MY QUESTION, I GUESS CONCERNS. MAKING SUGARS. I DIDN'T GET ONE OR TWO OF THE SAME. COURSE. AND YOU KNOW, HOW DO WE MAKE SURE THAT IT'S ENFORCED SO THAT. SO THAT IT'S BEING FORCED INDISCRIMINATELY. I DON'T BELIEVE EQUITY RIGHT? AND SO. I DON'T I DON'T KNOW IF I'M IN. FAVOR OF ADDING THAT CHARGES STUNK. CONVINCE ME OTHERWISE OTHERWISE MIGHT NOT BEING PAID FOR THAT. WELL, LET ME ADD SOMETHING TO THAT. THE NO ENFORCEMENT COMES WITHOUT COST AND YOU'RE ADDING ABOUT ENFORCEMENT AND SO TO PUT OUR PEOPLE ON THE STREET ON A THURSDAY OR FRIDAY OR SATURDAY COURSING AROUND THE CITY TO LOOK INSIDE AND SAYING, HAVE ANY CROSS SALE AND THEN HAVING THEM INDISCRIMINATELY OR EQUITABLY STOPPING THING? DO YOU HAVE A PERMIT? THAT IS THE COST OF PERSONNEL COSTS? $25 FEE TO HAVE THAT PERMIT IS SUBSIDIES SUBSIDIZING PERSONNEL COSTS FOR THAT ENFORCEMENT. THAT WAS PAINFUL TOES. MR CONTRERAS, AND I'M NOT TO FOLLOW UP ON COUNCILMAN COACH REMARKS AND I'M NOT UNDERSTAND THE MECHANICS OF. WHAT IT TAKES FOR US TO ENFORCE THIS AND WHY THERE IS A COST INVOLVED. BUT I ALSO KNOW THAT A LOT OF PEOPLE THAT ARE HAVING GARAGE SALES THEY MAY BE DOING IT TO PAY A LIGHT BILL. MANY OF THEM ARE JUST AT A POINT WHERE THEY'RE SELLING STUFF BECAUSE THEY HAVE TO, SO THE $25 HAS A LITTLE BIT OF MISTAKE. FROM MY REAL QUESTION REGARDING THIS IS UM. WHAT WHAT? WHAT ACTIONS ARE TAKEN WHEN WE CATCH SOMEBODY.
GENERALLY I START ON THURSDAYS OR FRIDAYS, AND WE CATCH SOMEBODY WE ALLOW THEM TO CONTINUE AND ASK THEM TO COME IN AND TAKE CARE OF IT. BUSINESS DAY OR DURING THE BUSINESS DAY, BUT WHERE DO WE SHUT THEM DOWN AT THAT POINT? MAYBE MR GARCIA GARCIA, MANAGING DIRECTOR DEVELOPMENT SERVICES TO ANSWER YOUR QUESTION, COUNSELOR. CONTRERAS RIGHT NOW, THE CODE ENFORCEMENT OFFICERS ARE WORKING ON SATURDAY MORNING. TAKE A LIST OF WHO HAS A PERMIT. THEY NOTIFY THEM OF THE VIOLATION AND WILL HAVE TO COME IN AND REGISTER, BUT THEY DON'T SHUT THEM DOWN TO CONTINUE, BUT THEY NOTIFY EDUCATE THEM THAT THEY WOULD HAVE TO GET THE PERMIT FOR THE GARAGE SALE. BUT PRIMARILY WHAT THEY'RE DOING IS THEY'RE MAKING SURE THEY'RE NOT PUTTING THEM IN THE RIGHT OF WAYS. AS YOU PROBABLY WEAR. THERE'S BEEN A TIME WHEN THERE WAS SEVERAL SIGNS THROUGHOUT THE CITY THAT THAT'S WHAT WE'RE TRYING TO CURTAIL SOME OF THAT ACTIVITY.
THANK YOU. OH INTERESTINGLY, IN MY NEIGHBORHOOD THIS WEEK WATCH DRIVING AROUND SOME OF THE GRASS SALE SIGNS OF PEOPLE HAVE POSTED. THEY PUT THE PERMIT NUMBER. REQUIRED THAT'S WHAT I'M SAYING SO THAT THAT'S INDICATIONS OF COMPLIANCE AND UNDERSTANDING WITH THAT, SO I SAW THE PERMANENT ARE ACTUALLY OFF ON THE SIDE OR SOMETHING. YEAH, MARIJUANA COMMENT ONE TO MAKE IS THAT DONATION BOXES, ISSUES THAT THAT WAS ONE OF THE THINGS THAT THAT ALSO NEEDED.
IT'S GOOD. THOSE EFFORTS AS WELL, TOO. OKAY? MY CONNECTION. WHILE YOU'RE DOING THAT THIS IS NOT ONLY AGENDA, BUT WE DO HAVE OUR NEW BUILDING OFFICIAL WITH US TONIGHT. MICHAEL FORMAL INTRODUCTION DURING THE COUNCIL CHAMBERS. BUT MR KIRK GASSING HAS JOINED US AS OUR NEW BUILDING OFFICIAL. WE'RE HAPPY TO HAVE HIM HERE. IT'S ALREADY HIT THE GROUND RUNNING. HEY WHAT'S INTRODUCED THE OTHER TWO IN ONE? THERE ARE PRACTICALLY NAMES, BUT MIGHT NOT BE FOR MR KURT. YEAH MCKEE'S THE INSPECTOR BUILDING. INSPECTOR SANJAY, SO HE'S THE MANAGER OVER THEIR PERMIT TAX INSPECTIONS. GOOD YEAH. WORK YES, SIR. YES, SIR. YEAH $25, BUT AND I ALSO HAD A CONVERSATION WITH SOMEONE WHO SAID, YOU KNOW, I DO THE DRIVE SALES TO SUPPLEMENT MY INCOME DOESN'T SEEM LIKE A LOT. MAYBE SOME OF US BUT SOME PEOPLE. THERE'S A LOT OF THINGS I WOULD LIKE TO MOVE THIS OVER JUST FOR FURTHER DISCUSSION. I DON'T KNOW. INDIVIDUALS CONSIDERATION.
I'M NOT SURE THAT'S THE IS IT NOT SURE ADDRESSING MR COACHES AND FOR CONSIDERATION OR THE TABLE AND HAVE MORE DISCUSSION AND THEN COME BACK SUPPORT DISCUSSION ABOUT THIS. YEAH, I
[00:35:03]
THINK HE WANTS TO MOVE IT FOR ITEMS FROM INDIVIDUAL CONSIDERATION TO TONIGHT'S AGENDA. OKAY? SO THIS WOULD BE FOR OUR. THIS WOULD BECOME ITEMS . FIVE OKAY? YEAH MR KEYES AND TELL IF YOU HAVE TO REMEMBER THAT. YES SIR. SORRY DAD. SURE SO FOR THE. MINE'S 1 73 TO 1 76.SO THOSE ADDRESS TEMPORARY. FOOD TRUCKS, RIGHT TEMPORARILY, OKAY? AND SO UNDER ALREADY. REQUIRED PERFECT FORMS. FINAL PARKING PLACE. FOR EXTENDED PERIOD OF TIME, WEEKS OR MONTHS. BE THERE FOR EACH. HOW ABOUT THE PERMIT THAT THEY NEED TO OPERATE IN THE CITY PARK FOOD, TRUCK AND PARKING LOT THERE FOR TWO MONTHS. MR GARCIA WAS NOT PRESENT FOR YOUR QUESTION. MR CUTS COULD RESTATED, PLEASE THE MASTERPIECE SCHEDULE, SO WE'RE JUST TALKS ABOUT TEMPORARY TRUNKS TEMPORARILY FOR DAVE. BUT WHAT ABOUT FOR FOOD TRUCKS? ARE THERE SEEMINGLY PERMANENTLY FOR SAY A MONTH, SO YES, THIS IS THIS IS ONE OF THE ITEMS THAT WE DISCUSSED WITH MR CASON BILLION OFFICIAL RECOMMENDATION THAT SINCE WE DO HAVE TWO TRUCKS, AND IT'S COMPLETELY DIFFERENT. LET'S SAY A BAKE SALE, YOU KNOW CANDY SALE, ETCETERA THAT GIVING THEM AN ANNUAL APARTMENT $125 FOR THE YEAR AND THEN IN THAT PERMIT, IDENTIFY EVERYTHING THAT THEY'RE GOING TO BE SELLING. AND THEN THAT WOULD BE A FUNCTION OF THE HEALTH INSPECTOR TO GO IN AND CONTINUE INSPECT AND MAKE SURE THAT I'M VIOLATING THAT APPLICATION WITHOUT PERMIT. AND THAT WOULD RESULT THAT ISSUE IF THEY DO CHANGE WHAT'S ON THEIR TOURNAMENT BASED ON INSPECTION BY HEALTH INSPECTOR WOULD HAVE TO PAY AN ADDITIONAL FEE BECAUSE THEY'VE ADDED SOMETHING TO THE APPLICATION, WHICH THEY SHOULDN'T DO. SO THAT'S GONNA BE A FUNCTION OF THE INSPECTIONS NOW, WITH REGARD TO THE ONE TIME DEPARTMENT INSPECTION, LET'S SAY WE HAVE SOMEBODY WHO COMES IN AND THEY'RE GONNA HAVE ONE AND THAT WILL BE A $75 INSPECTION FOR YOUR FEET FOR THE APPLICATION. NOW, IF I WAS A FOOD TRUCK WAS GOING TO BE IN CONTINUOUSLY PROBABLY OPT FOR $25 ANNUAL FEE. THAT WAS COMING FOR ONE TIME AND THEN I MIGHT JUST GO WITH THE $75, PLEASE. AND THAT WAS MAINLY BECAUSE AS YOU KNOW, WE HAVE DUNCAN SWITCHING COMING PERIODICALLY THROUGHOUT THE YEAR. UM WE WANTED TO MAKE SOMETHING THAT WAS, I GUESS WOULD ENCOURAGE MORE FOOD TRUCKS TO COME IN AND PARTICIPATE ANNUALLY TO EACH EVENT. SO MR CASON CAME UP WITH THE IDEA THAT MAYBE AN ANNUAL FEW $100 AND SPICE ASKING ABOUT TRUCK PARKS OUT HERE FROM THE PARKING LOT AND SITS THERE 300 DAYS A YEAR. THAT'S WHY HE THAT'S RIGHT. IT WOULD BE 100 $25 FEE ANNUAL C $25. THAT'S CORRECT. YES, SIR. THERE FOR THE ENTIRE YEAR. AS LONG AS YOU DIDN'T CHANGE WHAT YOU PUT ON YOUR APPLICATION THAT'S CORRECT. MY MISTAKEN I DON'T THINK WE WERE LIMITED ON HOW OFTEN THEY CAN BE THERE. THINK ABOUT EVERY DAY OR THEY JUST ALLOWED ON WEEKENDS. I THINK THEY'RE ALLOWED WHATEVER THEIR PERMIT, SO YOU GET A PERMIT THERE THREE DAYS, FOUR DAYS, NOT 365 DAYS, BECAUSE NOW THAT'S SOMETHING HELP FOR WEEKENDS, SO IT'S REALLY SUPPOSED TO BE TEMPORARY USE PERMANENT, RIGHT? BUT THEY WOULD HAVE AN ANNUAL APARTMENT. THEY WOULD ONLY PAY ONE TIME THAT WOULD BE COULD COME INTO TOWN AND HAVE THE PERMIT WITHOUT HAVING TO GET RE PERMITTED DIFFERENT LOCATIONS IN THE CITY NIGHT MARKET PARKING LOT AND JUST SIT THERE. THAT'S A WHOLE DIFFERENT NATIONS TEMPORARY VERSUS PERMANENT. AT LEAST THAT'S HIM. THAT'S RIGHT TRUCK.
THAT'S A RESTAURANT. YEAH AND WHAT IT STATES IS YOUR ANNUAL FEE FOR ANY EVENT. SO AGAIN, THAT'S EVENTS, BUT NOT PERMANENTLY. OKAY THAT'S GOOD. I'LL BE CORRECT. I TOLD THAT MISUNDERSTANDING, SO THERE'S NOTHING THAT WILL LOOK INTO IT, BUT BECAUSE THE CONCERN THAT SOMEBODY WOULD PARK A FOOD TRUCK THAT'S MR ANDERSON PARK IN THE PARKING LOT, AND YOU LEAVE IT THERE. 3 65 OVERNIGHT ALL THE TIME. YOU'RE ESSENTIALLY RUNNING A RESTAURANT WITHOUT HAVING TO INVEST CAPITAL AND BARNEY. YEAH IT SHOULD BE 500. ALREADY BEEN MOVED OUT INDIVIDUAL CONSIDERATION. WE'RE NOW TAKING TIME ON CONSENT. MAYOR CITY COUNCIL MEMBERS. MY NAME IS PAMELA. HOPEFULLY PARTNER WITH MY MARKER ASSIGNED TO LISTEN TO THAT TO YOU. THANK YOU. AND THE PARTNER ASSIGNED TO REPRESENT THE CITY OF DOCUMENT VILLE AND MANY OF YOU, YOU KNOW, US, BUT THOSE YOU MAY NOT KNOW OUR LAW FIRM. MY LAW FIRM HAS BEEN IN BUSINESS SINCE 1976 AND WE HAVE BEEN PROVIDING COLLECTION OF. HE TOLD ME HOW TO MOVE IN, AND I DIDN'T MOVE IT RIGHT? WE HAVE BEEN PROVIDING. COLLECTION SERVICE FOR DELINQUENT GOVERNMENT RECEIVABLE SINCE 1976 AND WE'VE PARTNERED WITH YOU, I THINK, UH, COLLECTION VENDOR ON YOUR DELINQUENT TAXES SINCE THIS
[00:45:06]
SENSE OF JULY OF 2001. WE HAVE A TEAM OF 80 DEDICATED AND DIVERSE GROUP OF PROFESSIONALS WHO WERE WORKING FOR YOU EVERYDAY WITH REGARD TO THE COLLECTIONS. A LITTLE BIT ABOUT WHAT WE VALUE.WE CERTAINLY VALUE OUR CLIENTS VERY OFTEN. PEOPLE WILL BE WHERE YOU ARE COMMUNITY. UM ONE OF THE THINGS THAT WE THINK IT'S KEITH IS THAT WE ARE DEDICATED TO SERVING ALL OF OUR CLIENTS, PARTICULARLY AND CERTAINLY DARKENED WILL IS ONE OF OUR CLIENTS. I WON'T TRY TO BUTTER ME UP AND SAY YOUR FAVORITE CLIENT. THAT'S ALL OF OUR CLIENTS. WE VALUE OUR PEOPLE.
