TECHNICALLY LET'S SEE TOMORROW TOMORROW. TOMORROW IS THE TERMINAL EQUALIZE. CORRECT LOOK THAT UP, UH, TOMORROW WEDNESDAY . EXACTLY RIGHT. MHM DAY OF THE WEEK. AND I'D LIKE TO JUST WELCOME HER AND MAKE SURE EVERYONE GETS A CHANCE TO SEE HER CHANCE TO MEET AND SPEND TIME WITH IT. OKAY? NEXT ON MY AGENDA ITEM FOR IT. CONSIDER THE MINUTES FOR SEPTEMBER. 6TH 2020 2020 22 CITY COUNCIL REGULAR NEED. FOUR BE CONSIDERED RESOLUTION AUTHORIZING THE RECEIPT OF A GRANT FROM THE TEXAS OFFICE OF THE GOVERNOR OF CRIMINAL JUSTICE DIVISION FY 23 BULLET RESISTANT SHIELD GRANT PROGRAM TO FIND FUNDING FOR THE POLICE DEPARTMENT TO PURCHASE 25 BULLET RESISTANT SHIELDS FOR POLICE OFFICERS WITH THE TOTAL RENT VALUE OF $250,125 BULLET RESISTANT SHELL GRANT. IS ADMINISTERED BY THE OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION. TO EQUIP LAW ENFORCEMENT OFFICERS WOULD BULLY RESISTANT SHIELDS. SHIELDS ARE FOR USE AND ACTIVE SHOOTER AND OTHER HIGH RISK SITUATIONS THAT ARISE DURING THE COURSE OF THE GRANT IS A REIMBURSEMENT RAMP WITH NO MATCH REQUIRED. POLICE DEPARTMENT HAS A MUTUAL AID AGREEMENT WITH THE DOCTOR, VILLE INDEPENDENT SCHOOL DISTRICT POLICE DEPARTMENT WHILE THE GRANT FUNDING PRIORITIZES FINDING SCHOOL DISTRICT POLICE OFFICERS. IT DOES ALLOW FUNDING FOR OTHER POLICE OFFICERS WHO WOULD BE EXPECTED TO RESPOND TO ACTIVE SHOOTING SCHOOL INCIDENTS . ITEM FORESEE, CONSIDER. IT IS A GRAND. WE HAVE TO SPEND THE MONEY FROM A REIMBURSABLE. SO WE HAVE TO SPEND IT AT SOME IS IT IN THE BUDGET FOR 22 23 OR IS IT EXCUSE ME. I DO. GRACIOUS SO IT'S A BUDGET THAT ITEM THAT 250,000. YES YES, WE DO IS WE SPEND AND THEN WHEN REIMBURSED ON IT, OKAY, MAKE SURE I UNDERSTAND. OKAY. THANK YOU. AND SOME OF THE QUESTIONS ARE ANSWERED. YOU'LL FIND THE MAYOR SENT SOME QUESTIONS. I HAVE QUESTIONS FROM OTHERS KIND OF INCORPORATED THOSE IN MY REMARKS , SO I DON'T FORESEE IS CONSIDERED A RESOLUTION AUTHORIZING AN APPLICATION ACCEPTANCE FOR THE RECEIPT OF A GRANT FROM THE TEXAS OFFICER, GOVERNORS CRIMINAL JUSTICE DIVISION. FY 23 ALERT TRAVEL ASSISTANCE GRANT TO PROVIDE FUNDING FOR THE POLICE DEPARTMENT TO SEND POLICE OFFICERS TO ADVANCED LAW ENFORCEMENT RAPID RESPONSE TRAINING WITH THE TOTAL GRANT VALUE OF $1000.23. TRAVEL REP IS ADMINISTERED BY THE OFFICE OF THE GOVERNOR. CRIMINAL JUSTICE DIVISION TO OFFSET AGENCY ENCOURAGE TRAVEL COSTS FOR THIS SENDING PEACE OFFICERS TO ADVANCED LAW ENFORCEMENT RAPID RESPONSE TRAIN ALERT IS DESIGNED TO PREPARE THE FIRST RESPONDERS TO ISOLATE, DISTRACT AND NEUTRALIZE AN ACTIVE SHOOTING. BONDS FROM THE GRANT WOULD ALLOW THE DEPARTMENT TO SEND OFFICERS TO THE ALERT, TRAIN THE TRAINER COURSES AND GET REIMBURSED FOR TRAVEL EXPENSES, IN ADDITION TO OVERTIME COSTS INCURRED BY THE AGENCY TO BACKFILL PEACE OFFICER SHIFT FOR THE OPPOSITES WHO ARE ATTENDING ALERT TRAIN. THIS IS ALSO ANOTHER REIMBURSEMENT. ONCE WE SUBMIT THE RECEIPT OF THE STATE, WHERE REINFORCES THE TRAINING IS A REQUIREMENT OF THE FY 23 BULLET RESISTANT SHIELD GRANT PROGRAM. ITEM. FOUR D. CONSIDER RESOLUTION APPROVING THE TERMS AND CONDITIONS OF THE CONTRACT AMENDMENT NUMBER THREE TO THE STANDARD FORM OF AGREEMENT ARE FQ 200011 WITH BROWN REYNOLDS ARCHITECT INC FOR ARCHITECTURAL AND ENGINEERING DESIGN SERVICES FOR FIRE STATION NUMBER ONE TO AN INCREASE IN THE GUARANTEED MAXIMUM PRICE FROM 4.5 MILLION TO 7.591908. ANY AMOUNT NOT TO EXCEED $197,000. SO THIS AMENDMENT THREE AS PROPOSED TO INCREASE THIS IS THE CONTRACT NOT TO THE ACTUAL CONSTRUCTION MANAGER AT RISK,
[00:05:02]
BUT TO THE ARCHITECT AND THE ARCHITECTS, PRICE WAS BASED ON BASED ON THE FINAL PRICE BROWN PAPER DUE TO THE PROVISIONS OF THE ORIGINAL REGION PARTICLES 11 WHICH STATES THAT SHOULD THE GUARANTEE MAXIMUM PRICE EXCEEDS THE AMOUNT BY 4.5 MILLION ARCHITECTS SPEECH SHALL BE INCREASED BY 8.75. OF THE DIFFERENCE BETWEEN THE ORIGINAL AND THE MAXIMUM PRICE, THE ACTUAL GUARANTEED MAXIMUM PRICE AS APPROVED BY COUNCIL ON JUNE 7TH, AS WE KNOW WAS AROUND 7.5 MILLION. BASED ON THIS PROVISION , ADDITIONAL DESIGN FEES WOULD HAVE BEEN 4 $270,541.95. HOW WELL APPROXIMATELY 11% OF THE PRICE INCREASE IS DUE TO THE RAPID CONSTRUCTION COSTS.ESCALATION EXPERIENCED LAST YEAR. THEREFORE THE RW PROPOSED A DISCOUNT IN THEIR SERVICE OF $197,000. SO. GO AHEAD. FANTASTIC QUESTION AND JUST THEY $197,000 IS NOT A CHANGE ORDER.
THIS INCREASE IN SERVICES IS COUPLED WITH THE COST OF THE PROJECT, WHICH WE KEPT SO THEY MOVE LIKE THIS. AND AS WE KEPT AS WE THE COUNCIL CAPTAINS PROJECT, THEN THEY HAVE THE ABILITY LEGAL ABILITY TO GO AHEAD AND INCREASE THEIR SERVICES, WHICH THEY DIDN'T.
THAT'S WHERE THIS $197,000 CAME FROM, AND THAT'S WHY I READ THIS, AND THAT'S THE QUESTION.
CITY MANAGER DID COVER IT. SO THESE THINGS ARE COUPLED ALL THE WAY UP. SO BUT IF THIS POINT THAT WE CANNOT EXPECT ANY FURTHER INCREASES IN THEIR SERVICES BECAUSE GETTING THERE KEPT OUT, THEY GAVE US A BIG DISCOUNT, WHICH WE GREATLY APPRECIATE THEIR SERVICES ARE NOW KEPT UP WITH THE ADDITION OF THE 1 97. WE NEGOTIATED, NEGOTIATED MR COONS? YES, QUESTION ABOUT IS THAT ARTICLE OF WEAPON IS THAT THAT STAND FOR THESE KINDS OF CONTRACTS AND DO THEY, BUT THEY NEVER SPECIFY. IT GOES BEYOND THAT GMP. IS THIS WASN'T IT CAN INCREASE. AT WORK AND JUST BE INCREASING OUR MATERIALS, RIGHT? SO IN THAT ARTICLE LED HIM TO ME THIS QUESTION STANDARD. UM COST OF THE ARCHITECTURAL. PROVISION IN THESE TYPES OF CONTRACT THAT THEY FOLLOW WHENEVER GUARANTEED. MAXIMUM PRICE IS AH! WHERE WE NEGOTIATED WITH THEM. THE FACT THAT THERE WAS A SPIKE IT WAS REALLY CAUSED BY COVID MORE THAN ANYTHING ELSE IN THIS PIE CHAIN.
SO THAT'S WHY WE'RE GOING TO GET THAT CAMERA. NORMALLY IT WOULD NOT NECESSARILY BE CAPPED, FOLLOWED COST GUARANTEED RIGHT? ALRIGHT LET'S BE ONE ITEM FOR THIS IS CONSIDERED RESOLUTION APPROVING THE LANDSCAPE MAKE DISAGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION TAX DOT THE LANDSCAPE IMPROVEMENTS ALONG U S. I H 20, BEGINNING AT NORTH CEDAR RIDGE DRIVE AND ENDING THE EAST NORTH SERIOUS DRIVE IN 2021, THE GOVERNOR COMMUNITY ACHIEVEMENT AWARDED TO KEEP DR GO BEAUTIFUL WITH $210,000 FOR A LANDSCAPING PROJECT. ON JUNE 7TH 2022 COUNCIL APPROVED THE LANDSCAPING ENHANCEMENT ALONG I 20 AND CEDAR RIDGE ROAD COUNCIL RESOLUTION IS REQUIRED TO ENTER INTO THE LANDSCAPE MAINTENANCE AGREEMENT L M A WITH TECH STOCKS FOR MAINTAINING THE LAST VEHICLE ASSOCIATED WITH THE LANDSCAPE PROJECT. THE CITY HAS AGREED TO BE RESPONSIBLE FOR MAINTAINING THE LANDSCAPE ENHANCEMENT. FUNDING FOR THE MAINTENANCE HAS BEEN INCLUDED IN THE 2022 23 BUDGET IF THE CITY DECIDES TO ENHANCE THE LANDSCAPE PROJECT IN THE FINAL DESIGN PHASE IN THE CITY WOULD BE REQUIRED TO ENTER INTO AN ADVANCED FUNDING AGREEMENT WITH TEXTILE OR ADDITIONAL ENHANCEMENTS. THIS IS THE PROJECT THAT WHEN WE WERE GIVEN THE OPPORTUNITY TO DECIDE WHERE WE WANT IT TO FUND CAME IN . WE SELECT THAT PROJECT BUT AS AN AGREEMENT WITH TECH STOCK PROVIDES FUNDING WE ARE THEN REQUIRED TO DO THE MAINTENANCE WANT TO DO THE BEAUTIFUL LANDSCAPING AND THAT'S TYPICAL OF OUR PROJECTS THAT ACTUALLY GIVES US MORE CONTROL AND MAINTENANCE BECAUSE WE'RE NOT ON TEXT DOT SCHEDULED FOR MAINTENANCE AND PUTS IT ON OUR SCHEDULE AND BECOMES OUR RESPONSIBILITY SO OKAY? M FOUR.