THAT'S WHY WE MAKE SURE WE HAVE PROVIDED WE ARE HIRING EXPERIENCED PEOPLE WHO ARE INNOVATIVE AND RESOURCEFUL, AND WE ARE PROUD OF SERVING OUR COMMUNITIES. DO WHICH WE WORK.
WE PROVIDE LEGAL PROFESSIONAL SERVICES FOR YOU WITH REGARD TO THE COLLECTION OF YOU'RE DOING FROM PROPERTY TAXES PROVIDE. WE ALSO REPRESENT YOU IN STATE. AND TELLING COURTS. UM WE HAVE A TEAM OF LEGISLATIVE PROFESSIONALS WHO ARE ALSO REPRESENTING OUR CLIENTS IN AUSTIN. DON'T KNOW WHERE THIS OBSESSION SO WE PROVIDE PEOPLE LEGISLATIVE SUPPORT. WE'VE ADVISED YOU A COMPLEX WITH, UH, COMPLEX LITIGATION ISSUES WHEN THEY ARISE, AND WE ALSO REPRESENT YOU IN BANKRUPTCY COURT. SHOULD A TAXPAYER, UM ENGLISH. THIS IS YOUR IDEA OF THE THAT'S COLLECTION TIMELINE AND JANUARY 1 IS WHEN YOU'RE ATTACKING IN THE TAX LIEN ATTACHES TO EACH OF THE PROPERTIES. APRIL 1ST IS WHEN YOU SHOULD BE FOLLOWING YOUR RENDITIONS FOR BUSINESS, PERSONAL PROPERTY. JULY 25TH IS WHEN THE APPRAISAL DISTRICT SHOULD BE A CERTIFYING YOUR APPRAISAL ROLE, AND THEN THE TAXING ENTITIES LEADER AT THAT TIME ADOPTING YOUR BUCK A BUDGET AND OCTOBER IS WITH THE TAX ASSESSOR COLLECTOR IS ATTEMPTING TO SEND OUT BILLS. I KNOW THERE'S SOME BILLS. HE'S NOT SENDING OUT JUST YET BECAUSE OF WHAT'S HAPPENING IN THE LEGISLATURE, BUT USUALLY THEY'RE SENDING AMOUNT IN OCTOBER THROUGH THIS MEMORY ONE. YOU'RE THE TAX HAS BECOME DELINQUENT. APRIL 1ST YOUR BBP. PROPERTY TAXES ARE TURNED OVER TO US FOR COLLECTION AND THEN, UH, JULY 1ST IS WHAT YOU TURN OVER YOUR REAL PROPERTY TAXES ONCE THEY'RE TURNED OVER TO US, WE TAKEN, UH, ANALYZE ALL OF THE ENTIRE ROLE TO DETERMINE THE COLLECTION PROGRAM. THAT'S RIGHT FOR YOU. WE ARE IDENTIFIED AND COUNTED PROTECTED, AND THEN WE BEGIN OUR COLLECTION PROGRAM BY SENDING OUT MELONS. WE ALSO ARE SKIPPING. ALL OF THE ACCOUNTS ARE MAKING TO MAKE SURE THAT WE CAN FIND THE DELINQUENT DEBTORS SO WE CAN'T COLLECT THE TAXES AND WE CAN'T FIND THEM. GROW ALSO CONNECTING THE TAXPAYERS AND TELEPHONE AND RECEIVING THE PHONE CALLS AS WELL. AND WE ARE NEGOTIATING PAYMENT ARRANGEMENTS WITH NECESSARY AND WE ARE IDENTIFYING ACCOUNTS FOR LEGAL ACTION. SO ACCOUNTS REMAIN DELINQUENT. THEN WE WILL DECIDE WHICH ONE OF THOSE NEED TO GO INTO LITIGATION AND AT THE RESOLUTION OF LITIGATION. IF THEY REMAIN DELINQUENT, THEN THAT COULD BE SO, UH, IN ORDER TO RECOVER THEIR PROPERTY TAXES. AND I DO APOLOGIZE BECAUSE I DID NOT INTRODUCE MY TEAM HAVE A TEAM UP. INDIVIDUALS WITH ME. I HAVE KAREN BISHOP WHO IS YOUR CLIENT LIAISON ON THE TAX SIDE, AND WE ALSO HAVE ANDY TAYLOR AND SO PHONY AND JUSTICE. WHO ARE FINES AND FEES EXPERTS, BUT NOW I'M GONNA TURN IT OVER TO KAREN. MOMENT FOR YOU, PLEASE DIDN'T THANK YOU. GOOD EVENING, EVERYONE. I'M CARRYING YOUR DEDICATED CLIENT LIAISON. AND WHAT I DO AS YOUR LIAISON IS THAT I AM OUT IN THE COMMUNITY TALKING TO PROTECT PLAYERS VISITING WITH TAXPAYERS HAND DELIVERING THEM THEIR TAXPAYER. SO IF THEY HAVE NOT PAID BY THE TIME THESE ACCOUNTS GET TURNED OVER TO US ON JULY 1 FOR REAL AND BBP, THAT'S ALL OF THEM. WE GET THE BUSINESS PERSONAL PROPERTY. I WILL START WORKING ON COUNCIL AS OF APRIL, 1ST. AND THEN ON JULY 1 GET THEM REMAINING TPP THAT'S STILL IN HAITI, ALONG WITH THE REAL PROPERTY. SO UM, LOOKING AT THIS SLIDE, YOU'LL SEE IN 2022. WE WERE TURNED OVER 699. DELINQUENT TAX ACCOUNTS JUST FOR THAT TAX CYCLE TOLD ME $449,270. THAT WAS 32.5% INCREASE FROM THE BASE TURNOVER THAT WAS DONE IN 2021.
SO YOU SEE THAT IN 2022. WE HAD 449,000 THAT I JUST SPOKE ABOUT. AND THE DIFFERENCE BETWEEN WHAT
[00:50:04]
WAS RECEIVED IN 2021. WAS 100 AND $10,197. NOW THE NEXT SLIDE TELLS YOU ARE TAXED ROLE ANNOUNCES BY THE SIZE OF ACCOUNTS, AND YOU'LL SEE THE CHART TO THE FAR IS THAT LEFT? RIGHT LEFT. THANK YOU. SHOWS YOU THE TOTAL NUMBER OF DELINQUENT ACCOUNTS, WHICH IS INCLUSIVE OR TEXTURED 2022 AND ALL THE YEARS PRIOR THAT ARE STILL DELINQUENT. AND SO OF THOSE 1300 ACCOUNTS.YOU HAVE ABOUT 2 MILLION IN TOTAL DELINQUENT TAXES THAT INCLUSIVE OF THE BASE TAX, PLUS THE PENALTY AND INTEREST. AND SO WHAT I DO WHEN WE GET THE TURNOVER IS THAT I GO AND LOOK AT ALL OF THE ACCOUNTS FOR THE CITY OF DUNCANVILLE AND I WILL LOOK AT IAN BASED ON HIGH DOLLAR DOWN, SO I'M GOING TO SORT MY TAX ROLL BY THE HIGHEST DOLLAR AMOUNT FOR THE MOST CURRENT YEAR, WHICH WOULD IN THIS CASE WOULD BE 2022. AND THEN I WORKED DOWN. AND WITH THAT, YOU SEE THAT YOU HAVE ABOUT 43% OF YOUR TAX DOLLARS ARE ACCOUNTS THAT OVER $5000. SO I'M GOING TO FOCUS MAINLY ON DOORS, AND THEN I'M GONNA KIND OF WORK MY WAY DOWN, ACCORDING TO THE CHART BASED ON THE DOLLAR AMOUNT, THAT'S DUDE. THE NEXT SLIDE TALKS ABOUT THE STATUS OF ALL THE ACCOUNTS. 1500 ACCOUNTS WE HAVE ABOUT 53.8% OR EITHER 740 OF THOSE FOULS. AH, THERE ARE DELINQUENT. AND WHAT WE CONSIDER COLLECTED COLLECTIBLE ACCOUNTS THAT WE'RE ACTIVELY WORKING. AND THEN, ACCORDING TO THE MIDDLE CHART, YOU SEE THAT YOU HAVE ABOUT 49 ALMOST 50% OF YOUR FILES FALL WITHIN THE COLLECTIBLE WHERE WE CAN CALL AND CONVICTABLE CATEGORY. AND COLLECTIBLE TO US MEANS WE'RE GOING TO MAIL OUT LETTERS. WE'RE GOING TO DO RESEARCH TO FIND FIND PEOPLE FIND BAD ADDRESSES. THE MALE IS COMING BACK FROM THE TAX OFFICE. WE'RE GOING TO BE DOING RESEARCH TO TRY TO GET GOOD ADDRESSES WE'RE GONNA ALSO BE INVESTIGATION IS, PAM SAID OBTAIN JUDGMENTS. FIVE FOULING THE LAWSUIT, AND THEN SOME OF THOSE ACCOUNTS IS REPRESENTED BY AN ATTORNEY. THEN WE WORK WITH THAT ATTORNEY TO TRY TO COME UP WITH WE DON'T NEGOTIATE DOWN THE TAXES. THERE'S A LOT WE DO GET THAT QUESTION A LOT, BUT BECAUSE YOU GOTTA PAY WHAT'S OLD, BUT IF YOU HAVE AN ATTORNEY, WE WILL WORK WITH THEM, WHICH WILL SOMETIMES HELP TO GET UP A JUDGMENT WITH AN AGREEMENT ATTACHED TO IT. SO THE TAXPAYERS ON A PAYMENT PLAN AND THEN OF COURSE, WE HAVE OUR BANKRUPTCY DEPARTMENT, WHICH WILL TAKE OVER THE IF WE FILE SUIT. AND THEN THAT TAXPAYERS SHOULD HAPPEN TO FILE BANKRUPTCY DOING THAT PROCESS. THEN WE HAVE A BANKRUPTCY DEPARTMENT THAT'S GOING TO TAKE OVER THAT ACCOUNT IN BALA, CLAIMING THAT THANKLESS AND THEN THE LAST WHAT WE WHAT WE DO ON OUR COLLECTIBLE ACCOUNTS IS DUE PAYMENT ARRANGEMENTS. AND THEN YOU HAVE ABOUT 45 ALMOST 46% OF YOUR FILES THAT MAY BE ON HOLD. DUE TO THE TAXPAYER MAY BE HAVING A OVER 65 EXEMPTION OR A TAX DEFERRAL. ARE THEY COUNTIES? EXAMPLE SOME REASON SO WE'RE NOT DOING ACTIVE COLLECTION ON THAT ACCOUNT. AND THEN YOU HAVE DISABILITY AND VETERANS EXEMPTIONS THAT TAXPAYERS CAN QUALIFY FOR AS WELL AND THEN 4.9% JUST ABOUT 5% OR YOUR FILES, MAYBE UNCOLLECTIBLE AT ALL, EITHER THEIR PAST THE STATUTE OF LIMITATIONS WHERE WE CAN FILE SUIT. WHICH ON BUSINESS PERSONAL PROFIT WILL BE FOUR YEARS AND ALL REAL PROPERTY IS GONNA BE 20 YEARS. SO IN THOSE GUIDELINES, THAT MEANS THAT ACCOUNT MAY NOT BE COLLECTED $15, THEN WE'RE NOT. I'M NOT GOING OUT AND KNOCKING ON THE DOOR FOR 15. OKAY SO THE NEXT ONE, I SHOWED YOU THE PROGRAMS AND ACTIVITIES AND RESULTS THAT WE DID, UH, WE'RE ABLE TO DO FOR THE CITY AND IN JULY 2022 ONCE WE GOT THE TURNOVER FOR ALL THE ACCOUNTS THROUGH JUNE OF THIS THIS PAST JUNE, AND WE FOUND A TOTAL OF 24 LAWSUITS. 13 WERE DISPOSED ONE WAY OR THE OTHER. IT WAS EITHER PAID OR MAYBE MAYBE WE HAD TO FILE A NON SUIT OR SOMETHING CAME UP AND WE COULDN'T GO FORWARD WITH THAT CASE. WE HAD ABOUT 10 OF THOSE ACCOUNTS THAT WERE IN BANKRUPTCY . SO THEN I BANKRUPTCY DEPARTMENT WILL COMMUNITY THEIR WORK. AND THEN, UM, FOR DUNCANVILLE. WE DON'T GET A LOT OF WE DON'T REALLY PUT A LOT OF FILES FOR, SHERIFF SAID WE DON'T GET A LOT OF THEM. WE ONLY HAD ONE DOING THAT 12 MONTH CYCLE, BUT THAT'S NOT INCLUSIVE OF EVERYTHING THAT WE PROBABLY HAVE GOTTEN THE SALE FOR. CITY IN DUNCANVILLE, AND THEN IT SHOWS HERE THAT I DID ABOUT 46 SITE IS IT'S IN THE 12 MONTHS. CYCLE ON THE TOP OF THE TAX PAPERS. HAD SOME SUCCESS ON SONGS ON MY DIDN'T THOSE THAT I WOULD NOT
[00:55:04]
WAS NOT ABLE TO COLLECT. I WILL FOR EVERYTHING OR THOSE ACCOUNTS TO LAWSUIT. SO THEN WE MAIL DATA OVER 1800 LETTERS. DELINQUENT NOTICES TO TAXPAYERS INCLUSIVE OF ME, ACTUALLY GOING OUT AND HANDLE LIVING HERE. NOTICE SO IN TOTAL, WE COLLECTED $546,910 FOR THE CITY OF DUNCANVILLE FOR THAT 12 MONTH CYCLE. AND THAT DOESN'T FOOD BASED TAX PENALTY AND INTEREST AND OUR ATTORNEY'S FEES WHICH ARE PAID WHEN THE TAXPAYER PACER TAXPAYERS SO THE CITY IS NOT PAYING US TO DO THESE COLLECTION EFFORTS. SO THIS ONE TALKS ABOUT OUR DIFFERENT PAYMENT OPTIONS AND, UM SO WE STARTED OUT. WE HAVE THREE PAYMENT OPTIONS. YOU GET TO GET A REGULAR PAYMENT AGREEMENT, WHICH CAN BE A MINIMUM OF 90 DAYS UP TO 12 MONTHS. IF THIS IS YOUR HOMESTEAD AND THEN IF YOU IF IT'S NOT YOUR HOMESTEAD, WE CAN DO THE 1912 MONTHS. BUT IF YOU HAVE THE HOMESTEAD EXEMPTION THAT HAS BEEN GRANTED BY THE DALLAS THAT'S REALLY APPRAISAL DISTRICT. THEN WE CAN GIVE YOU A MINIMUM OF 12 MAXIMUM 36 MONTHS. ON THE CURRENT YEAR OF DELINQUENT TAX. SO WHAT? THAT WHAT THAT DOES FOR THE TAXPAYER IS GIVE THEM AN OPTION TO MAKE SMALLER PAYMENTS OVER UP TO THE LEAST A THREE YEAR PERIOD. BUT IT ALSO ALLOWS THEM TO STAY IN THEIR HOME. AND NOT HAVE TO WORRY ABOUT BEING FORECLOSED. WE MAY EVEN GET A JUDGMENT IF WE DO GET A JUDGMENT. THAT'S WHERE THE POST JUDGMENT PAYMENT AGREEMENT COMES IN, AND THEN THOSE THINGS ARE APPLIED DEPENDING ON THE TAXPAYER'S ABILITY TO PAY, WHETHER THEY NEED 12 MONTHS OR MORE IN THE LAST SECTION RIGHT HERE, BOX TALKS ABOUT THE EXEMPTIONS THAT I SPOKE ABOUT A LOOP OF FEW MINUTES AGO. THOSE EXEMPTIONS ARE THINGS THAT TAXPAYERS AND FILL OUT APPLICATIONS WITH THE DALLAS CENTRAL APPRAISAL DISTRICT TO GET THOSE EXEMPTIONS. WE DON'T GIVE THEM TO HIM, BUT WHAT I DO AS A COURTESY TO THE TAXPAYER IS LET THEM KNOW IF I SEE THAT THEY DON'T HAVE THAT HOMESTEAD EXEMPTION AND THAT PROPERTY IS IN THEIR NAME AND THEIR DECERTIFIED OWNER. THAT PROPERTY , THEN I WILL REFER THEM TO THE APPRAISAL DISTRICT SO THAT THEY CAN MAKE AN APPLICATION TO GET THE EXEMPTIONS IF THEY FOLLOWED BY THE WOMAN. AND WITH THAT, THAT CONCLUDES, AND PAM IS GONNA CLOSE OUT FOR ME. SO WE ALSO HAVE INCLUDED SOME INFORMATION ABOUT PEOPLE COLLECTIONS, SO THIS IS FOR YOUR INFORMATION. WE'RE NOT GOING TO TALK ABOUT THOSE TONIGHT. SO THE NEXT THREE PAGES THREE BOWLS BECAUSE YOU'LL HAVE THAT INFORMATION BEFORE. BUT IF YOU HAVE ANY QUESTIONS ABOUT THAT, PLEASE FEEL FREE TO CONTACT UH, LIKE I SAID EARLIER. WE ARE PROUD OF THE, UH, COMMUNITIES. ACTIVE IN COMMUNITY SERVICE IN YOUR CITY. AND SO THIS PATIENT SOME PICTURES OF LOOKS LIKE AND HE'S THE ONLY ONE WHO'S OUT HERE. BUT WE ARE EVERYONE'S ALWAYS REMEMBER THIS SECTOR PICTURES LOVE YOU VERY ACTIVE WHEN YOU'RE DOING IN THE CITY. AND THEN THIS IS JUST A CONTACT INFORMATION. YOU HAVE OUR MANAGING PARTNER, BRIDGEND LOPEZ, MYSELF HEARING IN OPERATIONS MANAGER THEN, OF COURSE, ANDEAN SINFONIA, SHOULD YOU HAVE ANY QUESTIONS ABOUT ANY OTHER SERVICES THAT WE PROVIDE? CONTACT INFORMATION. WITH THAT. I'LL TAKE ANY QUESTIONS IF YOU HAVE ANY JUST A QUICK QUESTION. I HEARD YOU TALK ON LAWSUITS PILING HE HAD ONE SHERIFF'S SALE , BUT I DIDN'T HEAR ABOUT ANY TALK OF LANES BEING PLACED ON THE ON THESE HOMES. IS THAT PART OF THE PROCESS BEFORE SHERIFF'S SELENA TAXES JANUARY 1ST OF EVERY YEAR. THERE'S NO ACTION THAT WE HAVE TO TAKE THE LARGEST AUTOMATICALLY, SAYS JANUARY WOMAN TAX LIEN ATTACHES TO YOUR PROPERTY. THANK YOU. ANOTHER QUESTION. OH, THANK YOU, GRANDMA . THANK YOU. FOR ALL YOU DO IS VERY YOU KNOW THAT YOU DO A LOT OF WORK BEHIND THE SCENES THAT $545 DOLLARS. COULDN'T WE DO APPRECIATE THAT? I CAN'T BELIEVE SHE KNOCKS ON DOORS. THANK YOU CAN'T BELIEVE SHE KNOCKS ON THOSE I WAS BRINGING UP WONDERING, HAVE A SHERIFF OR SOMEBODY WITH YOU. AND YOU KNOW, MAYBE OFF DOING BEEN DOING THIS PART OF BEEN WITH THE FIRM SINCE 2008 I STARTED OUT IN THE LITIGATION DEPARTMENT HAS APPARENTLY GLE AND, UH IN 2017. I WAS PROMOTED TO THIS POSITION AND FROM THAT POINT TO TODAY, I'VE NOT HAD A TAXPAYER TO BE UGLY COMMUNITY ARE THREATENED ME OR ANY OF THAT COUNTS. I'M GOING OUT. I FEEL LIKE I'M DOING SOMEONE CULTURE WOULD HONESTLY WHEN I GO OUT, SO I GO OUT ON WITH INFORMATION AND TRY TO COMFORT YOU TO LET THEM KNOW[01:00:05]
THAT JUST BECAUSE YOU GOT THIS LETTER IN THE MAIL, SAYING WE'RE ABOUT TO SUE, YOU DOES NOT MEAN YOU'RE ABOUT TO LOSE YOUR HOUSE WITHIN THE NEXT WEEK. FOUR HOURS FOR SOME TAXPAYERS DO THINK THAT AND SO I THINK MYSELF GOING OUT INTO THE FIELD ALLEVIATES THAT FEAR OF THE UNKNOWN FOR THEM, SO THEY KNOW THAT WE'RE REALLY ACTUALLY WANTED TO HELP YOU STAY IN YOUR HOUSE. AND IF THERE SHE SEEMS SHE DRIVES UP TO A HOME OR BUSINESS, AND THEY APPEAR TO BE SAFE. WE ASKED HER TO KEEP TRYING. YES I MAY MAKE A NOTE ABOUT IT. AND THEN I WON'T WON'T GO ANYWHERE. I ACTUALLY WAS LOOKING AT A PROPERTY OF YESTERDAY AS A MATTER OF FACT, AND THERE WAS A MAILBOX WAY AT THE END OF THE ROAD, BUT IT WAS LIKE THIS DRIVE. BUT WHAT IS THE HOUSE BECAUSE IT WAS ALL THESE TREES AND SHRUBS AND I WAS LIKE, I DON'T EVEN KNOW WHERE THE HOUSES SO I WAS LIKE, I'M JUST GONNA TAKE THIS NOTICE TO THE MAILBOX. SO I DID THAT AND THEN JUST OUT OF CURIOSITY, I GOT BACK IN MY CAR AND DROVE DOWN THE BRIDE AND I FOUND THE HOUSE WAS THERE, BUT IT WAS JUST COVERED UP BY BRUSH AND ALL THAT. AND SO YOU COULDN'T SEE IT UNTIL YOU DRIVE ACTUALLY DOWN THE DRIVE. BUT THAT'S WHAT I'LL DO THOSE KIND OF THINGS I HAVE TO MAKE AN ASSESSMENT. YOU KNOW WHEN I'M OUT THERE, BUT SO FAR, GOD SAY, SAY, I HAVE BEEN SAYING THANK YOU. OKAY COUNCIL FOR INFORMATION. WE WILL UNDERSTAND EXECUTIVE SESSIONS WILL BE MOVED TO THE END OF OUR CITY COUNCIL MEETING. DON'T MAKE THAT ANNOUNCEMENT THERE, SO WE'RE GOING TO RECESS THE TIME. BUT IT IS A GREAT PROGRAM AND IT'S GOOD TO SEE OUR STAFF GET INVOLVED AND DOING IT IN A PASSIONATE WAY.I'M GONNA GIVE SPECIAL RECOGNITION TO MR JEREMY TENANT WHO DOES COORDINATE THAT ON THE CITY SIDE EVERY YEAR AND BRINGS MORE ENTHUSIASM WHEN TRYING TO GET STAFF MEMBERS TO PARTICIPATE
[01:10:07]
THAN, UH, I THINK ANYBODY I'VE EVER SEEN. SO THANK YOU, MR TENNANT. AH ALSO WANT TO ACKNOWLEDGE OUR POLICE DEPARTMENT ALONG WITH SEVERAL OF OUR OTHER DEPARTMENTS, WHO PARTICIPATED IN NATIONAL NIGHT OUT AT THE RECREATION CENTER. I KNOW I SAW SEVERAL COUNCIL MEMBERS THERE. I WAS THERE. WE HAD A STRONG TURNOUT. UH AND I THINK EVEN I LEARNED SOME THINGS ABOUT OUR DEPARTMENTS THAT I DIDN'T KNOW. SO THAT'S GOOD. UM DO WANNA ALSO ACKNOWLEDGED THE HISPANIC HERITAGE FESTIVAL. WE HAD ALMOST 800 PEOPLE OR 800. PLUS PEOPLE ATTEND THAT THROUGHOUT THE DAY. IT WAS A VERY SUCCESSFUL EVENT FOR OUR PARKS DEPARTMENT. UM. WE DO. WE ARE CLOSER TO NOVEMBER THAN WE ARE SEPTEMBER. SO I DO WANT TO POINT OUT A COUPLE OF THINGS COMING UP IN NOVEMBER. WE DO HAVE THE COUNCIL RETREAT NOVEMBER 2ND AND THIRD BUT ALSO ON FRIDAY, NOVEMBER 10TH. THE LIBRARY WILL BE CLOSED FOR STAFF TRAINING DAY. NUMBER TWO ON THE AGENDA, PROCLAMATIONS AND PRESENTATIONS. WE HAVE NONE THAT TAKES US TO ITEM NUMBER THREE CITIZENS INPUT. IN PERSON CITIZEN. PERSONAL CITIZEN COMMENTS WILL BE HEARD DURING THE REGULAR SESSION IN KEEPING WITH THE CITY COUNCIL RULES OF PROCEDURE ADOPTED OCTOBER 18TH OF 2022. ELECTRONIC MAIL COMMENTS WILL NO LONGER BE READ ALOUD. PAPER COPIES WILL BE DISTRIBUTED TO THE CITY COUNCIL MEMBERS AND MADE PART OF THE RECORD AND I WILL NOTE THAT WE DO HAVE ONE WRITTEN COMMENT THAT'S BEEN GIVEN TO US IN EACH COUNCIL MEMBER HAS THAT PURSUANT TO SECTION 5 51.007 OF THE TEXAS GOVERNMENT CODE. AND A MEMBER OF THE PUBLIC HAS THE OPPORTUNITY TO ADJUST THE CITY COUNCIL CONCERNING ANY MATTER OF PUBLIC BUSINESS OR ANY POSTED AGENDA ITEM. HOWEVER THE ACT PROHIBITS THE CITY COUNCIL FROM DELIBERATING AND THE ISSUES ISLAND PUBLIC GENDER, AND SUCH NON AGENDA MAY REFER TO CITY STAFF FOR RESEARCH AND ANY FUTURE ACTION. PERSONS ADDRESSING OR SUBJECT TO COUNCIL RULES AND LIMITATIONS PERMITTED BY LAW AND FOR THE CITY COUNCIL IN THE CITY OF DUNCANVILLE. THE RULE IS THAT YOU INDIVIDUALS THAT WISH TO COME FORWARD, HAVE TWO MINUTES TO SPEAK. AT THIS TIME THERE ON THE LECTERN OF CITY COUNCIL TIMES THAT AS WELL, SO WE ASK INDIVIDUALS. IF YOU WISH TO SPEAK, PLEASE COMPLY WITH OUR TWO MINUTES RULE. SO AT THIS TIME, I'M GONNA BE CALLING FORWARD INDIVIDUALS WHO HAVE SUBMITTED COMMENTS TO BE HEARD. THE FIRST ONE IS PATRICIA EBERT.EBERT 115 SOUTH GREEN STONE 75116 AND WHAT I'D LIKE TO READ CITY SECRETARY. UH CAN YOU? YEAH WE CAN'T HARDLY HEAR IS IT ON? IT'S GREEN. OKAY GOOD. GOOD GOOD. I COULDN'T HEAR YOU CLEARLY MISSING. YES GO AHEAD. IF YOU START OVER, PLEASE. YES PATRICIA EBERT, 115 SOUTH GREENSTONE 75116. SO IN THE BACKGROUND AGENDA TONIGHT I CAME ACROSS FIVE C THAT IS ONE OF YOUR CONSENT ITEMS, AND I READ IT CAREFULLY. I'D LIKE TO READ A COUPLE OF PARTS Y'ALL BECAUSE I'D LIKE SOME CLARIFICATION. AH IT SAYS THERE IS ASKING FOR A LITTLE ALMOST 50,000 EXTRA DOLLARS TO PAY UNPAID INVOICES THAT HAVE BEEN ACCUMULATED. THERE ARE THIRD PARTY BUILDING INSPECTIONS SERVICES AND DURING THE ABSENCE OF US NOT HAVING BUILDING OFFICIALS, WHICH WE DO HAVE TONIGHT. BUT IT SAYS THE BUILDING INSPECTOR POSITION HAS BEEN VACANT CONSISTENTLY SINCE FEBRUARY, 2022 AND IT'S SAID THAT THAT'S WHEN WE STARTED USING THE THIRD PARTY INSPECTION SERVICES. AND JUNE THE SIXTH, Y'ALL APPROVED 20 EXTRA $1000 TO PAY SOME UNPAID INVOICES. AND
[01:15:06]
IT'S SAYS THAT IF YOU APPROVE THE RESOLUTION TONIGHT THAT IT WILL ALLOW STAFF TO PAY THE OUTSTANDING INVOICES FOR BUILDING INSPECTION SERVICES. AND UNFORTUNATELY, THERE WERE F Y 22 INVOICES PAID OUT OF THE FY 23 BUDGET. THAT'S WHY THEY NEED ALMOST 50 EXTRA $1000. SO MY QUESTIONS ARE IS THEIR INTERESTS ATTACHED TO THIS BECAUSE SOME OF THE INVOICES ARE BACK IN 2020 10 MONTHS OLD. AND THEN ALSO IF WE WERE WITHOUT A BUILDING OFFICIAL FOR 20 MONTHS, WHERE WAS THE BUT WHERE WAS THE SALARY AND THE BENEFITS ALLOCATED IN THIS YEAR'S BUDGET? THANK YOU.SLIDER. GAIL SLICKER 14 05, SOUTH MAIN DUNCANVILLE, TEXAS. HONORABLE MAYOR AND COUNCIL. I WOULD LIKE TO COME WITH GOOD NEWS TONIGHT. I GOT A PHONE CALL FROM ONE OF MY FARMER CLASSMATES. WHO HAS BEEN A DUNCANVILLE CITIZEN BEFORE I GOT HERE 75 YEARS AGO.