CONSIDER. COUNCIL TO CONSIDER AUTHORIZED THE CITY MANAGER SOCIETY AND EXECUTE A SETTLEMENT AGREEMENT AND MUTUAL GENERAL RELEASE WITH AND NOT TREND AND REGARDING IN REGARDS TO THE CITY OF DUNCANVILLE MUNICIPAL COURT CASE NUMBER 200318004 AND FURTHER AUTHORIZED AS PART OF THE SETTLEMENT PAYMENT TO BEST AND LOST PS AND THE AMOUNT OF 39,007 24 CENTS. [00:10:08]
RELATED TO THE ALLEGED GAMBLING WILL BE FORFEITED TO SAY. AND SO I'LL LET THAT TRAINING RESPONSE.QUESTIONS HAVE THE QUESTION ON THIS PARTICULAR ONE TERM SOMETHING A FORFEITURE IN THE SETTLEMENT ITSELF. AGREEMENT BECAUSE THE SETTLEMENTS REACHED MEANS THERE WAS SOME CULPABILITY ON OUR PART. WELL WE'LL SEE SOME FUNDS THAT WE THOUGHT WERE ATTRIBUTED TO GAMBLING ACTIVITY, WHICH WE HAVE ENTITLED TO. AND AFTER WE GOT IT IN THAT DEPARTMENT AND THE OWNER OF THE BUSINESS, WE SETTLED ON THIS MOUNTAIN WAS SOMETHING THAT THEY HAVE FORFEITED TO US. WE'RE TRULY THOSE ATTRIBUTED TO THE GAMBLING AND $39,000 FUNDS THAT THEY EARNED BY GENERATION OF BUSINESS GENERALLY, WHAT HAPPENS MAYOR AND COUNCILORS? YES THERE'S GAMBLING ACTIVITY, AND THEY'RE PAYING THE GAMBLING PROCEEDS OUT OF THE TILL. WE TAKE THE HOTEL. RIGHT? AND TOBY.
COME TO SUMMER CORD. YEAH, AN ACCOUNTING IF YOU WILL. THANK YOU FOR THAT. THANK YOU. ANY OTHER? YES. QUESTION AND ANSWER. ITEM FOUR G CONSIDER APPROVAL OF THE RESOLUTION FOR AN OFFER OF A HOTEL OCCUPANCY TRACK TAX GRANT FOR FY 22 23 BUDGET IN THE AMOUNT NOT TO EXCEED $15,215.68R OF COMMERCE FOR MAINTENANCE REPAIRS, LANDSCAPING UPGRADES, UPGRADES AND SIGNAGE WHILE SERVING AS THE DOCUMENT OFFICIAL VISITORS HAVE RECEIVED SOME ADDITIONAL QUESTIONS THAT I DON'T HAVE THE ANSWER. AND SO I THINK I WAS REQUESTING THAT IF YOU WOULD ALLOW US TO BRING THIS ITEM ADDITIONAL INFORMATION AT THE TIME, BUT I HAVEN'T HAD A CHANCE TO GO THROUGH IT. SO PLEASE MAKE A NOTE OF THAT. WOULD YOU 40, OKAY? I DON'T H CONSIDER A RESOLUTION IMPROVING A NEGOTIATED SETTLEMENT BETWEEN ATMOS CITIES DURING COMMITTEE AND ATMOS ENERGY CORE MID TEXAS DIVISION REGARDING THE COMPANY'S 2022 GREAT REVIEW MECHANISM, WHILE CLIENT EXISTING RATES TO BE UNREASONABLE, ADOPTING TARIFFS THAT REFLECT RATE ADJUSTMENTS CONSISTENT WITH THE NEGOTIATED SETTLEMENT, FINDING A RACE TO BE SET BY THE ATTACHMENT SETTLEMENT TREACHEROUS TO BE JUST AND REASONABLE AND IN THE PUBLIC INTEREST ARE PROVING AN ATTACHMENT EXHIBIT. RESIDENTIAL RATE IS AN INCREASE OF 4.6. $6 MONTHLY ARE A 6.7 INCREASE. THE INCREASE OF AVERAGE COMMERCIAL USAGE WILL BE $14.34 OR A 4.3. ATMOSPHERE PROVIDED BILL IMPACT COMPARISONS CONTAINED AND CONTAINING THESE FIGURES. ITEM FOUR. I. CONSIDER A RESOLUTION AUTHORIZING A CONSENT TO ASSIGNMENT OF CONTRACT. FB DASH 19-1 TRAFFIC SIGNAL MAINTENANCE FROM INDUSTRY TO NEXT NEXT LLC. THIS IS A CHANGE IN COMPANY NAME AND TRANSFERRING OF SERVICES ON NOVEMBER 2020 18. THE COUNCIL AWARDED A CONTRACT 19 OH ONE TRAFFIC SIGNAL MAINTENANCE TO CNN'S INDUSTRY. I INCORPORATED THE V A SEAMLESS MOBILITY IN THE AMOUNT OF $151,314 FOR AN INITIAL TERM OF ONE YEAR WITH FOUR OPTIONAL ONE YEAR RENEWAL TERMS, THE CONTRACT WILL END ANOTHER 1920 23 WITH NO FURTHER WE GO ON. SIEMENS HAS REQUESTED THE CITY OF DR BILL CONSENT TO HAVE THE AWARDED CONTRACT ASSIGNED TO NEXT LLC AS PART OF THE COMPANY'S REORGANIZATION OF HIS BUSINESS. OKAY SIMPLY RENAMING. RENAMING. ABSOLUTELY NOW. CHECK FOR J CONSIDER RESOLUTION APPROVING SERVICES, UH, TEXAS LT D REQUEST TO THE CITY OF DR BILL TO INCREASE CONTRACT RATES ON THE MISERABLE MATERIAL MANAGEMENT AGREEMENT BY 4.4% FOR RESIDENTS COLLECTION AND COMMERCIAL SERVICE. THIS ITEM APPROVES REPUBLIC SERVICES OF TEXAS REQUEST TO INCREASE CONTRACT RATES UNDER THE MISSILE MATERIALS MANAGEMENT AGREEMENT. 4.4% FOR RESIDENTS COLLECTION AND COMMERCIAL SERVICES. CITY COUNCIL APPROVED THE MISS WORLD MATERIAL MANAGEMENT AGREEMENT WITH FROM PUBLIC TEXAS AND 2019 FOR AN INITIAL TERM OF SEPTEMBER 21ST 2019 THROUGH SEPTEMBER.20TH 2026 AGREEMENT INCLUDES A PROVISION FOR AN ANNUAL RATE ADJUSTMENT LIMITED TO THE PERCENTAGE INCREASE AND THE CONSUMER PRICE INDEX THE REQUESTED 4.4 INCREASE IN CONTRARY RATES FOR RESIDENTIAL COLLECTION AND COMMERCIAL SERVICES BASED ON THE JULY 2022 C P I, AND, IF APPROVED BY COUNCIL WILL TAKE EFFECT ON OCTOBER 1ST 2022. JUST FOR A NOTE IF YOU WANTED TO TAKE A LOOK AT THAT TABLE, WHAT IT AMOUNTS TO YES. THE RATE INCREASE INCREASE OUR MONTHLY HES WE AS CITIZENS PAID TO REPUBLIC BY 84 CENTS A MONTH.
WHICH WAS INCLUDED IN OUR BUDGET LESS THAN $1 A MONTH FOR WHAT THEY'RE ASKING FOR FORCES. I WILL THROW THIS IN ABOUT A WEEK AND A HALF AGO, I SAID. A COPY OF THE DALLAS MORNING NEWS TO CITY MANAGER THAT THE CITY OF IRVING IS GOING TO ONE TRASH PICK UP A MONTH. BASED ON THEIR PROVIDER, INABILITY TO HIRE AND RETAIN EMPLOYEES AND TO PAY AND THERE WAS NOT A DECISION THAT ANYBODY COULD LIKE TO COME TO THE CITY OF IRVINGTON MAKING THAT DECISION AND I THINK THAT WE AS A CITY OF DUNCANVILLE AND WE CITIZENS ARE BLESSED. WE HAVE REPUBLIC AND THEN WE'LL MOVE YOU'RE INCURRING HERE IS ON THE 84 CENTS A MONTH BECAUSE THEY'RE STILL CONTINUING TO PROVIDE CONTINUING TO WRITE TOO MUCH TO A WEEK VS IRVING HAPPENED A LITTLE WATER WEEK AS RESULT THEIR ISSUES WITH THEIR PROVIDER SO JUST THAT ISN'T IS AN ADJUNCT. PIECE OF INFORMATION TO UNDERSTAND WHAT WE'RE DOING WITH REPUBLIC VERSUS OTHER COMPANIES NOT ENDURING AS BEING SUSTAINABLE. I GUESS AS WE ARE WITH REPUBLIC JUST WANTED TO THROW THAT INFORMATION OUT.
THANK YOU. ITEM FOUR K. CONSIDER A RESOLUTION AUTHORIZING INCORPORATE PURCHASE AGREEMENT WITH EFFORTLESS BRUTE SECTION 271102 OF THE TEXAS LOCAL GOVERNMENT POST STATES LOCAL GOVERNMENT ANTICIPATING A CORPORATE PURCHASING PROGRAM, THE LOCAL GOVERNMENT OF THE STATE OR ANOTHER STATE OR WITHIN A LOCAL FOREIGN PEOPLE, COLONIZATION STATE GOVERNMENT UNDER STATE. LOCAL AGREEMENT MUST BE AUTHORIZED BY THE GOVERNMENT PARTY PARTY FOR EACH AGREEMENT. THE CITY INTENDS TO ENTER INTO THIS IN A LOCAL AGREEMENT TO PURCHASE GOODS AND SERVICES TO AVOID DUPLICATE PROCUREMENT EFFORTS TO OBTAIN BENEFITS OF VOLUME. PURCHASING THIS IS SOMETHING WE DO COMMONLY, IT GIVES US AN OPPORTUNITY TO BENEFIT FROM NEGOTIATED RATES BY OTHER COMMUNITIES PROBABLE AND OUTSIDE OF OUR STATE. GET BETTER PRICING HAD A QUESTION ON THIS ONE TURNED BLOATING. IT'S BASICALLY ANOTHER BY BOARD SOURCE THAT WE CAN GO TO IT WAS VERY GENERAL IN NATURE IN TERMS OF SERVICES AND SUPPLIES, SO IS IT WHAT KINDS OF SERVICES AND SUPPLIES WHAT EQUALITY. GIVE US SOMETHING THIS BY BOARD. GET TO ANSWER THAT, ACTUALLY EQUALLY IS THE CORPORATE ORGANIZATION THAT HAS BROUGHT TOGETHER SUSPICIONS MADE
[00:20:01]
BY SOME OTHER GOVERNMENT IDENTITIES, AND THIS CONTRACTS HAVE BEEN NEGOTIATED. I SHOULD.AS MATTER OF FACT, WE ARE PLANNING TO USE THIS ONE FOR THE BENEFITS CONTRACT THAT WERE NEGOTIATED THURSDAY. OKAY GENERAL GENERAL SERVICES AND SURVIVED. THAT WAS MY QUESTION.
THANK YOU VERY MUCH, MR. OKAY VERY GOOD. ALRIGHT SORRY. FINISHES UP OUR CONSENT ITEM DISCUSSIONS. OKAY, ABSOLUTELY GOING TO ITEM TWO. A DISCUSSING FINALIZED THE COUNCIL RULES PROCEDURES CITY MANAGER THIS OVER I'M GOING TO ASK MR KEYES, WHO'S BEEN WORKING ON THIS AND I'LL BE HERE TO SUPPORT QUESTIONS. I DID RECEIVE SOME FEEDBACK, WHICH WILL BE INCORPORATED IN YOUR CONVERSATIONS. THANK YOU MARY COUNCIL ASSISTANT CITY MANAGER.
YOU CAN DO THAT. SO, UH, FEW WEEKS AGO, YOU HAD YOUR MEETING ABOUT RULES AND PROCEDURE. WE SENT OUT THE DOCUMENTS WITH WHAT WAS TALKED ABOUT IN THAT MEETING TONIGHT. WE'RE JUST GONNA GO. WE SENT OUT THE CLEAN VERSION AND THE REDLINE VERSION. WHERE WHAT WE'RE GONNA HAVE UP HERE TONIGHT IS THE RED LINE VERSION JUST SO YOU CAN SEE THE CHANGES AND THINGS LIKE THAT. OBVIOUSLY WE WANT ANY KIND OF FEEDBACK. UH ANYTHING THAT WE YOU STILL MAY WANT TO TWEAK SO THAT WE MAKE SURE THAT YOUR MEETINGS RUN AS SMOOTHLY AS YOU WANT THEM TO. SO WE'LL START WITH THE RULES AND RESPONSIBILITIES AND A LOT OF WHAT WE DID. YEAH MOST OF WHAT YOU CAN SEE IS, UH, WITH WE ATTACKED THE GENDER PRONOUNS, MAKING SURE THAT EVERYTHING'S NEUTRAL. WE DID SOME FIXING UP OF ANY KIND OF GRAMMATICAL ERRORS, LOWER CASE ON THE CASE. THINGS LIKE THAT A LOT OF THINGS . AH WILL STAY THE SAME. BUT WE DO WANT TO MAKE SURE THAT WE PUT IN LANGUAGE UP HERE. I DON'T KNOW IF THE ORIGINAL HAD OR THE SUBSEQUENT RUN OFFS. IN TERMS OF WHEN WE ACTUALLY BRING SOMEBODY ONTO THE COUNCIL AND SQUARE. THE MEN. THINGS LIKE THAT. THIS OUTLINES THE DUTIES OF AMERICA PRO TEMPORE, AND THERE'S DISCUSSION ON HOW YOU ACTUALLY SAY THAT I'M JUST GOING TO GO WITH TEMPUR FOR RIGHT NOW SEPARATE TEMP WORK. UM. SO WE DID THAT, UH, THIS IS ACTUALLY ADDRESSING THE CITY COUNCIL. SO AND SOME OF IT, KID. ACTUALLY MENTIONS THE MAYOR AND THE MAYOR'S ROLE IN TERMS OF BEING THE MODERATOR OF THE MEETINGS AND HIS ROLE AS THE MAYOR AND THEN THE COUNCIL'S ROLE. UH IN ADDITION TO THE MAYOR, UM AND THEN WE ADDED THIS FINE DOWN HERE. WE'VE GOT A COUPLE, UH, MEETINGS WITH THE CITY ATTORNEY . WE WANNA GIVE YOU ACCESS, OBVIOUSLY CITY ATTORNEY AND HIRED BY YOU, AND WE WANT YOU TO HAVE ACCESS TO HIM. BUT YOU'VE GOT TO KEEP IN MIND THAT MR HAGAR DOES LIKE TO BUILD US AND SO WE WANT TO BE JUDICIOUS WITH WHAT WE ASKED HIM. UH STAFF IS ALWAYS AWARE OF THAT AS WELL. WE WOULD LIKE THE COUNCIL TO BE AWARE OF THAT AS WELL. UM AND THEN WE ADDED THE LINE HERE ABOUT THE MAYOR PRO TEM. BOTH THE MAYOR AND THE MAYOR PRO TEM ARE ABSENT, WHO WOULD FALL TO BE THE MODERATOR? AH AVERAGE.
COUNCIL MEETING AT THAT POINT THESE ARE THE CITY MANAGER'S RESPONSIBILITY. UM WELL, SHE IS REQUIRED. THE CITY MANAGERS REQUIRED OF AT THE TIME AND PROVIDING INFORMATION TO THE MAYOR AND COUNCIL. THERE WERE A FEW THAT I DIDN'T HAVE ANY KIND OF REVISIONS, AND THAT THE CITY ATTORNEY DEFINITION AS APPLIED IN THE HONORABLE CHARTER. AND WHAT THE RESPONSIBILITIES OF THE CITY ATTORNEY ARE TO INTERVIEW TERMS AGAIN, FIGHTING THOSE WRITTEN OPINIONS HE DOES STILL BUILD FOR THEM, SO ALWAYS KEEP THAT IN MIND. DO BRING IN THE CITY SECRETARY'S ROLE APPOINTED BY THE CITY MANAGER TO BE THE OFFICIAL KEEPER RECORD. UH FOR THE MINUTES. THE AGENDAS RUNS IN THE ELECTIONS TO CITY SECRETARY DOES A LOT OF THAT, BUT IT ALSO OUTLINES WHEN THE AGENDAS ARE SUPPOSED TO BE DONE WHEN MINUTES ARE SUPPOSED TO BE DONE. RECORDINGS OF MEETINGS, THINGS LIKE THAT, JUST TO MAKE SURE THAT WE'RE UP TO PAR WITH THE STATE OF TEXAS IS OPEN MEETINGS, ACT THINGS LIKE THAT. ANY QUESTIONS ON THAT BEFORE I GO INTO RELATIONS. OKAY THIS IS
[00:25:07]
GONNA BE THE RELATIONS OF MAYOR, CITY COUNCIL CITY MANAGER AND STAFF. NOT A WHOLE LOT OF CHANGES. THE ONE THING I'LL POINT OUT IN LINE THREE. WE DID HAD, UM, JUST SOMETHING. FOR THINGS WHERE YOU GET QUESTIONS FROM YOUR CONSTITUENTS ABOUT ROUTINE THINGS LIKE GARBAGE PICKED UP OR WATER BILLING. THE ASK IS THAT THOSE BEING DIRECTED TO CITY STAFF RATHER THAN TO THE CITY MANAGER? THOSE CITY STAFF ARE THERE EVERY DAY DAY IN AND DAY OUT. TO TAKE CARE OF IT, AND A LOT OF TIMES THEY'RE THE ONES THAT WILL HAVE THE BEST ANSWER FOR YOUR CONSTITUENTS, AND WE'LL GIVE YOUR CONSTITUENTS THE BEST CUSTOMER SERVICE POSSIBLE. MR CONTROLLER SAYS THE QUESTION.YES TO THAT POINT. UM, I JUST WANT TO MAKE SURE THAT WE'RE DIRECTOR. THAT WE'RE PLUGGING THE STAFF IN TO MAKE SURE THAT THEY ARE AVAILABLE TO ANSWER THEIR PHONES. EMAILS CAN RESPOND. BECAUSE WE'VE HAD A LOT OF. COLLINS AND CONCERNS ABOUT THOSE KINDS OF THINGS. SO IF WE'RE TAKING THAT THEY'RE NOT THAT I WANT TO OVERBURDEN THE CITY MANAGER WITH SOME OF THE DAY TO DAY ISSUES, BUT THAT THAT HAS BEEN A WEAK POINT BARS AND HOPEFULLY THAT WE'RE WORKING ON THAT AND GETTING BETTER. I'M NOT HEARING AS MUCH SO I ASSUME THAT WE ARE GETTING BETTER, BUT SOMETIMES THERE'S ISSUES WHERE THE CITIZENS JUST TELL US. WE'RE NOT GETTING ANY WORSE. AND SOMETIMES I'VE LEARNED THIS JUST BECAUSE I FEEL A LOT BEING IN THE CHAIR THAT FIELDS THE CITY MANAGER'S PHONE CALLS. I CAN TELL YOU A LOT OF TIMES THE QUESTION I ALWAYS START WITH WHEN SOMEBODY SAYS I DIDN'T GET THIS OR I DIDN'T GET THAT. I ALWAYS START WITH. HAVE YOU CALLED? SO AND SO AND I ACTUALLY HAVE HAD A FEW PEOPLE SAY WELL, NO, I HAVEN'T CALLED THEM YET. I KNOW YOU TOLD ME TO, BUT I STILL HADN'T GOTTEN ANYWHERE AND I SAID HAVE YOU CALLED? SO AND SO AND THEY SAY, WELL, NO, THEY'RE MY NEXT CALL. AND ALMOST ALWAYS THE NEXT CALL. SO I DO UNDERSTAND YOUR CONCERN, AND WE ALWAYS WANT TO MAKE SURE THAT WE TAKE CARE OF OUR CUSTOMERS. AND IF YOU GET A CUSTOMER THAT SAYS