HE HAD A LITTLE ACCIDENT. HE WAS HOOKING UP HIS MORE TO HIS TRACTOR. THE TRACTOR KICKED IN GEAR. FORTUNATELY HAD NOT TURNED ON THE MORE BLADES, HOWEVER. THE BIG TRACTOR RAN OVER HIM. AND CONTINUED TO RUN HIM TRYING TO GET AWAY FROM IT. SERIOUSLY INJURED. THE PHONE CALL I RECEIVED WAS FROM HIM. HE SAID TO ME, DO YOU REALIZE WHAT GREAT POLICE AND FIRE WE HAVE IN THIS CITY? AND I SAID WELL, OF COURSE I DO. AND HE SAID, I DIDN'T UNTIL I NEEDED HIM. I CAN'T TELL YOU HOW HE GLOWED. SPEAKING TO ME OVER THE PHONE, I COULD HEAR HIS ENTHUSIASM. AND I JUST WANTED TO MAKE IT PUBLIC. THAT THERE ARE SO MANY PEOPLE WHO DO NOT COME FORWARD. TO SING THE PRAISES OF OUR GREAT STAFF HERE OF OUR HE TALKED ABOUT HOW NOT ONLY THE POLICE THE FIRE, BUT THE POLICE DEPARTMENT TOOK CARE OF HIS WIFE, WHO HAS SOME PHYSICAL PROBLEMS, NOT MENTAL, BUT PHYSICAL PROBLEMS THAT DID NOT ALLOW HER TO GET TO HIM AND TRY TO HELP. SO I JUST WANTED TO LET THE COUNCIL KNOW AND MAKE IT PUBLIC. WHAT I GREAT POLICE AND FIRE DEPARTMENT ESPECIALLY THAT WE HAVE IN THIS CITY. THANK YOU FOR YOUR TIME. THANK YOU. JUDY SMITHY.
GRADY SMITH IS THE NEXT CARDIO.
READY. W. SMITH JR. RESIDENTS SINCE 1950. 18 06 YOUR ADDRESS. MR SMITHE NEED TO STATE YOUR ADDRESS FOR THE RECORD. THANK YOU. STATE YOUR ADDRESS FOR THE RECORD. I WAS JUST GETTING READY TO OKAY. YOU GOTTA HIT HIM. ON THAT ONE. 18 0 60 RAILROAD, DUNCANVILLE, TEXAS. 75136.
THERE'S SO MANY LITTLE THINGS THAT WE COULD DO THAT WOULD MAKE TRAFFIC FLOW BETTER. AND ESPECIALLY IN THE AREA IN WHICH I LIVE. WE'VE GOT WHAT WE'VE DONE OVER THERE IS REALLY MAKING A GREAT PLACE FOR PEOPLE TO GO TO GET TO GO HOME AND SEE HER HILL. THE PROBLEM IS THEY HAVE TO COME RIGHT DOWN. BUT YOU KNOW BY THE CEMETERY AND THEN HAVE TURNED DOWN HOME JOE WILSON ROAD AND THEN HAVE TURNED BACK TO GO TO THE RIGHT. BUT THERE'S SOMETHING WE COULD DO THAT WOULD MAKE THAT VERY MUCH EASIER. THERE'S SOME VACANT LAND UP THERE WHERE THEY WHERE THEY HAVE TO MAKE THE LEFT TURN GO DOWN THE HILL. IT GOES, AND IT CONNECTS TO BACK TO WHERE SERIAL ROAD RUNS BACK INTO THE RIGHT TIME TO AVOID RUNNING OFF IN THE CREEK. IT WAS VERY, YOU KNOW, WE COULD DO A VERY SHORT AMOUNT OF IT AND VIDEO COULD DO. YEAH A LITTLE BIT MORE OF IT AND THEN
[01:20:03]
AND WE COULD. WE COULD REALLY TAKE A LOT OF THOSE TRAFFIC THAT TRAFFIC OFF BECAUSE PEOPLE COME DOWN THE CORNER, COME DOWN THE CORNER AND THEN TURN RIGHT. AND MORE MORE CARS DO THAT, AND THEN GO GO STRAIGHT ON THREE. SO I ASK YOU TO HAVE YOUR YOUR DEPARTMENT TAKE A LOOK AT. I'LL BE GLAD TO GO OUT THERE WITH HIM AND SHOW HIM WHAT I'M TALKING ABOUT, UH, DID ALREADY TALKED TO THE GUN AND CEDAR HILL WHO JUST HAPPENED TO BE OVER IN THAT STRETCH ONE DAY, AND I THINK THAT WOULD BE AMENABLE TO IT. BUT I THINK THAT WOULD MAKE TRAFFIC KLAWITTER VERY MUCH BECAUSE RIGHT NOW, MORNING AND AFTERNOON. JOE WILSON ROAD AND UP TO THAT CORNER AND AROUND AROUND JUST IN AN AFTERNOON, ESPECIALLY. IT'S JUST TERRIBLE SO THAT YOU KNOW THE TRAFFIC ACCOUNT. THERE IS JUST GETTING REALLY BAD. AND THE ROADS GETTING WORN OUT PRETTY QUICK.THANK YOU. THANK YOU. THE SMITHY. HI I'M JUDY SMITHY AT 18 06 CEDAR HILL ROAD. FIRST IT WAS A HAPPY BIRTHDAY MAYOR AND I'M HERE TO SPEAK ABOUT THE DUNCANVILLE COMMUNITY THEATER. I'M NOT GONNA PARK NOWHERE ELSE, BUT I'VE BEEN PARKING OR EVER SINCE, AND I SHOPPED FOR PEOPLE. SO THE REASON WHY I PARKED HER BECAUSE THERE ARE EIGHT CAMERAS LITERALLY GOING STRAIGHT DOWN ON THAT STRIP. PLUS I KNOW THE PAWNSHOP HAS CAMERAS. SO THAT'S WHY I PARKED THERE. BUT HE TOLD ME THAT HE DON'T WANT ME TO PARK THERE BECAUSE I WAS AN F AND B AND HE WAS GOING TO KICK MY AGE. SO THAT'S WHY I PARKED THERE NOW. AND I PUT THAT BASKET THERE NOW. SO YOU'RE POLICE OFFICERS TALKING ABOUT WHERE I SHOULDN'T PARKED HER? NO, I HAVE THE RIGHT DEPART WHEREVER I WANT TO PARK PARK, BUT HE DOESN'T HAVE A RIGHT TO COME OUT HIS SHOP. TO SAY ANYTHING TO ME AT ALL. HE DON'T HAVE A RIGHT TO DO THAT.
BECAUSE I HAVE. I DON'T GO IN HIS SHOP. SO IF I DON'T COME IN OR MISSING WITH YOU, WHY ARE YOU COMING OUTSIDE TO MESS WITH ME NOW? TWO MEN HAD TO TELL HIM TO STEP DOWN TODAY AND HE DID. BUT DID HE THREATEN THEM? NO. SO IT LOOKS LIKE HE LIKED TO FIGHT WOMEN. AND IF YOU LIKE THE FIGHT WOMEN I KNOW MEN THAT LIKE TO FIGHT MEN THAT LIKE TO FIGHT WOMEN. SO I ASKED YOU TO GET IT TOGETHER. I AM GOING TO DALLAS COUNTY NEXT, AND I HAVE TOLD THE A T F THE PLEASE COME CHECK HIM OUT BECAUSE HE'S NOT CALLED IN PEOPLE. WHEN YOU GO INTO A LIQUOR STORE. THEY HAVE TWO CARDS. OKAY IN THE MICROPHONE ONE MORE SLOWLY, SO I G M TOBACCO. THAT'S THE NAME OF IT. THEY SELL CBD, THEY SAID ILLEGAL. THEY SELL WEED LEGAL WEED, AND HE DON'T EVEN KNOW HOW TO DO THAT. I JUST NEEDED THE NAME OF THE STORE HIM TO KNOW HOW TO SAY THANK YOU.
THANK YOU. BUT HE'S NOT DOING IT RIGHT TOGETHER PART. THE FINAL CARD TO HAVE SOME CANDY JACKSON. AMY JACKSON, 9 34 CAMBRIDGE DRIVE, DUNCANVILLE. GOOD EVENING, MAYOR AND COUNCIL IN MARCH OF 1988. I SOMEWHAT NAIVELY ASKED THE CITY COUNCIL FROM FOR PERMISSION TO USE THE SOON TO BE VACANT FORMER COUNSEL AND COURTS BUILDING TO PRODUCE TWO PLAYS DURING THE SUMMER. AT THAT TIME, I DIDN'T HAVE A FORMAL ORGANIZATION OR EVEN A NAME FOR IT. JUST AN IDEA.
SURPRISINGLY THE COUNCIL SAID, YES. AND BY JUNE WE YES. OTHERS HAVE JOINED IN, HAD A NAME, A LOGO AND EVEN A SIGN ON THE FRONT. AFTER A VERY SUCCESSFUL TO SHOW SUMMER WE ASKED TO KEEP USING THE SPACE FOR MORE THEATER IN DUNCANVILLE. FOR TWO YEARS, WE WERE GRANTED 90 DAY LEASES AND IN 1990, WE TRANSITIONED TO A ONE YEAR LEASE WITH THE CITY, MAINTAINING A 60 DAY NOTICE TO VACATE CLAUSE AT LEAST TWICE THE CITY PUT A FOR SALE, SIGN ON THE FRONT GRASS AND SOLICITED BIDS.
THE BUILDING DIDN'T SELL, AND WE KEPT DOING SHOWS. IN 2004 CITY LEADERS RECOGNIZING ABOUT THE ECONOMIC IMPACT ON THE QUALITY OF LIFE BENEFITS DO CT WAS BRINGING TO THE COMMUNITY ASK US WHAT IT WOULD TAKE TO KEEP THE CT AT 106, SOUTH MAIN, THE ANSWER A LONG TERM LEASE AND A MUCH NEEDED BUILDING RENOVATION PLANS WERE DRAWN. FUNDING WAS SECURED, AND IN 2006, A 20 YEAR LEASE WAS EXECUTED AND CONSTRUCTION BEGAN A WIN ONE FOR EVERYONE. WELL, 20 YEARS SOUNDED LIKE A LONG TIME IN 2006. IT HAS SOMEHOW FLOWN BY SHE'S IN PLANNING, SECURING RIGHTS DIRECTORS AND BUDGETING TAKES TIME, AND IT'S CAREFULLY ORCHESTRATED TO ENSURE A SMOOTH PERFORMANCE THROUGHOUT THE SEASON, WHICH IS WHY WE ARE NOW REQUESTING A NEW LONG TERM LEASE TO FACILITATE PLANNING FOR FUTURE SEASONS. TAKING CARE OF THIS BUSINESS AGREEMENT TODAY ENABLES US TO CONTINUE TO SHARE OUR ART FOR THE FUTURE. 106 SOUTH MAIN STREET HAS BEEN DUNCANVILLE COMMUNITY THEATERS HOME FOR 35 YEARS LONGER, IN FACT, AND IT SERVED AS A COUNCIL IN COURTS BUILDING LONGER THAN SO MANY OF OUR VOLUNTEERS BACK HERE HAVE EVEN BEEN ALIVE. WHEN WE STARTED USING THE SPACE, THE CITY HALL WAS NEXT DOOR AND THERE WAS A VACANT LOT BEHIND US . SO MUCH HAS CHANGED, BUT WE'RE STILL HERE. THIS EVENING. WE ALL OF THESE FOLKS BACK HERE AND OTHERS BEHIND THE SCENES AND NOT HERE TONIGHT. WE RESPECTFULLY AT REQUEST THAT YOU EXTEND OUR STAY. THANK YOU. THANK YOU. THAT CONCLUDES OUR CITIZEN COMMENTS CITIZEN INPUT FOR THIS EVENING.

TAKE PLACE AT THE VERY END OF OUR CITY COUNCIL MEETING. ITEM FIVE B. CONSIDERED RESOLUTION APPROVING AMENDMENT NUMBER ONE TO THE GUARANTEED MAXIMUM PRICE WITH CORE CONSTRUCTION SERVICES OF TEXAS INCORPORATED. THE PROPOSED AMOUNT OF $265,927. INCLUDING 135 THOUSANDS OF PROJECT CONTINGENCY FOR THE EXECUTION OF FUTURE CHANGE ORDERS PROVIDE FOR ADDITIONAL CONSTRUCTION SERVICES FOR THE NEW FIRE STATION NUMBER 2 71 FOR REVISED TOTAL GUARANTEED MAXIMUM PRICE OF 7,857,830. AND AUTHORIZING THE INTERIM CITY MANAGER TO NEGOTIATE. AND EXECUTE THE AMENDMENT AFTER APPROVAL AS TO FORM OF THE CITY ATTORNEY AND ANY FUTURE CONTRACT CHANGEOVER. IT'S NOT EXCEEDING $50,000 TURNING THIS OVER TO OUR INTERIM EXECUTIVE FOR PUBLIC WORKS. MR JACKIE, MISS JACKIE COLTON. COLTON, PLEASE. GOOD EVENING, HONORABLE MAYOR GORDON DISTINGUISHED MEMBERS OF THE DUNCANVILLE CITY COUNCIL. I AM JACQUELINE COLD AND I'M THE INTERIM DIRECTOR OF PUBLIC WORKS. AND I HAVE JOINING ME TONIGHT PARTNERS IN OUR FIRE[01:40:02]
STATION PROJECT. UM TO MY IMMEDIATE RIGHT. I HAVE MR JOSHUA HONEYCUTT. HE IS WITH CORE. THEY ARE OUR CONSTRUCTION MANAGER AT RISK ON THE FIRE STATION. AND TO MY IMMEDIATE LEFT. WE HAVE CORY DURANT, WHO IS WITH BR W. THEY'RE THE ARCHITECTS ON THE PROJECT. SO BASICALLY TONIGHT WE'RE HERE TO DISCUSS AMENDMENTS TO OUR GMP. WE'RE TRYING TO GET TO THE FINISH LINE. OUR PROJECT IS APPROXIMATELY 90. COMPLETE AT THIS POINT, BUT THERE ARE SOME ISSUES THAT WE HAVE UNCOVERED THAT WE NEED ADDITIONAL FUNDS FOR. OKAY, SO, BASICALLY, HERE WE HAVE THE DESIGN TIMELINE. THE CITIZENS OF DUNCANVILLE WERE SO KIND TO APPROPRIATE OR VOTE ON A BUN. PROCEED $6 MILLION FOR A NEW FIRE EMERGENCY FACILITY AND THAT WAS BACK IN 2018. SO FAST FORWARDING. UH WE HIRED THE CONSTRUCTION MANAGER AT RISK SCORE AND 2019. WE WANTED TO MAKE SURE THAT THEY WERE ON BOARD BEFORE WE HAD THE ARCHITECT SO THAT THEY COULD GUIDE US THROUGH THAT PROCESS. SO THE FOLLOWING YEAR WE BROUGHT ON BR W AS ARCHITECTS TO START DESIGNING THE PROJECT. THE PROJECT WAS FINALLY DESIGN. AND COMPLETED, THE DESIGN WAS FINALLY COMPLETED AND MARCH OF 2022 AND OFF WE WERE HANDING IT OFF. UH TOOK CORE AND THEY TOOK THE LEAD ON IDENTIFYING SUBCONTRACTORS AND THEY DEVELOPED WHAT IS TERMED A GUARANTEED MAXIMUM PRICE FOR THE FIRE STATION. AND THAT AMOUNT WAS SET AT 7,000,591. $108. SO WE THEN BROUGHT THAT PROPOSAL TO THE CITY COUNCIL FOR APPROVAL THAT WAS IN JUNE OF LAST YEAR.AND THE PROJECT WAS AWARDED, UM, NOTICED SUPERSEDE WAS ISSUED AND COURSE STARTED WORK IN AUGUST OF LAST YEAR, CONSTRUCTING THE JOB. OKAY ON THIS SLIDE, WE HAVE A RENDITION OF WHAT THE FINISHED PRODUCT WILL LOOK LIKE. THAT'S THE PHOTO. ON THE RIGHT AND THEN AT THE UPPER LEFT HAND CORNER.