I CALLED, AND I DIDN'T GET THIS THAT ABSOLUTELY COME TO US, AND WE'LL MAKE SURE STAFF IS ON TOP OF THANK YOU. QUESTION IS CATTLE COURTESY. DO CITY MANAGER AND YOURSELF? STILL ASKED THAT WE SEE SEE TO WHEN WE ARE AFFORDING THIS TO AN APPROPRIATE DIRECTOR . SO WHAT? WE'RE STUFF, ACTUALLY . SO WHAT WE'RE SAYING TO YOU IS ACTUALLY THE OPPOSITE. WE'RE ASKING YOU ALL TO ASK YOUR CITIZENS TO REACH HAVE THEY REACHED OUT TO STAFF FIRST. IF THEY SAID I CALL STAFF, NOBODY ANSWERED MY CALL. THEN IT COMES TO US. WE JUST THIS IS REALLY A REMINDER THAT WE WON'T ROUTINE CALLS TO START OUT WITH THE CITY STAFF. AND THEN COME TO THE CITY MANAGER AS AN ESCALATION. AND SO YOUR REQUEST THAT HAVE COME BECAUSE YOUR CONSTITUENTS ARE FRUSTRATED. COULDN'T REACH ANYBODY. ONCE YOU'VE ASKED THAT QUESTION, THEN YOU GET TO TALK TO ME. INDEED, ALL THESE QUESTIONS LEAST FOR ME AGAINST BIG ABOUT COUNCIL. ALL THESE QUESTIONS COMING TO ME OR MY EMAIL. SO MY RESPONSE GOING BACK TO THAT PERSON WOULD SAY, HAVE YOU CONTACTED SO AND SO? AND I'M ASKING. DO YOU WANT TO BE CC'D GOING BACK? NOT UNTIL THEY NOT UNTIL THEY'VE SAID, UH YES, WE CONTACT THEM AND WE DIDN'T GET ANY HELP. AND THAT'S WHEN WE HAVE TO INTERVIEW THE ANSWER. SO WE WANT TO UNBURDEN YOUR INBOX. ESPECIALLY ABSOLUTELY AND IF YOU WOULD LIKE WE CAN SEND OUT A QUICK LIST OF THAT YOU WILL YOU MOST FREQUENT FLYERS IN TERMS OF PHONE LIST, UH, SERVICE CENTER, NEIGHBORHOOD SERVICES UTILITY CUSTOMER SERVICE OFFICE. WE CAN GET YOU THOSE AND EVEN A BRIEF YEP. CONSTITUENT ASKED THIS FOOLISH PROCESS OF ROLLING OUT THE CUSTOMER SERVICE UNIT. WHAT ARE THE THINGS THAT WAS ROMAN? WORKED IN THE CITY OF FORT WORTH WAS THE ACTION CENTER. AND SO THEY WERE THE ONE STOP CALL CENTER FOR THE CITY OF FORT WORTH FOR HOW MANY YEARS OF YEARS AND SO SHE WAS ALSO PART OF THE TRANSITION TO THE 31 MONTH SYSTEM. AND SO THAT'S GONNA HELP WITH WHERE WE STARTED IN ROLLING OUT THAT WHOLE CUSTOMER SERVICE PROGRAM SAYS THAT'S SOMETHING SHE HAS, ESPECIALLY THAT WILL ALSO BE PART OF HER RESPONSIBILITY. PLEASE. BOTTOM LINE AT THE END OF THE DAY. YOU WANT YOUR CONSTITUENTS HAPPY. WE WANT TO THANK YOU, UH, SO COUNCIL INQUIRIES WITH THE CITY MANAGER, THIS, UH I THINK WE MOSTLY THIS IS A NEW IN ADDITION TO THE DOCUMENT, UM BUT AH, YOU KNOW, EVERYTHING. PART OF THE CHARTER GOES THROUGH THE CITY MANAGER AND SO, UM YOU KNOW, EVEN AGENDA QUESTIONS MAYOR LIKE THIS EVENING QUESTIONS TO THE CITY MANAGER ABOUT AGENDA ITEMS. THE
[00:30:05]
CITY MANAGER WILL OCCASIONALLY DESIGNATED REPRESENTATIVE FROM STAFF TO GIVE A PRESENTATION TO COUNCIL. UH AS IS THE CITY MANAGER'S, RIGHT, UM AND THEN PROBLEM RESOLUTION FOR THE CITY MANAGERS, UM OR THE STAFF'S TIME IS BEING DOMINATED BY ONE COUNCIL MEMBER. WE LAY OUT SOME RULES ON HOW THAT GETS TO A RESOLUTION RATHER THAN YOU KNOW. TRYING TO GO WITH THE NUCLEAR OPTION. WE ADDRESS IT FIRST AND JUST SAY THIS IS WHAT WE THINK. UM I THINK THE MAYOR GETS, UM THERE AND THE MAYOR PRO TIM AT SOME POINT INSTEAD FOR THREE AND FOUR GET INVOLVED IF THERE'S NOT A CONSENSUS BETWEEN THE CITY MANAGER AND THAT COUNCIL MEMBER ON TIME CONSTRAINTS. WE DISCUSSED THIS. WE LOOKED AT BEST PRACTICES SO MANY OF OUR BEST SOUTHWEST CITIES AND OTHER CITIES AS FAR AS THEIR GOVERNANCE DOCUMENTS. AND SO I BELIEVE MUCH OF THIS WAS TAKEN FROM ONE OF OUR OTHER CITIES AS FAR AS HOW THEY WERE OUTLINED AND LAID OUT, SO WE DIDN'T STAFF DIDN'T COME UP WITH THIS. I THINK WE TALKED ABOUT THIS WHEN WE MET, BUT THESE WERE PART OF THE THINGS THAT OUR INTERN WAS PRESENTING. BUT WE BROUGHT THIS C N AS AN EXAMPLE OF THINGS WE CAN DO. FROM THE CITY OF LANCASTER. MR HAGAR LOOKS FAMILIAR TO YOU THINK HE WROTE IT? UH MAYOR AND COUNCIL MEMBER TRAINING AND PROFESSIONAL DEVELOPMENT. THE REALITY IS WHEN YOU RUN FOR COUNCIL A LOT OF TIMES YOU COME FROM DIFFERENT SPHERES OF THE BUSINESS WORLD OR OTHER DIFFERENT TYPES OF GOVERNMENT. SO IT'S VERY IMPORTANT THAT YOUR YOU GET THE KNOWLEDGE THAT YOU NEED TO BE THE INFLUENTIAL BODY AND THE GOVERNING BODY OF THE CITY THAT YOU'VE BEEN ELECTED TO. AND SO WE WANT TO MAKE SURE THAT WE GET YOU THE TRAINING GET YOU THE PROFESSIONAL DEVELOPMENT. I THINK YOU'RE ALL SIGNED UP FOR TML IN THE COMING WEEKS. ALWAYS A WEALTH OF INFORMATION. WE ALWAYS WE CERTAINLY ENCOURAGE YOU TO SPEAK TO ANY VENDORS TEND TO IT'S IN THE WORKSHOPS THERE. LEARN AS MUCH AS YOU CAN. UM AND WILL WE'VE ALSO I THINK WE'RE WORKING RIGHT NOW TO SCHEDULE STAFF RETREAT ARE NOT STAFFORD TREAT COUNCIL RETREAT FOR THE FALL TO GET YOU BUT I THINK WE'RE NOW GOING TO DO I THINK THREE OR FOUR FOLLOW UP, UH, WITH THAT, SO THERE'S A CONSTANT TRAINING STAFF. WE'VE GOT TO GET TRAINED BECAUSE WE NEED TO KNOW OUR JOB. WE NEED TO KNOW THE RULES. WE NEED TO KNOW THE BEST WAY TO DEAL AND PROVIDE THE BEST SERVICE TO YOUR CONSTITUENTS. HIS COUNSEL YOU NEEDED TO. THIS IS A STEP SECTION THAT EXISTED SO WHAT YOU'LL SEE HERE IS ITEMS SEED WAS REVISED AS FROM BEING ITEM BASED. THIS ALREADY EXISTED . WHAT WE DID WAS WE BROKE IT UP INTO DIFFERENT SECTIONS, AND WE MAKE SURE THE LANGUAGE WAS CONSISTENT WITH EVERYTHING THAT WAS HAPPENING ALSO IN THIS BUDGET YEAR. EACH COUNCIL MEMBER HAS A DEDICATED AMOUNT FOR THEIR TRAINING. AND SO IT'S BY YOUR DISTRICT OR YOUR ROLE ON COUNCIL . AND SO THAT'S SOMETHING NEW. BUT THIS IS NOT EVEN THOUGH IT LISTED NEW IT'S ACTUALLY BEEN MOVED FROM ANOTHER SECTION IN HIS SPELLED OUT WITH MORE DETAILS. COMMUNITY EVENTS AND TOWN HALLS. UM WE WANT TO MAKE SURE THAT NOTHING HERE ANOTHER REVISED SECTION BY SECTION, BUT WE WILL MAKE SURE WE GIVE YOU THE OPPORTUNITY TO HAVE YOUR TOWN HALLS AND SPEAK WITH YOUR CONSTITUENTS. WITH STAFF SUPPORT. MEDIA AND SOCIAL MEDIA BELIEVE THIS ONE'S BRAND NEW, UM WAS REVISED FROM BEING ITEMS BE BUT WITH SOME NEWLY ADDED SECTIONS, UM YOU KNOW, ONE OF THE THINGS THAT. I THINK IT'S PROBABLY KNEW, ESPECIALLY THE KEEP. NIGHT ON IT'S JUST THE SOCIAL MEDIA PLATFORM. YOU GUYS ARE IN A WONDERFUL POSITION OF BEING ABOUT CITIZENS. AND PART OF THE GOVERNING BODY AND THEN WHERE THAT CAN GET SOMETIMES A LITTLE HECTIC IS THE SOCIAL MEDIA SPHERE. YOU GOT TO REMEMBER, JUST LIKE STAFF HAS TO REMEMBER. SOCIAL MEDIA.EVERYTHING THAT YOU POST PEOPLE THINK IS AN OFFICIAL STATEMENT OF THE CITY. SAME WITH STAFF POST SOMETHING THAT IS NOT A GOOD REPORT. IF WE POST SOMETHING THAT'S NOT A GOOD REFLECTION ON THE CITY. PEOPLE ARE GOING TO THINK AH, IT'S AN OFFICIAL CITY STATEMENT. EVEN IF IT'S PERSONAL STATEMENT ON OUR BEHALF. SOMETHING TO KEEP IN MIND THERE. UH, BOARDS AND COMMISSIONS. THIS WAS REVISED FROM BEING ITEM G HAS A FEW REVISIONS. UM ADDED SECTIONS, INCLUDING UM. COUNCIL MEMBERS WILL BE ALLOWED TO SELECT THE BOARDS AND COMMISSIONS THEY'D
[00:35:04]