YOU CAN SEE WHAT THE SITE LOOKED LIKE PRIOR TO CONSTRUCTION. AND THE BOTTOM LEFT IS WHAT IT LOOKS LIKE NOW, SO WE ARE BASICALLY, YOU KNOW, WE'VE GOT THE STRUCTURE COMPLETED. WE'VE GOT YOU KNOW THE BAY DOORS WERE WORKING ON INTERNAL, UM UH, FINISHES THE CARPET HAS BEEN IS BEING LAID CURRENTLY. AND WE'RE OFTEN AND RUNNING AND ALMOST TO THE FINISH LINE. JUST A LITTLE BACKGROUND ON THE GMP CONTRACTUAL PROVISIONS. BASICALLY WHAT THAT SAYS IS CORE AGREED TO CONSTRUCT THE PROJECT FOR A CERTAIN AMOUNT AND AH, THE COST WOULD NOT EXCEED THAT BUDGET AS LONG AS WE STAYED WITHIN THE SCOPE OF THE JOB. AND SO, UM, AND THEN THAT ACTUALLY PUT CORE ON THE HOOK FOR COVERING ANY OTHER, UM, NON CITY INITIATED, UH, COSTS EXCEEDING THE BUDGET. AS A PART OF THIS JOB. WE DETERMINED THAT THERE WERE CERTAIN OWNER FURNISHED EQUIPMENT. THAT WE WOULD SUPPLY OUTSIDE OF THE CORE, UM, CONTRACT AND THAT SOME OF THEM ITEMS UH, CORE WAS TO INSTALL ONE OF THEM IS THE GENERATOR FOR THE FACILITY. IT WAS ON A SUPPLY INSTALLED BY CORE. AND THEN ALL OF THE I T EQUIPMENT WAS OWNER SUPPLIED AND INSTALLED. AND WE'VE GOT, UM, WE'RE WE'VE PAID FOR PERMITS AND GEO TECH AND OTHER MISCELLANEOUS ITEMS. SO ONE OF THE THINGS THAT WE DO IS WE MEET WITH CORE ON A REGULAR BASIS. CURRENTLY, IT'S ACTUALLY BI WEEKLY. AND WE DISCUSS THE PROGRESS OF THE PROJECT AND WHAT IS GOING TO TAKE TO GET IT FINISHED AND THE CONSTRUCTION SCHEDULE AS WELL AS ANY ISSUES THAT WE MIGHT NEED TO ADDRESS.
[01:45:07]
AH ONE OF THE THINGS THAT WE WANTED TO POINT OUT IS PRIOR TO THE FINAL PAYMENT TO CORE. THAT WILL REQUIRE CITY COUNCIL APPROVAL. AND SO WE WILL BE COMING BACK TO YOU, UH, IN APPROXIMATELY 33 TO 4 MONTHS OR SO WITH THAT. UM REQUESTING THAT FINAL APPROVAL. SO WITH THAT, I WOULD LIKE TO TURN IT OVER TO JOSH HONEYCUTT, WHO WILL DISCUSS THE PROVISIONS OF THE GMP AGREEMENT. ALL RIGHT. I WANT TO THANK YOU FOR HAVING US HERE AND FOR YOUR CONSTRUCTION. THANK YOU FOR LETTING US BE A PART OF THIS PROJECT. UM AS JACKIE STATED THAT THIS PROJECT HAS BEEN GOING ON A WHILE THROUGH PRECONSTRUCTION THROUGH THROUGH CONCEPTUAL WHATNOT. AND IT'S GOT TO WHERE WE ARE TODAY, SO WE'RE 90% COMPLETE. UM WE DO EXPECT IT TO TURN THE PROJECT. EARLY TO LATE JANUARY. WE'RE GONNA DO EVERYTHING I CAN PERSONALLY TO MAKE SURE THAT HAPPENS SOONER AS SOON AS WE GET THOSE FIRE FIREMAN OPERATING OUT OF THAT FACILITY, THAT BETTER IT IS FOR THE COMMUNITY. SO THE SLIDE HERE IS BASICALLY HALF THE GMP WAS BROKEN OUT FROM THE BEGINNING.HOW WE SAW IT, HOW WE THOUGHT IT WAS GOING TO COME OUT. BASED ON THE BIDS AND THE FEEDBACK WE HAD LEADING UP TO THIS PROJECT. UM YOU KNOW, WITH ALL PROJECTS, THINGS COME UP SCOPES CHANGE IN SIX YEARS. IT'S REASONABLE TO UNDERSTAND THAT THE SCOPE OF THIS PROJECT COULD HAVE SLIGHTLY CHANGED. THERE WAS THINGS THAT WERE THOUGHT THEY WERE GOING TO BE ADDED OR INCLUDED. YEAH, THEY HAD TO CHANGE TO MEET THE NEEDS OF THE U. S C AND IN THE OPERATING NEEDS FOR THE CITY.
AH! YOU KNOW, ALSO EQUIPMENT CHANGES. THERE'S SOMETHING SOME SLIGHT ISSUES THAT WE HAD ON THIS PROJECT. THAT WE HAD TO NAVIGATE AROUND IN ORDER TO DEFEND IT TO MEET WITHIN THE STATION. UH UM, SO THAT LEADS TO SOME OF THE ITEMS THAT COMES UP ON THIS NEXT SLIDE. YES WE ARE ASKING TO INCREASE THIS GMP BASED ON THE NEEDS OF THE PROJECT, AND HOW UH, DECISIONS WE MADE AND THE MATERIALS AVAILABLE. HOW THINGS SHIFTED. UM ONE OF THE LEAD DRIVERS OF THIS IS SOME OF THE ACTIVITIES THAT US CORPS IN THE PROJECT TEAM. DECIDED ON TO MOVE FORWARD ON THE BEST BENEFIT OF THE PROJECT. WE HAD TO LOCATE A HUGE MACHINERY RELATED TO THE GENERATOR. UM UPSTAIRS AND OVER. YOU KNOW THERE'S A LOT OF COSTS AND WE WOULDN'T BE AT THE 90% MARK RIGHT NOW, IF WE AS A TEAM DIDN'T ELECT TO MOVE FORWARD UNTIL WE CAN GET THIS RESOLVED.
UM SO I GUESS AS FAR AS CORE WE KNOW THERE'S GONNA BE A FEW MORE HICCUPS THAT WE'RE WORKING THROUGH RIGHT NOW. UM YOU KNOW THAT WE HAVE SEVERAL ITEMS THAT WE'VE COMMITTED ON AND A COUPLE THAT WE HAVEN'T THAT ARE IDENTIFIED. FOR THE DOLLAR AMOUNTS NEXT TO THEM. UM BUT ON THIS REMAINING CONTINGENCY PORTION OF THAT UM, THE CITY'S TRUSTING US TO MAKE THE DECISIONS. WE'RE DEFINITELY GONNA MAKE THE DECISIONS WITH OUR MANAGEMENT PARTNERS. AT THE END OF THE DAY, WE'RE GOING TO TURN OVER ALL DOCUMENTATION. ALL BACK UP NEEDED, SO WE'RE JUST WE WANT TO COMPLETE THIS AS SOON AS POSSIBLE. AH! AT THE BEST, YOU KNOW VALUE FOR THE CITY. UM SO, YEAH, WE'RE ASKING TO RAISE THE GMP TO COVER THOSE THINGS. UM COREY OUR DESIGN. PROCESS A LITTLE BIT. SO UM, IDEALLY, IN A PERFECT WORLD, WE GET TO COMMUNICATE ALL THE NEEDS OF A FACILITY IN THE DESIGN PHASE. I'M SORRY. IDEALLY WE GET TO, YOU KNOW, FULLY UNDERSTAND ALL THE NEEDS OF A BUILDING IN THE DESIGN PHASE. THEREFORE WE DON'T HAVE ANY UNFORESEEN ITEMS THAT COME UP DURING CONSTRUCTION WHEN UNFORTUNATELY, LIKE I SAID, BEFORE, NEEDS CHANGE AS TIME GOES ON, YOU KNOW, WE SEE THIS IS INITIALLY A 2020 PROJECT NEVER NOW CONSTRUCTED IN 2023 AND HOPING TO COMPLETE VIBE THE BEGINNING OF 2024, THE LATEST BUT WE JUST SAW NEEDS CHANGE. UM I KNOW Y'ALL HAD STAFFING CHANGES. IN THE COURSE OF THIS TIME. WE WERE LUCKY TO BE BLESSED WITH JACKIE WITH THIS PROJECT ON THE LATE END OF THE PROJECT, BUT WE WERE WORKING WITH, YOU KNOW, MR REMY BEFORE DURING THE DESIGN PHASE, SO I'M JUST A LOT OF THINGS THAT COULD HAVE BEEN COMMUNICATED. IDEALLY IN AN EARLIER DESIGN PHASE, WE COULD HAVE STARTED SOME OF THESE THINGS THAT DEVELOPED LATER ON. BUT AS THE CURRENT I T DEPARTMENT GOT INVOLVED. WE JUST LEARNED MORE AND MORE ABOUT WHAT THE CITY'S NEEDS WERE, AND THAT'S WHAT ESSENTIALLY SHIFTED THE SCOPE OF THIS PROJECT. THUS, WE NEED ADDITIONAL FUNDING TO PROVIDE WHAT DEPARTMENT NEEDS TODAY. THANK YOU ALL. YEAH. GREAT TIME. OKAY UM, SO I WOULD LIKE TO, UM, GO OVER THE COST OF DATE ON THIS PROJECT. WE'VE IDENTIFIED THE DESIGN COST THE CONSTRUCTION
[01:50:07]
MANAGER COST AND THE LAND ACQUISITION COST. AND THAT TOTAL IS APPROXIMATELY $9.2 MILLION.SO WE PRESENTED AN ITEM TO COUNCIL IN JULY FOR OUR I T NEEDS. AND THAT WAS APPROXIMATELY 1.5. IT IS A PART OF THE THAT WAS THAT'S APPROXIMATELY 1.1 MILLION IS A PART OF THE ONE POINT 5 MILLION THAT'S BEST LISTED HERE. THERE ARE SOME OTHER NEEDS THAT WE, UM SOME OTHER PURCHASES THAT WE WILL BE MAKING IN THE FUTURE. UM RELATED TO FURNITURE MOVING COST PERIMETER FENCING. BASICALLY AND THEN. THOSE ARE THE MAIN THINGS I WOULD LIKE TO ELABORATE ON THE CONTINGENCY AMOUNT. IN THE PREVIOUS SLIDE. THE 175,000 SO. WE ARE CURRENTLY EVALUATING. OUR IRRIGATION, UH, DESIGN AND ALSO, UH, WATER PRESSURE AT THE FACILITY. SO THERE IS A POSSIBILITY THAT WE MIGHT NEED TO ACQUIRE AND HAVE INSTALLED BY CORE, UH, BOOSTER PUMPS ON OUR IRRIGATION SYSTEM AND OUR DOMESTIC WATER SUPPLY. AND SO, UM, WITH ANY CONSTRUCTION JOB IF YOU DON'T HAVE CONTINGENCY FUNDS IDENTIFIED, YOUR PROJECT COULD JUST SHUT DOWN. SO THAT IS THE REASON WHY, YOU KNOW WE'RE ASKING FOR FUNDS IN ADVANCE. THEY WILL HAVE TO BE APPROVED BY STAFF BEFORE YOU KNOW THAT MONEY CAN BE UTILIZED. BUT I DID WANT TO, YOU KNOW, NOTE THAT. SO.
BASICALLY THIS CONCLUDES THE PRESENTATION. DO YOU ALL HAVE ANY QUESTIONS? YES, SOME.
CLARIFICATION I GUESS TO PUT IT ON PERSPECTIVE. I RECALL VERY CLEARLY. WHEN COURSE CAME BEFORE THE CITY COUNCIL, AND THE REQUEST WAS MADE TO PUT THE GM THE GUARANTEED MAXIMUM PRICE ON IT. AND I ASKED THE REPRESENTATIVES AT TIMES THAT ARE YOU SURE? THAT THIS IS GOING TO BE WHERE IT IS BECAUSE WE'RE LOOKING AT WHAT'S GOING ON WITH BUILDING MATERIALS AND EVEN THE COST OF CONCRETE AND SO FORTH. ARE YOU SURE THAT YOU CAN LIVE WITH THIS AND BE ABLE TO SUSTAIN ANY COST INCREASES COMING BACK TO THE CITY COUNCIL FOR AN INCREASE IN THE ANSWER WAS, YES.