LIKE TO RAISE WITH SENIORITY. NOT REQUIRED BUT ARE ENCOURAGED TO ATTEND THE BOARDS AND COMMISSIONS THAT YOU CHOOSE. UM AND EACH COUNCIL MEMBER OF MASON MIDDLE QUARTERLY REPORT TO THE ENTIRE COUNCIL THROUGH THE CITY SECRETARY ON THE ACTIVITIES OF THEIR RESPECTIVE BOARDS AND COMMISSIONS, AND THIS IS BACK. THIS IS THE NEWLY DEFINED SECTION GO BACK TO THAT. AH YES, I HAD THERE HAD SOME COMMENTS ON THIS PARTICULAR ITEM, WHICH I UNDERSTAND. MR HAGER HAS BEEN INFORMED ABOUT ALREADY. AND THAT WAS THE TEST LANGUAGE WHERE IT SAID AUTOMATIC INVESTMENT IF YOU MISSED THREE MEETINGS AND THAT IS NOT WHAT WE AS A COUNCIL HAD AGREED UPON. WE HAD AGREED DONE BE SOMETHING THAT GOES ON BETWEEN THE COUNCIL MEMBER THAT OR YOU IN THE STAFF MEMBER BEFORE THERE IS DIVESTMENT OF THAT POSITION ON THE BORDER COMMISSION. THERE'S SOME COMMUNICATION LANGUAGE IS WRITTEN RIGHT NOW IS TOO STRICT . WE WANTED TO MODIFIED THE COUNCIL. TO BE A LITTLE MORE LENIENT TALK WITH THE PERSON BEFORE THEY LOSE THEIR SEATS ON THE BORDER CONDITION AND I ASKED THAT THAT LANGUAGE WE CHANGED. THE ABSENCES CAUSED DEGREE. THAT LIAISON WILL DISCUSS THE ACTRESS'S CARS AND MAKE A RECOMMENDATION ACCOUNTABLE INVESTMENT IF NECESSARY. AND FURTHER THE ABSENCES CAUSES NOT INCLUDING EVERY WORD COMMISSION.SECTION SO I UNDERSTAND, MR HAGAR THAT HAS BEEN CHANGED, PERMISSIVE AFTER THREE OF THEM WITH WITH THIS AND THAT ORDINANCE THAT WOULD GET IT TO YOU. YOU MAY OR MAY NOT EXCUSE OR CONTINUE THE FIRST TIME THE BOARD MADE IT CLEAR GREAT AND THE OTHER ONES THAT SOME OF THE BOARDS AND COMMISSIONS SECTIONS AND THE NORTHERN CLITORAL. ROBERT'S RULES OF ORDERS WITH SOME DID SOME. DIDN'T I ASKED IT IF IT'S GOING TO BE CONSISTENT WITH CONSISTENT ALL THE WAY THROUGH. THAT CHANGE HAS BEEN MADE. AND ALSO THAT INTERESTING. I GOT AN EDUCATION. I WOULD STAND UP AND CONFESS. I GOT AN EDUCATION THAT I SENT AN EMAIL SAYING THERE'S A TYPO MULTICULTURAL COMMISSION. DIFFERENT PRESENTATION. OKAY I'M SORRY IT'S UNDER THERE, BUT THAT'S THAT'S ENOUGH IMPORTANT COMMISSIONS. THAT'S NOT THAT PRESENTATION. INDIVIDUAL CONSIDERATION. NEVER MIND. ALRIGHT BRING IT UP THERE. IT UP NOW THAT I'M CONFESSING INVARIANCE, YOU KNOW, I THOUGHT I CAUGHT A TYPO WHERE THERE WAS A T N X LIBERAL LIKE IT WAS A TYPO HERE, SO I SENT THAT IN AND THE ANSWER WAS NO, IT IS NOT A TYPE OF IT IS NEW. NORMAN CLAIMS TO BE GENDER NEUTRAL. THERE'S NOT LATINA LATINO 19 X. I GUESS IT'S THE MANNER IN WHICH WE PRONOUNCE THAT SO WHEN YOU SEE THAT TO ME, IT WAS SAID THERE WAS AN EDUCATION FOR ME, AND I APPRECIATE STAFF BEING OF A COMPANY'S KINDS OF THINGS, TOO. EDUCATE ME ON THOSE KINDS OF THINGS. PART OF THE TRAINING. ALRIGHT COME BACK TO THAT PARK. THIS IS IMPORTANT. MAKE SURE COUNCIL THIS WAS ONE WHERE WE TALKED ABOUT. THAT COUNCIL MEMBER WITH THE EXCEPTION OF THE MAYOR MAY SERVE AS ONLY A SIGN THAT SOMETHING NEW THAT WE TALKED ABOUT IN THE MEETING OF HAVING YOU ALL SELECT A MEMBER THAT SERVES AS THE LIAISON TO THE BOARD BEYOND THE STAFF PERSON, AND SO THAT'S SOMETHING THAT JUST KIND OF WE DIDN'T HEAR . WE TALKED ABOUT IT TALKED ABOUT THE ADVANTAGE OF MY STANDPOINT OF HAVING SOMEONE WHO'S ALSO WORKED WITH CREATING A BETTER RELATIONSHIP, BUT I WANT TO MAKE SURE YOU SAW THAT THAT WAS INCLUDED IN THE COUNT.
THE RULES LEADING. SO THIS 2ND 1ST SECTION IS THE MEETING STRUCTURE. SOME REVISIONS, NEWLY ADDED SECTIONS. BUT FOR THE MOST PART COVERS. REGULAR MEETINGS. OBVIOUSLY WE MAKE SURE THAT WE'RE MIND TAXES, SUPPLEMENTINGE CALL. AT THE REQUEST. I BELIEVE THAT THE MAYOR OR THE CITY MANAGER COUNCIL MEMBERS TO MORE COUNSELING. UM, LOOKS. BUT THAT'S ONE WHERE I HAVE OBJECTION BECAUSE MARRIAGE DOES DOES RUN THE MEETINGS, BUT THERE IS NO DIFFERENT. STATUE OF NATO, THE COUNCIL MEMBERS I DON'T THINK IT SHOULD BE TO COUNSEL. THERE SHOULD BE ONE COUNCIL. NOT A PROBLEM. UH HUH. AND THEN WITH THE GOVERNANCE OF THE MEETINGS AND THE SWEARING IN OF NEWLY ELECTED COUNCIL MEMBERS HAVE RUN OFFS. UH COUNCIL HOLD GOVERNANCE MEETING TOO. DISCUSS THIS AND.
[00:40:01]
THE PROCEDURE AND HOW THE MEETINGS WILL BE WRONG. APPOINT THE MAYOR PRO TEM. AND MAKE APPOINTMENTS TO THE AUDIT COMMITTEE FOR ONE YEAR TERM. SO THIS PART HERE SECOND PART OF THE MEETING STRUCTURE COVERS AGENDA RULES. UM. NOT A LOT OF CHANGE IN TERMS OF THE GENERALS WILL MAKE SURE THAT WE GET I'M REALLY NOT DOING. OH BUT AGENDA ITEMS SHOULD BE PRESENTED TO THE CITY SECRETARY TO THURSDAY'S PART COUNCIL MEETING TOO. ANY KIND OF LAST MINUTE THINGS PUT ON THERE THAT DOESN'T GIVE YOU AND GIVE THEM PUBLIC TIME, TOO. REVIEW THEM. WE WANT THEM POSTED IN FINAL FORM BATH BY THURSDAY PRIOR TO THE MEETING, AND IF NOT THE CITY MANAGER'S REQUIRED NOTIFIED COUNCIL IMMEDIATELY ALIVE IN GENESIS. HOW IS THE ID? UM AND THEN BRIEFING SESSIONS ALSO. COVER COUNCIL NEIGHBOR REQUESTED AN ITEM ON THE LIST FOR INDIVIDUAL CONSIDERATIONS.CONSIDER ETCETERA THAT HAS TO BE EXERCISED. BUT WE AS A COUNSELOR, THIS PARTICULAR ITEM F IS CONSENSUS. YES, WE CANNOT TAKE OVER AND VOTE IN A BRIEFING SESSION AND WE GET VERY STRICT COUNCIL FORMER CITY ATTORNEY ON THIS SO WE HAVE DONE THIS ALREADY. WE HAVE HAD CITY COUNCIL MEMBERS REQUEST ITEMS FROM THE EXCEPT THE ITEMS TO CONSIDER INDIVIDUAL CONSIDERATION. AND WHAT WHOEVER IS SITTING IN THIS PARTICULAR CHAIR HAS TO REQUEST CONSENSUS, AND THAT CAN BE BY HOW DO YOU THINK YOU KNOW IF THEIR STUDENT BODY LANGUAGE A HEADS UP, THUMBS UP, WHATEVER THAT'S GOING TO BE HOW WE'RE GONNA DO IT, BUT WE CANNOT TAKE WE AS A COUNCIL, DON'T IT? CAN ADMINISTER OF VOTE DRINKING BRIEFING SESSION. SO I'M JUST BEING VERY CAREFUL ABOUT THIS LANGUAGE IS VERY CLEAR AND VERY PRECISE. BUT THERE HAS TO BE CONSENSUS. WE CAN'T THINK OF BOAT DURING ACCOUNT DURING BRIEFING SESSION. OKAY? SCHEDULE AND DURATION OF THE MEETINGS. ARE. INITIAL PLAN OF 30 MINUTE MEETING GOT SHUT DOWN. NO BUT WE DO WANNA WE WANT THEM MAXIMIZE THE EFFICIENCY. WE DO WANT TO MAKE SURE THAT THE RULES IN PLACE TO KEEP THE MEETINGS GOING AND THEN UM THIS. RIGHT HERE, TALKS ABOUT IF IT FALLS ON ELECTION, UH, INSTEAD OF THE NEXT HOLDING IT ON THE DAY OF THE ELECTION. SHALL WE HELP THE NEXT TUESDAY NIGHT FOLLOWING THAT ELECTION? UM SAME THING FOR HOLIDAY PERIOD. UM WE DID. THERE IS NO MEETING SHALL EXTEND AFTER THE HOUR. 12 MIDNIGHT UNLESS THE COUNCIL BY AN AFFIRMATIVE VOTE OF THE MAJORITY OF PRESIDENT COUNCIL MEMBERS EXTENDS THE LENGTH OF THE MEETING. SOMETIMES THINGS HAVE TO GET DONE. BUT COUNCIL MEMBERS OF MOVING TO EXTEND THE LENGTH OF THE MEETING SHALL INCLUDE THEM EMOTIONAL MATTERS, APPEARING ON THE DOCKET FOR THAT MEETING TO BE CONSIDERED AFTER THE HOUR, 12. COMING UP. ONE MORE COMMENT REGARDING THAT. IS THAT REALLY THE COUNCIL IS THE ONE THAT DETERMINES OUR SCHEDULE. YEAH THIS IS THE BABY. ON ELECTION NIGHT. LIKE CHOOSING NOT TO, BUT YOU'RE NOT SPECIFICALLY HAVE TO GO WITH THE NEXT WE CAN DETERMINE WHAT POINT THAT'S TRUE PLANNING ON TEXT ONE. YEAH. AND WE CAN CHANGE THAT. BECAUSE IT DOES SAY SHALL BE HELD THERE SO MAY AT THE DISCRETION OF THE COUNCIL. CONDUCT. ALSO HAS, UH, CHANGES, BUT, UH BASICALLY IS. YOUR AGREEMENT WITH EACH OTHER ON HOW YOU CONDUCT YOURSELVES DURING THE MEETING. LISTEN AND UNDERSTAND WHAT FOR, BUT JUDGING FOCUS ON THE VISION AND GOALS FOR AREAS OF AGREEMENT. BE ON TIME START ON TIME. SUPPORT. SERVING DECISION WAS MADE.