POSITIVITY SO WE AS A COUNCIL VOTED TO PUT THAT CAP. ON THE COST. SO NOW LOOKING BACK AT THAT IN REFLECTION, AND NOW SEEING THAT WE'RE LOOKING AT ANOTHER 266 ROUGHLY $1000 TO COME INTO PLAY AND GOING BACK TO THE COMMENT THAT AS LONG AS THE CITY DOESN'T CHANGE THE SCOPE THEN THERE'S NO CHANGE TO THE GMP. HOWEVER YOU'VE EXPLAINED THAT THERE ARE SOME CHANGES TO THE SCOPE OF THE PROJECT, AS INITIATED BY THE CITY, PRIMARILY FOR SUMMIT PURPOSES HAS BEEN SAID AND SO LOOKING AT THIS, IN FACT, I'M GLAD YOU WENT BACK TO SLIDE NUMBER 83. SO LOOKING AT SLIDE NUMBER 83 AND GOING BACK TO WHAT? MR HONEYCUTT COMMENTED ON GAVE US INFORMATION ON FROM CORE. MY QUESTION FOR THESE PARTICULAR LINE ITEMS. THESE PARTICULAR LINE ITEMS WERE INCURRED WERE INCREASED COSTS INCURRED AS A RESULT OF THE PROJECT, BUT NOT AT THE REQUEST OF THE CITY TO MAKE CHANGES TO THE TO THE CONTRACT ORDER. IS THAT A CORRECT SOME OR IS THAT A CORRECT ASSESSMENT OF THE SITUATION AS I UNDERSTAND WHAT MR HONEYCUTT SAID. SO TO ANSWER YOUR QUESTION, UM THE GENERATOR ALSO COMES WITH THE 80 S. THAT WAS THAT WAS BROKERED BY THIS CITY. SO 40 45,000 OF THIS IS RELATED TO THE 80 S AND MOVE. THAT'S ASSOCIATED WITH THE ACRONYM. YOU'RE USING, SIR. AUTOMATED TRANSFER SWITCH, OKAY? YEAH. YEAH, IT TRANSFERS POWER BETWEEN HOUSE POWER AND. THE GENERATOR. OKAY THANK YOU. GO AHEAD. ONE OF THE THINGS I WANT TO NOTE IS WE HAD TO CHANGE. THE GENERATOR. BIG UH, IN ORDER TO MEET THE SCHEDULE FOR THE PROJECT, WE HAD TO IDENTIFY AN ADDITIONAL GENERATOR AND SO BECAUSE THAT GENERATOR WAS LARGER THAN THE ONE WE HAD ORIGINALLY ANTICIPATED IT COULD NOT FIT IN THAT SPACE. SO THAT WAS A CHANGE THAT WAS INADVERTENTLY, UM. THERE WAS INADVERTENTLY CAUSED BY THE
[01:55:06]
CITY. BECAUSE WE NEEDED TO HAVE A GENERATOR IN PLACE. THE ONE THAT WE WERE LOOKING AT. THERE WAS A LONG LEAD TIME AND IT WOULD HAVE DELAYED DELAYED THE PROJECT UNNECESSARILY, SO WE WERE LUCKY TO WORK WITH COMMENTS . UH ACTUALLY ALAN BROWN, WHO IS OUR CONSTRUCTION? INSPECTOR? HE'S HERE TONIGHT. WITH THIS. HE WORKED WITH COMMENTS TO IDENTIFY ANOTHER GENERATOR THAT WE WERE ABLE TO PURCHASE OR HE NEGOTIATED THE PURCHASE PRICE DOWN TO THE PRICE THAT WE WOULD HAVE PAID FOR THE ORIGINAL GENERATOR. HOWEVER IT WAS BIGGER THAN THE ONE WE HAD ORIGINALLY INTENDED. THEREFORE IT HAD TO BE RELOCATED FROM THEIR ORIGINAL SPACE. AND SO THAT'S ACCOUNTING FOR, YOU KNOW A LOT OF THE COSTS THAT ARE, UM PROVIDED IN THIS PARTICULAR SLIDE. REMEMBER OUR DIRECTOR OF IT, BRIEFING US ON THIS NECESSITY TO MOVE THE SAFETY S AS A RESULT OF MANY, MANY THINGS BEYOND MY COMPREHENSION. BUT UNDERSTANDING EXACTLY WHAT NEEDED TO BE DONE.SO LOOKING AT SLIDE 83, STARTING WITH THE H V, A C SYSTEM FOR MEZZANINE 202 DOWN TO THE MOVE TO MISSING THOSE PARTICULAR ITEMS TOTAL ROUGHLY JUST EXCLUDING THE FIRST THREE ITEMS, WE'RE TALKING MAYBE WHAT? MAYBE 23 $2500 OF THE 87,000. IT'S ALL RELATED TO THIS. I T ISSUE OF THE GENERATOR IN THE 80 S MOVEMENT AS IT WAS STATED SO AS THE REQUEST BACK, NOT A REQUEST REQUIREMENT. WE HAD NO MEANS TO OBVIATE THIS. THIS NECESSITY WE HAD TO DO THIS SO GOING BACK TO THE COMMENT THAT ANY CHANGES NOT IN NOT REQUIRED THIS WAY. ANY CHANGES TO THE SCOPE OF THE PROJECT INITIATED BY THE CITY HAVE TO BE SUBSTANCE SUBSIDIZED BY THE CITY RATHER THAN BEING COMING UNDER THE GMP HAS AGREED TO BUY THE CORE. SO THAT'S WHAT I'M TRYING TO EXPLAIN AND UNDERSTAND MYSELF AT THE SAME TIME. SO LOOKING AT THESE ITEMS AND UNDERSTANDING WHERE THAT $87,000 COMES FROM THE BOOK OF IT IS BECAUSE WE HAD TO DO THIS STUFF FOR THE VARIETY FOR THAT 80 S SO AND I, AND THEN I GET THE 4. WHAT? I DON'T CLEARLY UNDERSTAND, THEN IS YOUR YOU DIDN'T PRETTY FAIR EXPLANATION OF $175,000 FOR THE CONTINGENT CONTINGENCY, BUT IS THAT A PERCENTAGE OF SOMETHING OR IS IT IS IT A BALLPARK FIGURE AND WHAT'S ESTIMATED TO BE INCURRED IN THE FUTURE? IT IS ACTUALLY IT'S NOT A PERCENTAGE OR A BALLPARK IS LIKE AN ESTIMATE OF WHAT WE COULD INCUR IF WE HAD TO. UH ACTUALLY HAVE BOOSTER PUMPS ON OUR IRRIGATION SYSTEM AS WELL AS DOMESTIC SYSTEM. THAT'S. LIKE 80 SOMETHING 1000. AND THEN, UM, ACTUALLY, YOU KNOW , AS THE PROJECT PROGRESSES, WE, UM DETERMINED THAT THERE ARE OTHER THINGS THAT NEED TO BE ADDED. AH AS A MATTER OF FACT, EVEN THIS WEEK WE HAD ANY ELECTRICAL, UM AH, NEED IN THE BAY THAT THAT WE'RE GOING TO HAVE TO ADDRESS AND WHATEVER THE FIXES FOR THAT THAT WILL COME OUT THE 1 75, AND I'LL ACTUALLY ASKED JOSH TO EXPLAIN THAT FURTHER. SO EACH OF THE APPARATUS IS THE FIRE TRUCKS, ENGINES, WHATNOT, AMBULANCES, THEY ALL REQUIRE A POWER TO HOOK THEM UP TO KEEP THEIR MEDICINES COOL. THE CHARGE THEM TO KEEP THEM READY TO GO WHEN, WHEN NEEDED. UM SO WE HAVE SEVERAL THOSE IDENTIFIED ON THE ON THE CONTRACT DOCUMENTS, UH, LOCATIONS OR WHATNOT. UM, I GUESS THE PLACE WHERE IT PLUGS INTO THE DUNCANVILLE APPARATUSES. IS DIFFERENT FROM THE PLANT, SO THERE'S GOING TO BE INCREASED LINEAR FOOTAGES FOR WIRE CONDUIT. UM AS WELL AS THE AMBULANCE IS REQUIRED. DISCONNECT UM AND ALSO, UH, SOME OF THE VEHICLES TAKE MORE THAN ONE. AND THAT WAS THAT WASN'T THOUGHT OF OR IDENTIFIED OR ON THE DOCUMENTS. AH, THAT COST RIGHT NOW IS. WE'RE ALMOST CERTAINLY IT IS, BUT WE NEED TO OFFICIAL DIRECTION TO COME BACK FROM ENGINEERING. FIGURE IT OUT. UM SO THAT'S ONE OF THE ITEMS AND THE I GUESS THE IRRIGATION OF BOOSTER PUMPS AND FOR THE DOMESTIC WE'RE WORKING THROUGH THAT, OKAY? YEAH SO I GUESS IN IN SUMMATION, THEN WHAT WE'RE LOOKING AT OUR ITEMS REQUIRED THAT WE AS A CITY HAVE DEEMED NECESSARY. AND NOT SOMETHING THAT THE CONTRACTOR OR CORE HAS COME SAID THAT WE NEED MORE MONEY BECAUSE OF SOMETHING ELSE. IT'S THE WE'RE EXCEEDING. THE GMP HAS AGREED TO BECAUSE THE CITY IS REQUIRING THESE PARTICULAR ITEMS. SO THEREFORE UNDER THE CONTRACT THEM THIS REQUEST IS LEGITIMATE. YES THAT'S WHAT I WOULD CONCLUDE.
[02:00:05]
YES SO WHAT? I WILL, UM LET YOU ALL KNOW THAT EVERY REQUEST WE GET FROM CORE IS HIGHLY VETTED.UH JOSHUA CAN ATTEST TO THAT. AND COREY. YOU KNOW, WE'VE WE'VE MET EVERY REQUEST, AND SOMETIMES WE SAY NO. SO YOU KNOW, THERE HE IS AN INTERACTION THAT TAKES PLACE RELATED TO ANY CHANGE. IS LIKE WE DETERMINE. WELL UH, IS IT A DESIGN OVERSIGHT? IS IT A CONSTRUCTION OVERSIGHT? DID WE? YOU KNOW THERE IS A PROCESS THAT WE LOOK AT. OKAY. ALL RIGHT. OKAY? UM MR CONTRERAS? YES, SIR.
THANK YOU, MAYOR. UM, SO IN SUMMARY WHAT WE'RE SAYING. THESE THE. LISTEN TO ALL THE QUESTIONS THE MAYOR HAD, BUT I WANT TO BE CLEAR THAT 100% OF THESE ADDITIONAL COSTS CAME AS A RESULT OF THE CITY NEEDING SOMETHING THAT WASN'T ORIGINALLY THOUGHT OF OR IT WAS OVERLOOKED.
IS THAT? IS THAT CORRECT? THAT'S CORRECT, OK? YES, SIR. THANK YOU. MR MCBURNETT. THANK YOU, MAYOR. YEAH, I'M. I'M GOING TO EVENTUALLY MAKE A MOTION TO APPROVE THIS, BUT BUT I STILL HAVE A QUESTION. BECAUSE WE'VE WE'VE DISCUSSED TREES. THIS PROPERTY, SO I I'M CURIOUS TO SEE WHAT THE ANSWER THE RESULT, AND THAT MIGHT BE MR KEYES. IT MIGHT BE SOMETHING FOR YOU TO ANSWER. FOR US AS WELL. SO TREES WERE BROUGHT UP IN THE LAST CITY COUNCIL MEETING RECALLED CORRECTLY. YES, SIR. THANK YOU. WE WERE GONNA MEET THE TREE MITIGATION REQUIREMENT BASED UPON TREES ORDERED BY THE PARKS DEPARTMENT. THANK YOU AND I'LL MAKE THE MOTION TO APPROVE.
THANK YOU. WE HAVE A MOTION TO PROVE, MR MCBURNETT. WE HAVE A SECOND. SECONDLY MR CONTRERAS COUNCIL, PLEASE VOTE. UNANIMOUSLY APPROVED. THANK YOU. THANK YOU. THANK YOU FOR PUTTING UP WITH QUESTIONS. I JUST HAD TO GET IT CLEAR IN MY MIND THAT AS YOU CORRECTLY STATED, AND WE'VE UNDERSTOOD THAT. THESE HAVE BEEN INITIATED BY THE CITY. NOT BY INCREASED COST IS INCURRED BY THE CONTRACTORS. VERY IMPORTANT. THANK YOU VERY MUCH. APPRECIATE IT. THANK YOU. ON TO ITEM FIVE.
[5.C. Consider a Resolution ratifying the increase in the spending authorization level by $49,901.43, from $70,000 to $119,901.43, which was approved for one-time procurement of building inspection services due to staffing shortages. The unit amount with an estimated annual expenditure of seventy thousand dollars ($70,000.00). The ratification would hereby approve the additional forty-nine thousand, nine-hundred and one dollar and forty-three cents ($49,901.43) authorization increase.]
C CONSIDER A RESOLUTION RATIFYING THE INCREASE IN THE SPENDING AUTHORIZATION LEVEL BY $49,901.43. FROM 70,000. 2 $119,901.43, WHICH WAS APPROVED FOR ONE TIME PROCUREMENT.BUILDING INSPECTION SERVICES DUE TO STAFFING SHORTAGES. THE UNIT AMOUNT WITH AN ESTIMATED ANNUAL EXPENDITURE OF $70,000. THE RATIFICATION WOULD HEREBY APPROVED THE ADDITIONAL $49,901.43. AUTHORIZATION INCREASE. MR TENANT, MR GARCIA, THE FLOOR IS YOURS, PLEASE.
THANK YOU. MR MAYOR COUNCIL. I JUST WANT TO QUICKLY GIVE YOU YOUR DISCUSSION UPDATE ON WHAT IT IS REQUESTING OF. BASICALLY WE HAD A TIME DURING 2022 2023, WHERE WE HAD SOME VACANCY WITHIN OUR OFFICE, THE BUILDING INSPECTION DIVISION, AND THAT TIME WE BASICALLY HAD TO UTILIZE OUR THIRD PARTY A LITTLE BIT MORE, UH, MORE ALTERNATIVE WE ANTICIPATED AT THAT TIME. WE BASICALLY OF COURSE, HAD TO GO THROUGH THE INVOICE PROCESS, WHICH THERE WERE NO AH, UM, INTEREST ON. THERE'S NO INTEREST ON THAT. I THINK THERE WAS A QUESTION THAT WAS ASKED. I WANT TO MAKE SURE I ADDRESS THAT, BUT ALSO BECAUSE OF THE TRADE OFF AS YOU WILL, BECAUSE WE DID NOT HAVE STAFF INTERNALLY. WE BASICALLY UTILIZED THE COST SAVINGS. WE WORKED WITH OUR FINANCE DEPARTMENT. ALSO OUR BUDGET DEPARTMENT IN ORDER TO BASICALLY, UM, KIND OF COVER THOSE CALLS IN THE LOO OF NOT BEING ABLE TO HAVE ANYBODY INTERNALLY TO PAY THOSE INVOICES . I MEAN SOME OF THEIR VOICES THAT TIME. UNFORTUNATELY WE DID HAVE A LOT OF A LOT OF INSPECTIONS COME UP, AND ONE OF MY FUTURE SLIDES IS GOING TO ACTUALLY SHOW THE NUMBERS JUST KIND OF GIVE YOU THAT PERSPECTIVE SO THAT WE CAN UNDERSTAND THE GRAVITY THAT WOULD THAT THE DIVISION HAD WITH THE NUMBER INSPECTIONS THAT WERE FOR THE LAST TWO YEARS. SO WITH THAT SAID, WE BASICALLY LOST. UNFORTUNATELY BILLIONS OFFICIAL WE LOST THE BUILDING, INSPECTOR.