GREATER DISAGREE. DON'T PAIR PRAISE IN PUBLIC PROVIDE CONSTRUCTIVE FEEDBACK, PRIVATE JUST FINE DISCUSSIONS, COURTEOUS, HONEST AND TREAT OTHERS WITH RESPECT.
COMMUNICATING OPEN DIRECT MANNER. DO YOU HAVE A PERSONAL ISSUE WITH NUMBER COUNCIL? GO TO THAT MEMBER DIRECTLY POSITIVE AMBASSADOR FOR THE CITY. USUALLY ELECTRONIC SYSTEMS AND NOTIFIED THE MAYOR WHEN YOU MR COMMENT, OBVIOUSLY IN THE BRIEFING ROOM THAT CHANGES A LITTLE BIT, ALLOW
[00:45:02]
OTHERS TO FINISH. THEIR COMMENTS WERE SPEAKING. OKAY? AND THEN WE CONTINUE TO BECAUSE IT'S GOT TO BE KIND OF A LONG SECTION. UM BUT WE ASKED. WE ALSO WANT OUR CITIZENS TO BUY BY THE CODE OF CONDUCT. AND, UH THEN. VIA SANCTION OF THIS IS THE MEDIA IN TERMS OF HOW THE MEDIA IS EXPECTED. ARE ROLLING, GETTING PAINS TO THE MEDIA SO THAT WE CAN MAKE SURE THAT OUR CITIZENS HAVE ACCESS THAT THEY NEED TO OUR MEETINGS. THIS IS THE ORDER OF BUSINESS. NO, HE LAID OUT BY THE AGENDA. THE RULES OF PROCEDURE. AH! SO RESIDING OFFICER SHALL BE RESPONSIBLE FOR MAINTAINING THE PROCEDURE. THREE COMMENTS FROM PUBLIC. CITIZENS PUBLIC TALENT PUBLIC HEARINGS.REPORTS TO COUNCIL THERE IS A THINKING HERE. THREE MINUTES. LIMITATION ON ANY REPORT.
MEETING MINUTES. CHARTER NOT SHALL BE MAINTAINED. MOST TIMELY MANNER. RESOLUTIONS AND ORDINANCES. HOW MUCH CHANGE THERE? REGULATIONS. UM. BY BY THE CODE OF ETHICS. I WANT TO ADD THAT COMMAND STAFF FOR CONSIDERING ADDING THE CODE OF ETHICS IN PRESENT TIME IS SEPARATE. UM INCORPORATING ATTENDED TO THE RULES AND PROCEDURES MAKES IT MORE CONCEPT DOCUMENT EASILY REFERENCE IN CASE THERE IS A PROBLEM WITH SOMEBODY WHO THINKS ISSUES SO HAVING THAT NOW BEING SEPARATE HAVING TO REFER TO THAT IS NOW INCORPORATED INTO THE PROCEDURE.
AND THEN THE CENTRAL POLICY. UH BUT, UM. JUST NOTED AT THE TOP AFTER A PERSONAL CONVERSATION BETWEEN AT LEAST ONE COUNCIL MEMBER HUGHES. COUNCIL MEMBERS TAKING PLACE AND THAT IS PROVEN UNSUCCESSFUL. THIS GOES THROUGH THE POLICY OF. HOW TO GO ABOUT CENTERING THE MEMBER OF THE COUNCIL. UM AND YOU'VE BEEN FILED WITH THE CITY SECRETARY NEED TO BE UM, STEPPED FORTH THE ALLEGATIONS UNDER THE CITY CHARTER THINGS AND THE RULES OF PROCEDURE. AND THEN ON THE FIRST REGULARLY SCHEDULED MEETING AFTER THE FIRE WAY, UM FORMALLY PRESENT THE NOTICE. ACCUSED COUNSEL NUMBER HAS THE RIGHT TO BE REPRESENTED BY LEGAL COUNSEL OF THEIR CHOOSING. UM AND THEN COUNCILORS VOTED TO FIND GOOD CALLS PUBLIC HEARING ON THE ALLEGATIONS IN RESPONSE TO THE SHOW HELD UH, AND THAT'S EITHER AT A REGULAR SPECIAL CALLED MEETING. UM DIFFERENT DAYS AT THE FINAL HEARING. CITY COUNCIL WILL HEAR EVIDENCE CONCERNED CENTER AND MAKE A DECISION. ON THE GRIEVE IT. THEN REMOVAL FROM OFFICE. IT'S ALWAYS THE FINAL ONE. THERE IS ALSO REMOVABLE OTHER APPOINTMENTS, OFFICIALS. MOVE OF THE APPOINTED BOARDS. COMMISSIONS WITHOUT NOTICE EXCEPT OTHERWISE PROVIDED BY ST PAUL. THERE'S ONE MORE HOLD ON REFERENCE THAT WE JUST WORKED IN HERE BECAUSE YOU MADE MENTION THIS, BUT THIS WAS JUST MAKING SURE THAT YOU HAVE ONE CONCRETE DOCUMENT THAT HAD ALL OF THE THINGS THAT APPLY TO COUNCIL AND THEIR INTERACTIONS. ANY OTHER QUESTIONS DAVID YOU'VE MADE WHICH MAY WANT TO DO IS PUT IN THE APPENDIX TO COPY THOSE OTHER CHARTER ORDINANCE AND ATTACHED TO THEM, SO YOU'VE GOT IT. IN ONE. MAKE IT. OUR CHILDREN YEAH.
OKAY THANK YOU. ANY QUESTIONS, COMMENTS? I THINK IF THERE ARE ANY FURTHER QUESTIONS, PLEASE EMAIL THEM TO THE CITY MANAGER, MR KEYES, OTHERWISE COMING DOCUMENT WILL GO FINAL. ONE MORE TIME. I GUESS SYMPATHIES. COUPLE OF MODIFICATIONS HAVE BEEN MENTIONED TODAY WILL COME OUT ONE MORE TIME EMAIL AND THAT'S FOR YOU TO GIVE YOUR THUMBS UP ON THAT WITHOUT ANY FURTHER
[00:50:02]
COMMENT, AND THAT WILL GO FINE. HMM. OKAY WE ARE RUNNING LIKE SEVEN MINUTES TO GO. AND I DON'T MEAN TO BEAT DISCUSSION ON THE LAB PROPERTY REQUESTED BY MR COMES, MR COMES SEVEN MINUTES HAVE WANT TO RUSH YOU WANT YOU WANT TO DO IT ANOTHER TIME, OKAY? UH, SO. WE ALL KNOW ABOUT THE LAST PROPERTY. DONATED CITY 19. 98. CULTURAL EDUCATIONAL, ARTISTIC PURPOSES AND SPECIFIES THAT THERE'S SOME EXAMPLES THAT ARE GIVEN TO BE AND WHAT COULD BE USED FOR YES. IT NEARLY QUARTER OF A CENTURY. UH, NOTHING HAS BEEN DONE. AS FAR AS USE OF THE PROPERTY. PENDANT.COURSE WE HAD. ECONOMIC DEVELOPMENT COUPLE OF MONTHS AGO, JUST SHOWING SOMETHING DIFFERENT. IDEAS. STAMPS AND FOR WHATEVER REASON. ALL THOSE FAILED. OVER A YEAR AGO, I STARTED HAVING BRIEFINGS AND DISCUSSIONS ON ANOTHER PROPOSAL USED, WHICH WAS AS A NATURE PRESERVED. AND SO WE BEGAN THOSE DISCUSSIONS. AND TOWARD THE END OF LAST YEAR. SINCE WE'RE TOGETHER PETITIONS SUPPORT OF A NATURE PRESERVE. LOT OF VOLUNTEER EFFORTS HAVE BEEN ON THE PROPERTY. AND. JUST HERE RECENTLY, MR. BOB LADD HIMSELF HAD A MEETING WITH MYSELF. CITY MANAGER. MAYOR AND CITY MANAGER. JUST TO GIVE US HIS THOUGHTS. ON THE CURRENT PROPOSED USE. AND WE ALL HAVE A COPY OF THAT PROPOSED USE AS A NATURE PRESERVE. AND SO I JUST WANTED TO ALLOW FOR THE COUNCIL TO HAPPEN. JUST AN OPEN DISCUSSION. IN RESPONSE TO BY THE DOCUMENT AND ALSO TALK ABOUT MR LADS, RESPONSE TO BOTH JEWS. MR CONTRAST JUST QUICKLY, UM I WANT TO SAY THAT WHEN WE RECEIVED THIS WELL BACK UM, I WAS JUST BLOWN AWAY BY HOW PROFESSIONALLY PUT TOGETHER IT DEMONSTRATES THE POTENTIAL TO MEET THOSE THAT HAVE WORKED SO HARD ON THIS LAND PROPERTY ISSUE. ALONG WITH INCLUDING SOME OF THE WISHES OF THE LAB FILM. AND. I JUST CAN'T SAY ENOUGH ABOUT HOW MUCH THIS MEANS HELPING US. MOVE FORWARD IN THE CONVERSATION, AND I DON'T SAY THAT I TOLD YOU WE'RE KICKING THE CAN DOWN THE ROAD. THIS REALLY IMPORTANT PIECE, THE FIRST THE FIRST PUBLICATION Y'ALL DID WAS WAS GREAT. THIS. THIS WAS TIMELY, VERY WELL DONE.