EXCUSE ME, AND THEN ALSO A BUILDING OFFICIAL FOR A NUMBER OF THOSE FOR A NUMBER THAT PERIOD AS BISHOP EARLIER. BUT AS YOU SEE, NOW WE'RE FULLY STAFFED . AND I DO UNDERSTAND THAT SOMETIMES THIRD TIME IS THE CHARM, BUT I WOULD DEFINITELY WANT TO TAKE THIS TIME OUT TO ALSO PERSONALLY RECOGNIZE OUR TO DO ADDITIONS TO OUR BUILDING TEAM. MR KIRK IS SUN AND ALSO MR JAMES MCKEE AS WELL THAT ARE ALSO PART OF THIS TEAM THAT WILL HOPEFULLY ENSURE THAT WE WILL NOT HAVE TO COME BEFORE YOU AGAIN AND LITTLE OF THIS AND ALSO ALSO WANT TO THANK YOU ALL, UNFORTUNATELY, WAS OUT WHEN IT OCCURRED WITH THE MASSIVE PIECE SCHEDULE REQUEST WHERE YOU GUYS ALLOWED FOR THIS TO BE MORE OF A PASS THROUGH, THEN THEY CALLS OFFSET BECAUSE NOW WE ACTUALLY
[02:05:03]
WANT TO NOT HAVE TO WORRY ABOUT TAKING THE LOSS EVERY TIME WE HAVE CERTAIN INSPECTIONS, SO THANK YOU ALL FOR THAT FORESIGHT AND WISDOM AND DOING SO I SHOULD HAVE REGARD AT THIS POINT, WE ANTICIPATE ONLY USING BERG FOR TOSS ON AN EMERGENCY OR AS NEEDED BASIS. THERE'S OF COURSE WE HAVE ONE INSPECTOR. WE DO UNDERSTAND THERE WILL BE A NEED TO POTENTIALLY USE IT BECAUSE WE BEGIN. WE ARE HUMAN BEINGS. WE DO GET SICK AND WE DO HAVE TO TAKE A VACATION. SO WE'RE NOT SAYING WE'RE NOT GOING TO USE THEM IN THE FUTURE, BUT WILL BE VERY BILL THAT WILL BE BETTER PREPARED TO WHETHER THAT STORM THE FUTURE MOVING FORWARD. AH AND AGAIN THAT'S GOING TO BE UTILIZED IN OUR FUTURE ON 24 BUDGET EXPENSES COMING FORTH. AS MENTIONED EARLIER. I WANTED TO GIVE YOU GUYS A BIT OF THE NUMBERS THAT WE WERE LOOKING AT OVER THE LAST COUPLE OF YEARS AND AGAIN, 2022. THERE WERE SOME WE DID, UH, STAFF THAT DIED. UNFORTUNATELY PAY EVERY INVOICE IN 2022. SO I ROLLED OVER 2023, WHICH, OF COURSE, PUT US BEHIND THE EIGHT BALL. THAT COUPLE. OF COURSE. WHAT DO YOU LIKE OF STAFFING PERSONNEL IS WHAT PUT US BEHIND THE EIGHT BALL THAT WE CURRENTLY HAVE BEFORE US DOWN. BUT IT IS SOMETHING THAT WE HAVE BEEN ADDRESSING. UNFORTUNATELY THERE HAS BEEN SOME TRANSITION OUR FINANCE DEPARTMENT AS YOU ALL DO KNOW, BUT IT'S SOMETHING THAT STAFF HAS BEEN WORKING WITH FINANCE DEPARTMENT TO ENSURE THAT WE WERE ABLE TO GET UP AHEAD OF THIS, AND WE'VE BEEN WORKING ON THIS SINCE FEBRUARY. SO THIS IS NOT SOMETHING THAT JUST CAME UP AS A SURPRISE. BEFORE THEN WE CAME BACK BEFORE JUNE TO SPEAK TO YOU ALL. AND NOW WE'RE BACK HERE AGAIN AS WELL. BECAUSE WE HAVE WE, OF COURSE, AT THE END OF THE AH, YEAR KNOW EXACTLY THE GRAVITY AGAIN USING THAT TERM AND TO UNDERSTAND EXACTLY HOW MUCH IS ACTUALLY OWED TO OUR THIRD PARTY, BECAUSE AGAIN WE STILL HAVE TO UTILIZE THEM AND OTHER ENTITIES IN ORDER TO ENSURE THAT WE DO NOT HAVE ANY LOSS OF SERVICES TO THE BUILDING INSPECTION DIVISION AS WE PROCEEDED FORWARD. AND SO I'M READY TO ANSWER ANY QUESTIONS OR MR GARCIA. YOU GOT ANYTHING TO ADD THAT I'M IF POTENTIALLY MISSED WILL BE MORE THAN HAPPY TO ANSWER YOUR QUESTIONS. UH, IN OUR PACKET. WE HAVE THE NUMBER OF INSPECTIONS THAT WERE DONE.YES BUT IT'S NOT SHOWN HERE. SO YES, THAT'S PROBABLY 17 1716. THEY WHAT 1716 INSPECTIONS THAT WERE DONE BY BURE OVERDOSE. QUESTIONS OF $49,901.43. OKAY, OKAY. SO CURIOUS QUESTION. THIS IS AN INCREASE OF 49,900 CHANGE, WHICH IS BELOW THE $50,000 MAX BEFORE YOU HAVE TO COME TO CITY COUNCIL, BUT IT CHANGES FROM 70 TO 1 19 9. SO IS THIS COMING TO US AS A COUNCIL TO RATIFY EXPENSES THAT WERE ALREADY PAID OUT. THAT IS ACCURATE, SIR. YES, SIR. BUT IS IT IS IT A MATTER OF COURTESY COMING IN 49 9 BECAUSE YOU REALLY DIDN'T HAVE TO, OR YOU HAVE TO COME TO US BECAUSE IT WENT FROM 70 TO 11 19, MR CITY ATTORNEY. I'M JUST CURIOUS. THEY HAVE TO BECAUSE THE SAME VENDOR SO ITS VENDOR VENDOR, SO ANY INCREASE ABOVE $50,000 HAS COME HERE. OKAY JUST WANTED TO MAKE SURE THAT IN TERMS OF THE PRESENCE OF THIS PARTICULAR ITEM COMING TO US FOR RATIFICATION AT THIS POINT. AND UNDERSTANDING AS WELL FROM SAID THIS BEFORE. TO WIN SOMETIME IN THE PAST THAT WITH MY EXPERIENCE AND UNDERSTANDING OF THE PROCUREMENT PROCESS, THE TERM RATIFICATION IS A VERY IT'S A VERY SPECIFIC WORD. MEANING RATIFICATION ER, RIP PROVING SOMETHING THAT HAS BEEN DONE IN THE PAST AND WITHOUT RATIFYING. IT PUTS US IN A DEPTH MODE. SO WE ARE RATIFYING WHAT EXPENSES THAT HAVE BEEN PAID OUT. BEFORE OUR KNOWLEDGE COMING TO US TODAY, GIVING US THAT KNOWLEDGE AND RATIFYING SOMETHING THAT WAS DONE IN THE PAST. WE MAKE IT LEGITIMATE FOR THE FUTURE. CORRECT CORRECT. OKAY. JUST WANTED TO MAKE SURE THAT THE TERM RATIFICATION TO ME IS AN IMPORTANT WORD. BECAUSE MY EXPERIENCE AND PROCUREMENT SO I JUST WANT TO MAKE SURE WE UNDERSTAND WE AS A COUNCIL UNDERSTAND THE RATIFICATION PROCESS, OKAY? AND OF COURSE, THE NECESSITY HERE IS CLEAR. UM, ANY QUESTIONS FROM COUNCIL.
SEEING NONE. CHERYL ACCEPT THE MOTION TO APPROVE. SO MOVE MOTION TO APPROVE MR MCBURNETT SECOND. BYE BYE, MR KHAN, CHAIRMAN. COUNCIL, PLEASE VOTE. YEAH. MUST BE APPROVED. THANK YOU VERY MUCH. AFTER REQUEST OF A COUNCIL MEMBER. WE NOW TAKE ITEM. FOR OUR ON THE CONSENT
[Additional Item]
AGENDA. AND MAKE IT ITEM FIVE D ON THE ISLAND FOR INDIVIDUAL CONSIDERATION. SO I WILL READ THIS INTO THE RECORD. CONSIDER RESOLUTION AMENDING THE FISCAL YEAR 2023 2024 MASTER FIST SCHEDULE FOR PLANNING AND NEIGHBORHOOD SERVICES. TURNING THE FLOOR OVER TO MR GARCIA. YES SIR. GOOD EVENING MAYOR COUNCIL. GUS GARCIA, MANAGING DIRECTOR OF ELEMENT SERVICES I HAVE WITH ME, MR KIRK HASSAN. HE'S THE BUILDING. OFFICIAL. FOR BUILDING INSPECTIONS. YOUR ANSWER ANY QUESTIONS YOU MAY HAVE MR KOONTZ. MHM. WELL, THERE. YOU KNOW, AS I MENTIONED AND[02:10:04]
BRIEFING SLOWER. THERE ARE TWO SEPARATE QUESTIONS AND ONE WELL. ONE WAS MORE OF A CONCERN ABOUT JUST THE FEES FOR THE GARAGE SALES OF $25 FEE. THAT WAS IN ADDITION, MY UNDERSTANDING IS BEFORE THE PERMIT WAS REQUIRED, BUT THERE WAS NO $25 FEE IT THAT'S CORRECT. CORRECT THAT'S CORRECT. AND I HAD SOME QUESTIONS ABOUT. THE ENFORCEMENT OF YOUR MAKE SURE PEOPLE HAD PAID. YOU KNOW THOSE FEES TO GET THE PERMITS FOR THE GARAGE SALES. UM AND YOU KNOW, JUST FRANKLY, I WASN'T SURE IF WE SHOULD HAVE THAT AS AN ADDITION TO THE FEE SCHEDULE, SO I JUST WANT TO HERE. YOU DISCUSSIONS SURROUNDING THAT? UM IF I MAY, I WAS JUST THINKING, YOU KNOW, I MADE A COMMENT WHILE WE'RE IN THE BRIEFING SESSION THAT ENFORCEMENT YOU ASKED ABOUT ENFORCEMENT ENFORCEMENT DOES HAVE A COST TO IT. BUT YOU MADE A COMMENT THAT I THINK HAS MERIT AND MR I THINK MR CONTRERAS CONCURRED THAT SOMETIMES GARAGE SALES ARE DONE OUT OF NECESSITY RATHER THAN JUST CLEARING OUT STUFF. SO MY QUESTION WOULD BE IS IT? IS IT POSSIBLE FOR OUR INSPECTOR. DOING THE ENFORCEMENT OF THE GARAGE SALE PERMIT. WHEN HARDSHIP IS MENTIONED. BY THE BY THE CITIZEN THAT THEY'RE DOING THIS TO PAY AN ELECTRICITY BILL I THINK WAS MENTIONED OR FOR RENT OR SOME OTHER PURPOSES AND JUST TRYING TO RAISE MONEY CLEARING OUT OF HOUSE CAN ANY CONSIDERATION BE GIVEN TO WAIVE THE $25 FEE FOR HARDSHIP PURPOSES? OH THE FOR TO MR HAGAR ON THAT QUESTION. PLEASE KNOW UNLESS YOU ADAPT SOME CRITERIA THAT WOULD BE ARBITRARY AND CAPRICIOUS. I'M SORRY. I DIDN'T HEAR YOU. YOU WOULD HAVE TO ESTABLISH SOME CRITERIA AND THE FEE SCHEDULE SO THAT WE CAN APPLY THAT AS A MINISTERIAL ACT AND NOT A DISCRETION AREA. OKAY SO IF WE WERE TO DO THAT, WITH AN UNDERSTANDING THAT THE COUNCIL WOULD AGREE TO THAT THAT HARDSHIP EXPLANATION ON THE PART OF THE CITIZEN WOULD HAVE TO OCCUR AT THE TIME OF ACT OF COMING FORWARD TO ASK FOR THE PERMIT. NOT AT THE TIME OF ENFORCEMENT. CORRECT. THEY WOULD HAVE TO. I WOULD IF I WANTED IF I WANTED TO DO A GARAGE SALE, BUT I'M IN A HARDSHIP MODE. I'M DOING IT TO RAISE MONEY TO PAY MY PHONE BILL, I WOULD HAVE TO STATE TO OUR ASSOCIATE. COMING FOR THE PERMIT DIME IN A HARDSHIP MODE, AND THAT WOULD HAVE TO BE VALIDATED AT THAT TIME RATHER THAN AT THE TIME OF ENFORCEMENT AFTER THE PERMITS BEEN ISSUED, AND WHAT'S THE VALIDATION? PROCESS LOOK LIKE AND WHAT'S THE INFORMATION THAT'S GOING TO BE GARNERED AND WHAT METHOD OR MANNER? I WOULD BASICALLY THERE HAS TO BE LEGITIMIZED IN SOME FASHION. IF YOU'RE ASKING FOR TOMORROW, MY INCOME TAX RETURN. THAT THAT WILL BE DIFFICULT. AND THE STAFF WOULD BE HARD PRESSED. CHALLENGE ANYBODY, AND THEN THERE'S A PRIVACY ISSUE ABOUT GETTING THAT PERMIT THE SHOW MY INDIGENCY. OKAY SO THAT'S WHY I BRING THIS QUESTION UP FOR FURTHER DISCUSSION. SO, MR CONTRERAS? YES, SIR. YES, SIR. THANK YOU. MAYBE I COULD SIMPLIFY THIS IN THE TIME BETWEEN OUR BRIEFING SESSION AND NOW I CHECKED ONLINE WITH THE CITY OF CEDAR HILL, LANCASTER AND DESOTO. NONE OF THEM CHARGED FOR GARAGE SALE PERMITS, AND I THINK THAT WOULD BE WISE FOR US TO UM, IN THE COMMUNITY THAT WE ALL REPRESENT. THAT SPIRIT OF GIVING THESE GARAGE SALE PERMITS WAY FREE IS OBVIOUS. OBVIOUSLY. SOMETHING THE OTHER CITIES HAVE CONSIDERED. OKAY OKAY. THANK YOU, MR KOONTZ. YES, SIR. I APPRECIATE YOU BRINGING THAT UP COUNSELOR CONTRAST. AND I JUST WANT TO BE CLEAR. I THINK IT'S GOOD THAT THEY HAVE TO GET PERMITS. AND I THINK THAT'S A GOOD POLICY TO HAVE. BUT YEAH, I WOULDN'T WANT TO APPROVE THE SPEY SCHEDULED AND INCLUDE THAT THAT CHANGE. SO AH! IF WE CAN VOTE ON THIS WITH WITH THE PROPOSED YOU CAN MAKE A MOTION TO APPROVE IT WITHOUT THE GARAGE FEE PERMIT. AND IF YOU GOT A SECOND WELL, WHAT? WHAT I'D LIKE TO UNDERSTAND WHERE WE'RE GOING WITH WHAT I'D LIKE TO DO. UM AND I APPRECIATE THE COMMENT AND THE RESEARCH. IS TO ASK IF THERE'S ANY FURTHER COMMENTS BY THE OTHER CITY COUNCIL MEMBERS IN TERMS OF ELIMINATING THIS $25 FEE FROM THE FEW SCHEDULED BEFORE MOTION IS MADE TO DO IT. LET'S LET'S HAVE SOME DISCUSSION BEFORE THAT MOTION IS MADE IS GOOD. THANK YOU, MAYOR. UM, I BELIEVE IN BRIEFING. ONE OF MY QUESTIONS WAS, UM, IS THIS ALONG THE SAME LINES THAT THE OTHER BEST SOUTH, WITTY CITIES ARE. CHARGING AND I WAS TOLD YES, UM, BUT WE'VE RECENTLY DISCOVERED THAT THE OTHER CITIES ARE NOT CHARGING THE ADDITIONAL $25.25 DOLLARS FOR THE GARAGE SALES, SO I'M IN FAVOR OF REMOVING THE $25 FEE, AND THAT'S THE INPUTS THAT[02:15:05]
I'M LOOKING FORWARD THIS TIME BEFORE WE MOVE FOR GO FOR A MOTION. UM ANY OTHER INDIVIDUALS ? YEAH MR MATT BURNETT. I WOULD CONCUR WITH MS GOODEN. AND I'M GETTING A BODY LANGUAGE FROM MR VERA CRUZ. BUT I WOULD APPRECIATE IT IF YOU'D SAY SOMETHING. YES, SIR. I AGREE.OKAY. YEAH, NO COMMENT. OKAY SO, MR KOONTZ, I THINK THERE IS CONSENSUS AMONG COUNCILS. THE THAT IF YOU WERE TO MAKE A MOTION TWO. WE WERE STILL REQUIRE A PERMIT. BUT IN THE MASTER FEE SCHEDULE, WE WOULD DELETE THE $25 COST FOR THAT PERMIT. HE'S RIGHT. THANK YOU.