THANK YOU. AND OF COURSE, AS WE CAN SEE, A LOT OF WORK WENT INTO THAT COURSE WE APPOINTED THAT LIKE COMMITTEE A COUPLE OF MONTHS AND THEY'VE BEEN DOING THIS UNBELIEVABLE AMOUNT OF WORK. UNBELIEVABLE. MY RESEARCH. OKAY, PUT INTO IT AND ATTEMPTING TO RESPOND TO IT. CONCERNS THAT WE'VE ALL HAD IN REGARDS TO FUNDING GUARDS WOULD BE USED. AND EVEN HERE LATELY PROPOSED AN ORDINANCE. AND SO, UM AS FAR AS THE MEETING WITH MR LACK. SO THERE WAS A COUPLE OF TAKEAWAYS.
OF COURSE THE MAYOR WAS THERE AS WELL. AND SAY, MANAGER SO. I MEAN, THESE ARE MY KEY TAKEAWAYS AND THE MAYOR AND CITY MANAGER MAY HAVE OTHERS, BUT HE DID CLARIFY THAT HE DID NOT INTEND FOR ANY USE OF THE PROPERTY OF THE PROPHET S SPECIFY THAT CLARIFY THAT HE SAID THAT HE HAD BEEN OPPOSED TO EVERY PROPOSED USE THUS FAR. FROM SEEING EXAMPLES OF WHAT'S BEEN PROPOSED. YOU SAID THAT HE WAS OPPOSED TO THE PROPERTY CONTINUING IN ITS CURRENT STATE, SO IT WAS VERY CLEAR ABOUT THE FACT THAT HE DOES NOT WANT THE PROBLEM TO STAY AS IT IS. I HAVE NOTHING DONE WITH IT. AND JUST BASICALLY JUST A CABLE OF THE WAY IT IS. HE SAID HE WOULD BE OPPOSED TO THAT. HE STATED THAT THIS PARTICULAR PLAN THAT WE HAVE, HE SAID, THAT'S THE FIRST PLAN THAT HE'S SEEN THE FIRST VISION FOR HIS IDEA. THAT HE DOES SUPPORT. AND THAT HE WOULD BACK AND HE ASKED. HOW THE PROJECT WILL BE FUNDED. THE MAYOR OFFERS SOME POSSIBLE FUNDING. OPPORTUNITIES OPTIONS, BUT THAT'S SOMETHING THAT THE COMMITTEE IS WORKING VERY HARD ON AS FAR AS FUNDING. UM SIERRA CLUB IS OFFERED. YES, SUPPORT. LOOK AT TEXAS PARKS AND WILDLIFE , NATIONAL PARKS AND WILDLIFE. TEXAS TEXAS WATER ACTION COLLABORATIVE, AND SO THEY DEAL
[00:55:03]
WITH THE TRINITY WATER. TRENDY HASTEN THE OFFER. LOTS OF GRANTS. WE STARTED TO AND CONSERVATION FUND. AND SO THAT'S SOMETHING THAT CAN BUILD OVER TIME. AND ALSO, WE NOW HAVE A DUNCANVILLE NATURE CONSERVANCY. THEY'RE THEY'RE DEDICATED TO DOING THE WORK. FINAL FUNDS AND WITHIN THE PROPOSED PROPOSAL DOCUMENTS THEY SPECIFY A PHASE PLAN. BYE. WEEKENDS BEGAN WITH LOW HANGING FRUIT. AND TAKE CARE OF THINGS AND COST LITTLE TO NOTHING. AND THEN OVER TIME WE CAN WORK ON BIGGER BUDGET ISLANDS. BIGGER DOLLAR ITEMS BUT AGAIN THE MAIN POINT HAS BEEN MADE IS THAT A LOT OF THE PUBLIC PRIVATE FUNDING THAT WE CAN RECEIVE CAN'T RECEIVE. SO WE HAVE NATURE PRISONERS, AND SO THAT'S KIND OF BEEN THE MAIN POINT SO FAR, AND SO AGAIN, WE DO HAVE AN ORDINANCE PROPOSED ORDINANCE THAT THEY'VE GIVEN US THAT WOULD ALLOW US TO OFFICIALLY HAVE A NATURE PRESERVE AND ALLOWED THEM TO PURSUE FUNDING PROJECTS. ONE THING THAT I WOULD I WOULD ADD MR CLINTON TAKE AWAY THAT MR LEAD DID I DIDN'T ASK HE. STATED THE CITY SHOULD ENGAGE 2 TO 3 PROFESSIONAL LANDSCAPE ARCHITECT. TO LOOK AT THE DESIGN AND THE LOOK AT THE PROPOSAL THAT'S BEEN SUBMITTED AND TO LOOK AT THE ENTIRE PROPERTY IN TERMS OF HOW IT COULD BE TURNED INTO A TRUE NATURE CONSERVANCY, WHICH WOULD INCLUDE STRUCTURES AS PROPOSED EVEN HEARING IN PHASE FIVE OF WHAT WE HAVE HERE AND HE SAID, UH CAN WE TALK ABOUT THE SEVEN ACRES MIGHT AS WELL I MEAN, YOU ASKED THE QUESTION, YOU GIVE A PRETTY STRAIGHT ANSWER TO IT. OTHER 7.2 ACRES AND STILL BELONG TO THE LAST FAMILY. AND MR COONS ASKED IF MR LAD WOULD CONSIDER DONATING THOSE THOSE 7.2 ACRES TO THE CITY. AND HE SAID ONLY ALL RIGHT. THEY FUNDING AND ENGAGEMENT, PROFESSIONAL LANDSCAPE ARCHITECT THAT HAS A PLAN THAT THE CITY HAS APPROVED. THAT MEANS THAT THE FUNDING OF IT AT THAT PARTICULAR POINT IN TIME, YOU WOULD CONSIDER A DONATION OF SEVEN POINT YOU KNOW WHO COULD ARGUE WITH THAT? HE'S BASICALLY SAYING FINISH THIS WHOLE THING OUT. LET ME SEE WHAT YOU GOT. AND I EVEN ASKED SHE WOULD. BUT THE LANDSCAPE PROFESSIONAL LANDSCAPE ARCHITECT MUST DO WHEN THEY DESIGNED THIS ENTIRE CONSERVANCY. LOOK AT THIS INCLUDE THE 7.2 ACRES, BECAUSE IF YOU IF WE CHOP IT OUT, THEN IT'S NOT GOING TO BE A COMPLETE PLAN THAT MR LACK SO THAT'S WHAT HE SAID. WHEN IT'S DESIGNED AND FUNDED. THEN THE CITY MAY COME TO HIM FOR CONSIDERING THE DONATION OF THOSE 7.2 ACRES. AND THE MONEY'S YOU KNOW, IT'S MR KOONTZ IS CORRECTLY. STATED THAT THE HOW WE HOW WE HAVE THIS PARTICULAR DESIGN IS GOING TO BE FUNDED IS SOMETHING THAT IS OF CONCERN. AND I TOLD I STATED IN THE MEETING WITH MR LAD THAT WE HAVE JUST COMPLETED OUR BUDGET FOR 22 23. THERE'S NO LIGHT ITEMS THAT BUDGET ENGAGING PROFESSIONAL LANDSCAPE ARCHITECT BUT THE MATTER IN WHICH WE WOULD GO ABOUT THIS FOR THE FUTURE MAY TAKE US A LITTLE TIME. IT COULD BE 22 23. IT COULD BE 23 24, BUT DOING THAT PROFESSIONALLY AND COMING UP WITH THE ENGAGEMENT OF PROFESSIONAL LANDSCAPE ARCHITECT, WHICH COULD BE A MULTIPLE SOURCE SOLICITATION ON THE PART OF OUR PROCUREMENT OFFICE. BUT THEN IT COMES TO THE EXAMINATION BY THE COMMISSION. AND COME TO COUNCIL AS WELL. SO REALLY, IT WAS A VERY STRONG AND VERY, VERY PRODUCTIVE MEETING. AND I APPRECIATE MR COONS, PUTTING IT TOGETHER AND HAVING MR LAND EXPRESSES OPINIONS. HE ALSO ASKED US FOR THREE DESIGNS , SO I THINK. THREE PROFESSIONAL LANDSCAPE ARTIST DESIGNS FOR THE PROPERTY FINALS. TO BE EVEN CONSIDERED. WHAT THOSE PEOPLE COST. I DON'T HAVE A CLUE. SO MAYBE THERE'S MAYBE THERE'S BY THE WAY, HOW WE CAN GET SOME MONEY TO HELP FUND THOSE ENGAGEMENTS. WE'LL HAVE TO SEE SO COULD BE ANOTHER DISCUSSION. BUT I KNOW THAT THE MEDIA IS ALSO ALREADY IDENTIFIED. TWO POTENTIAL CONSULTANTS ARE LOOKING VERY GOOD. AND ONE OF WHICH WE'VE ALREADY CITIES ALREADY WORKED BY THE WAY. REPRESENTATIVES WANT TO LIKE. I DO LIKE THIS DOCUMENT AS WELL.AND I APPRECIATE MR JONES, SENDING IT TO US. THAT'S WELL, BUT THE ONE COMMENT I WANT TO MAKE ABOUT THE MEETINGS BECAUSE I WOULDN'T FULLY AWARE THAT I WAS GOING TO HAPPEN ABOUT THAT.