FOR THAT MOTION IS MADE. THIS ISN'T AGAIN. THIS WAS A QUESTION THAT WASN'T I DON'T KNOW IF IT WAS A CONCERN OR SOMETHING THAT NEEDS TO BE CHANGED. BUT MY QUESTION WAS THE OTHER QUESTION.
WAS ABOUT THE FOOD TRUCKS AND WHAT'S IN OUR FEE SCHEDULE ADDRESSES. TEMPORARY. LOCATIONS AND FOR EVENTS AND IN PARTICULAR. YOU KNOW, HAVE IT IN FRONT OF ME. BUT THE PERMIT. FOR YOU CAN GET AN EXTENSION, BASICALLY FOR $5 A DAY UP TO 10 DAYS, AND SO AFTER 10 DAYS I DON'T KNOW WHAT HAPPENS AFTER THAT. MY QUESTION WAS WHAT ABOUT FOR FOOD TRUCK THAT'S LOCATED FOR A MONTH OR TWO MONTHS. IS THERE ANYTHING IN OUR FEE SCHEDULE OR ANY KIND OF POLICY THAT ADDRESSES THAT A PERMANENT FOOD TRUCK? THANK YOU. YES UH SO WE HAD A MOMENT TO CONFIRM.
AFTER THE DISCUSSION AND IN THE WORK SESSION. AND SO BASICALLY, IT'S DICTATED BY AN S U P CURRENTLY, SO WE HAVE SOME AREAS WITHIN THE CITY THAT RECEIVED US UPS. THAT ALLOWED THEM TO HAVE A FOOD TRUCK ON THEIR SITE AND WITHOUT THAT S U P AND PERMISSION TO DO SO. THEN THERE WOULD BE SUBJECT TO THE YOU KNOW THE PROVISION THAT WOULD BE ORDINANCES THAT WOULD BE WITHIN THE CITY, WHICH CURRENTLY WE DON'T HAVE ANYTHING THAT WOULD GIVE THEM THE ABILITY TO HAVE IT. YEAR ROUND 365 DAYS. SO WE DO NOT CURRENTLY HAVE A FEE FOR THAT TYPE OF USE, SO THIS WOULD BE A TEMPORARY USE. WE WOULD HAVE TO COME BACK BEFORE COUNCIL AND PRESENT SOMETHING THAT YOU WOULD EVENTUALLY APPROVED. SO THAT WOULD BE THE LATER DATE. AND THAT WOULD BE AN S U P FOR THE PROPERTY ON WHICH THE FOOD TRUCK IS LOCATED. OBVIOUSLY, NOT FOR THE THAT'S CORRECT. AND SO JUST IN DISCUSSIONS, WE'D PROBABLY PRESENT SOMETHING THAT WOULD ALLOW A FEE FOR MAYBE A PERIOD OF SO MANY DAYS. AH AT A PARTICULAR TIME, AND THEN THEY HAVE TO MOVE IT UNLESS THIS COUNCIL WOULD ALLOW FOR YEAR ROUND FOOD TRUCK. THEN, OF COURSE, THAT WOULD BE A DIFFERENT FEE. OBVIOUSLY. YEAH. THE LEGISLATIVE REGULATORY SCHEME IS. I OWN A SHOPPING CENTER, AND I WANT A FOOD COURT TRUCK THERE TO HELP ATTRACT. PATRONS TO THAT SHOPPING CENTER.
SO I WOULD GET AN S. U P AND THEY WOULD IDENTIFY SITE WITHIN THE PARKING LOT FOR A FOOD TRUCK COURT. AND SO THE FEE SCHEDULE IS SO IF I WANTED TO UTILIZE THAT I COULD PAY A ANNUAL FEE TO GO TO THE FOOD TRUCK COURT. OR IF THERE WAS ANOTHER FOOD COURT TRUCK. I COULD GO BETWEEN THOSE TWO FOOD COURT TRUCKS BECAUSE THERE'S PERMITTED USE SO THE SCHEME IS FOR AN ANNUAL PERMIT FOR A FOOD HANDLER TO GO TO THOSE FOOD COURT. FOOD FOOD TRUCK COURTS FOR INTERMITTENT TIMES. BUT THERE WOULDN'T BE ANY PERMANENT. FACILITY LIKE IF YOU'VE GONE TO AUSTIN AND GONE TO THE TRAILER PARK, WHICH IS DOWN SOUTH LAMAR YEAH, THAT'S PERMANENT. AND THAT'S DONE BY AND THEN THERE'S ANOTHER ONE. ABOUT TWO BLOCKS EAST OF 15TH STREET FROM GUADELOUPE. AND THOSE ARE PERMANENT. AND SO TRUCKS ROTATE OUT WITH THE PROPERTY OWNER. THERE'S ONLY SPACE FOR 45 DIDN'T GIVEN MOMENT AND SO THEY ROTATE IN AND OUT OF THERE OR THE ONE ON SOUTH LAMAR IS PERMANENT. SO WE WOULD SET ALL THOSE RULES UP IN THE ISSUE P AND THEN THEY HAVE TO GET BASICALLY A PERMIT OPERATE IN THE CITY. BASED ON WHAT YOU'VE GOT HERE, AND SO COUNCILOR, RACCOONS. I'M I'M THINKING IT'S GOING TO BE PROBABLY ALONG THE LINES AS FAR AS IF HE IS CONCERNED WHAT WE WOULD CHARGE AND ESTABLISHMENT FOR HEALTH INSPECTIONS, WHICH IS 250
[02:20:03]
ANNUALLY FOR TWO INSPECTIONS. SO IT'S PROBABLY GONNA BE SOMEWHERE ALONG THOSE LINES. I WOULD THINK IF I HAD TO GIVE YOU A NUMBER TODAY, MAYOR, THIS SOUNDS MORE LIKE A ZONING DISCUSSION DOESN'T SEEM LIKE HAS ANY BEARING ON WHAT'S WHAT'S THIS U P CAME INTO THE PICTURE OF THEM WERE KIND OF MOVING AWAY. BUT IT'S GOOD FROM THE CITY ATTORNEY TO HELP US UNDERSTAND THAT THERE'S TWO PIECES TO WHAT WE'RE LOOKING AT HERE. ONE IS THE PERMITTING. AND IN THE FEE VERSUS WHAT'S GONNA BE HAPPENING IN TERMS OF THE LOCATION FOR THE S U P YEAH. IT IS STATED IN THE BRIEFING SESSION. I THINK IT'S WORTH NOTING HERE THAT MR GARCIA SAID THAT THEIR FEE IS AN ANNUAL FEE.IT'S FROM FOR ONE TIME A YEAR, AND IT WOULD ONLY BE REASSESSED. IF SOMETHING WERE TO CHANGE IN TERMS OF THE SCOPE OF WHAT THEY'RE OFFERING IS SO YOU GET A PERMIT EACH TIME YOU WANT TO SHOW UP, BUT YOU ONLY PAY A FEW ONE TIME. IS THAT CORRECT? I UNDERSTAND. CORRECT. YES, SIR.
SO THAT THERE WOULDN'T BE AN ENCUMBRANCE OF MORE MONEY ON A FOOD TRUCK VENDOR. IF THEY PAY THE FEE ONE TIME OF YEAR. THEY JUST HAVE TO COME IN AND GET A PERMIT. IF IT'S GOING TO BE LOCATION, A LIKE AT ARMSTRONG PARK FOR AN EVENT OR SOMETHING, THEY MOVE SOMEWHERE ELSE IN THE CITY, BUT THEY DON'T EVEN HAPPEN TO PAY A FEW ONE TIME OF YEAR. WE COULD GET A MAYBE DISCUSSION ON ZONING ASPECT OF IT AND AT SOME POINT OF COURSE. BUT THAT BEING SAID I'D LIKE TO MOVED TO PROVE THE CURRENT PEACE SCHEDULE WITH. YEAH I WAS GONNA I WAS JUST GOING TO INTERRUPT, BECAUSE MISS CHERRY HAS A COMMENT. I WANTED TO CALL ON HER BEFORE WE MOVE FORWARD THAT YES, MR JERRY BROWN. I HAVE A QUESTION ON THE YOUR SALES PRIOR TO THIS WE DIDN'T HAVE TO HAVE ANY KIND OF PERMIT. RIGHT PERSON JUST HAD A YARD SALE. CORRECT WE ALWAYS HAD TO HAVE A PERMIT. WE DID HAVE A LOT OF NON PERMITTED GARAGE SALES THAT WERE OCCURRING. AND SO THAT'S WHAT KIND OF SPURRED THE DISCUSSION AND THE FEE SCHEDULE IN 25. I JUST I WAS JUST CURIOUS ABOUT THAT BECAUSE I WAS THINKING IF WE'RE SAYING WE DON'T WANT CAUSE HARDSHIP, IF DAMP WORD IF WE DIDN'T HAVE ANYTHING BEFORE I WAS THINKING IT'S GONNA BE HARDSHIP. IF YOU HAVE TO GO GET PREMIERED ON THAT PERSON AND THE ON THE CITIZEN AND THE STAFF. SO IF IT WAS LIKE THAT BEFORE, OKAY? OKAY THANK YOU. SO UM IT'S GOOD TO KNOW WHERE, OKAY. I WANT TO MAKE SURE WE GET THINGS IN ORDER HERE. MR KOONTZ IS READY TO MAKE A MOTION. YOUR LIGHT CAME ON THAT YOU WANT TO MAKE A COMMENT? YES.
PLEASE GO AHEAD. THANK YOU, MAYOR. UM ON THE PREVIOUS AGENDA ITEM. I THINK IT WAS REFERENCED THAT THE MASTER FEE SCHEDULE THE JUST APPROVED AND SEE. AM I UNDERSTANDING THAT CORRECTLY? SO NOT. NOT EXACTLY THE MASTER FEED SCHEDULE. WE'RE CURRENTLY PLAYING PAYING BUREAU VERITAS.
70 $76.42 FOR AN INSPECTION OUR PREVIOUS MASTER FEE SCHEDULE WE HAD AT $75 ALONG WITH SOME OTHER FEES. SO THIS NEW MASTER FEE SCHEDULE MADE SURE THAT WE DIDN'T HAVE A DEFICIT PER CHARGE SCHEDULE WILL COVER THE COSTS INCURRED BY US WHEN WE USE A THIRD PARTY INSPECTOR, SO THAT'S WHAT IS MEANT THERE. OKAY SO I JUST WANT TO MAKE SURE THAT $25 DOESN'T AFFECT THAT. NO MA'AM PERMIT FOR THE GARAGE SALE. THAT'S WHAT I NEEDED. THANK YOU. THANK YOU, MR COONS. YES, SIR.
SO I WOULD LIKE TO MOVE THAT WE APPROVE. THE PEACE MASTER FEE SCHEDULES BEFORE US AH, BUT AMENDING IT BY REMOVING THE PROPOSED $25 FOR THE GARAGE. NO PERMIT SECOND. WE HAVE A MOTION BY MR KOONTZ AND THE SECOND BY MR CONTRERAS. IT'S ALL UNDERSTOOD. I HOPE ANY QUESTIONS? WE ARE SIMPLY REMOVING THE $25 FEE FOR THE GARAGE SALE PERMIT IN YOUR PACKETS. THERE'S AN EXHIBIT, WHICH IS AT THE BACK OF THAT THE EXHIBIT WILL NOW DELETE THAT PORTION DEALING WITH GARAGE. OKAY COUNCIL, PLEASE VOTE ON THE MOTION HAS BEEN MADE AND THE ITEM THAT WE HAVE BEFORE US TOGETHER. AND THEN ACTUALLY APPROVED. THANK YOU. YES SIR.
JUST JUST FOR THE PUBLIC JUST TO BE CLEAR. WE'RE NOT SAYING THEY DON'T HAVE TO HAVE A PERMIT.
THEY STILL HAVE TO GET A PERMIT. RIGHT PERMIT HAS ALWAYS BEEN IN PLACE, RIGHT? RIGHT. OKAY. VERY GOOD. THANK YOU. THAT COMPLETES THE ITEMS FOR INDIVIDUAL CONSIDERATION. AND THEY WILL NOW
[EXECUTIVE SESSION]