BUT I WOULD ALSO SAY 20 TALK ABOUT FOUR. THIS PROPERTY IS IN DISTRICT ONE. DISTRICT ONE COUNCIL MEMBER REALLY SHOULD BE A PART OF THE DISCUSSION. ANY MEETINGS, ALONG WITH. THE SAME THING. I THINK IT REACHES 12 AND FOUR AND NEITHER ONE OF US WERE IN THERE SO MAYBE IN THE FUTURE.
WE CAN WORK ALL THAT. ASIDE FROM THAT. WHEN THIS WHOLE THING STARTED OVER A YEAR AGO, I
[01:00:07]
HAVEN'T BEEN CONTACTED MORE TIME ABOUT ANY OF IT OTHER THAN ROTATION, WHICH WENT AROUND MY HOUSE CAME TO MY HOUSE AND IN MY MOVING FORWARD THE WHOLE THING SO I BELIEVE IN THIS 100. I'D LIKE TO KNOW A LITTLE BIT ABOUT IT. HOW CAN I HELP? THIS IS MY QUESTION. AND SO ACKNOWLEDGED AND NOTED, MR CONTRERAS REAL QUICK BECAUSE I KNOW WE'RE RUNNING OVER AND IT'S NOT GETTING AN ANSWER RIGHT NOW FROM MR EDGAR. BUT I RECALL AFTER THE FIRST PRESENTATION, NOT THIS ONE, BUT FIRST ONE THAT THERE WAS SOME CONCERNS VOICED ABOUT CREATING THE CONSERVATION EASEMENT. AND THAT THERE WAS SOME CHALLENGES AND I DON'T REMEMBER IF THEY WERE COST LEGALITIES. FOR EXACTLY WHAT THEY WERE, BUT THEY SEEM TO BE A STICKING POINT. UM THAT'S MY RECOLLECTION, SO I WOULD LIKE TO FURTHER THAT CONVERSATION WITH THE ATTORNEY AND SOME OF THE POINTS TO MAKE SURE THAT THAT'S THAT'S A HURDLE THAT WE'RE READY TO DO IT. ITSELF. AND TWICE IN THE CONSERVANCY. RESTRICTS THE PROPERTY WHAT YOU CAN DO UNTIL YOU DECIDE WHAT THE PLANS KIND OF YOU WOULD NOT WANT TO CONSERVE SO YOU KNEW WHAT YOU WERE CONCERNED. I'M SORRY THINGS FIRST OF ALL. COMMITTEES ALSO IDENTIFIED POTENTIAL LAND TRUST FOR FOUR CONSERVATIONS. DETAILS ON THAT. BUT SOMEONE'S ALREADY I THINK FIVE AND SECONDLY BUT WE ALL RECEIVED PROPOSED ORDINANCE TWO WEEKS AGO. AS FAR AS DESIGNATED PROPERTY NATURE PRESERVE, SO WE HAVEN'T OFFICIALLY DESIGNATED THE NATURE PRESERVE YET. THAT ORDINANCE WOULD ALLOW US TO DO SOMETHING.SO IT'S BEEN A LOT OF WORK PUT INTO THIS. LOT OF WORKING CITIZENS COMMITTEE HAS PUT INTO IT. IT SEEMS LIKE THERE'S GENERAL SUPPORT FOR THIS PARTICULAR VISION. AND SO NO, I THINK WE'RE AT A POINT WHERE FIRST PHASE IDENTIFIES. ESTABLISHING A NATURE PRESERVE NORTH. AND I THINK THAT'S WHERE WE NEEDED FOR PRETTY MUCH THE POINT. WE NEED TO DECIDE WHAT TO DO THIS OR NOT FOR AS DESIGNATED DESIGNATED NATURE PRESERVE. EXCUSE ME FOR INTERRUPTING THERE, BUT I HAVE THIS INTERJECT. THAT BELIEF WAS THAT YOU COULDN'T DECLARED A NATURE PRESERVE WITHOUT IT WITHOUT THE CONSERVATIONIST. ALRIGHT, OKAY. I'M SORRY. PROBABLY BELONGS TO THE CITY. DECLARED A NATURE PRESERVE. AND THEN AFTERWARDS GO AND MAKE SURE WE GO BACK AND DO THE DETAILS ON THE CONSERVATION. GO AHEAD AND CITY MANAGER WHAT I REMEMBER DISCUSSION AND I'LL ASK HER ATTORNEY TO CLARIFY ME, BASED ON WHAT OUR CONTRACT STATES THAT I THINK WE'VE GOT TO COME UP WITH A PLAN THAT FIND AND THERE WAS THAT'S APPROVED THAT IDENTIFIES IT AS AN AGE PRESERVED. WE'VE GOTTA COME UP WITH. YOU GOTTA COME UP WITH DESIGNS. MR LAD BLESSES THAT AND SAYS YES. PICKED THIS AND NOW YOU CAN MAKE THIS THAT AND THEN IT BECOMES A NATURE PRESERVE, BASED ON WHICH WE SELECT. HE KNOWS THAT HE CAN POSSIBLY TELL A LITTLE BIT MORE BECAUSE MY UNDERSTANDING IS IT WAS UP TO HIM. EVEN THOUGH WE OWN THE LAND. HE HAS THE RIGHT OF WHAT WE CAN DO ON THE LAND AND NOT DO SO CONSERVATIVE WHEN IT DOES RESTRICTOR PROP DO YOU UNDERSTAND THAT TO ME IS PROTECTING NATURAL ASSETS. YOU KNOW, LIKE A SNAIL DARTERS LIVED THERE. OR WHATEVER FUN AND FLOUR. BOTANICALS OR THERE, YOU'RE SAVING BY PUTTING THE CONSERVANCY ON THERE. YOU'RE ENSURING PROTECTION. SWEET. THE ORDINANCE COMES FIRST. MR KRANTZ SAID CONSERVATIVE. LOT OF TIMES YOU SEE THE CONSERVANCY USED IN PRIVATE DEVELOPER WILL CONSERVE WETLANDS. ILLEGALS OR SOMETHING NESTING THERE. THEY'LL PUT THAT CONSERVATIVE SO THAT NO DEVELOPMENT OCCURS. THEY'RE IN DANGER. WHATEVER ITSELF SO THAT THAT'S THE PURPOSE OF IT. I THINK I WAS ASKING A DIFFERENT QUESTION. MY QUESTION WAS, DO WE HAVE TO HAVE THE PLAN APPROVED BY MR LAD APPROVING THE PRESERVED AND THAT'S WHAT HAPPENED IN THE LAST MEETING. SO HE IMPROVED THIS PARTICULAR? YES TO US. WE HAVE TO HAVE SOMETHING. YOU WANT HIS LAND.
GIVE US WE HAVE TO. IT'S NOT IMPLANTS. YEAH CONTINUES FOR CERTAIN. NO I MEAN, DID HE NOT HAVE DID HE NOT HAVE CONDITIONS ON THE LAND RIVER? YEAH AND IT'S BASED ON HIS APPROVAL SONG. IT'S JUST AN AGREEMENT. HE JUST NEEDS TO SIGN UP. YOU CAN GIVE US A VERBAL MEANS NOTHING I CAN TELL
[01:05:03]
YOU, YOU CAN DO WHATEVER. BUT IF HE HAS IN THIS, SO ALL WE NEED IS SOMETHING WITH OUR ATTORNEY TOGETHER, SAYING THAT HE'S COMMITTED TO THIS CONCEPT THAT HAVE TO BE THE DESIGN, RIGHT. WE WANT HIM TO DO IS JEREMY'S 0.9 UNDERSTAND WHAT YOU'RE ASKING. YOU'RE ASKING. HE'S GOTTA RELEASE THE REVERTED. YOU DON'T WANT TO SPEND ALL THIS MONEY AND THEN UM AND YOU GOT NOTHING TO DO WHATEVER HE WANTS. SO IN EXCHANGE FOR DOING ALL THESE THINGS THAT YOU WANT TO DO, YOU SHOULD GET A RELEASE IN THIS GOVERNMENT. SO HIS OTHER DONATION IF YOUR PLAN PLEASES HIM. THAT'S AN IMPORTANT. MY ABSORBING AND UNDERSTANDING THAT. SECONDLY, I WOULD SUGGEST YES, MR COUNTRIES. MAGIC WE'VE HAD THIS ORDINANCE HAS BEEN DRAFTED CRAFTED HAS BEEN OUR POSITION. I PERSONALLY WOULD NEED TO REREAD THAT IN LIFE OF WHAT WE HAVE NOT RECEIVED FROM THE COMMISSION. AND SEE IF THAT ORDINANCE IS STILL WRITTEN EXACTLY AS WELL AS A CITY WOULD LIKE TO HAVE IT DONE. WITH ALL OF THE IMPLICATIONS AND ALL THE AFRICAN ACTIONS NECESSARY FOR THAT. SO MY SUGGESTION TO ALL THE COUNCIL MEMBERS IS TO PULL THAT. ORDINANCE BACK UP, TAKE A REREAD OF IT. LET'S GET DIGESTED , REALLY UNDERSTAND IT LINE BY LINE WITH THE RULES OF PROCEDURE HERE, AND IF YOU HAVE ANY MORE QUESTIONS, I THINK BRING THOSE TWO COUNCIL AND HAVE THOSE THINGS BRIEF, ESPECIALLY BY CITY ATTORNEY AND UNDERSTANDING AND MEMBERS OF THE COMMISSION. SEE A LOT OF MEMBERS OF THAT COMMISSION SITTING AROUND THE ROOM, BUT RIGHT NOW, THAT WOULD BE VERY PUBLIC AND OPEN TERMS ARE WE DISCUSSED THAT ORDINANCE AND THE APPLICATION AND THREE VERSION CLAUSES ITSELF MYSELF? THAT'S A VERY IMPORTANT THING, ULTIMATELY HAVE TO HAVE A RELEASE OF THAT ONCE. ARE YOU COMMITTED TO IT ON THE RIVER TO YOU DON'T WANT IT. WHAT COMMITMENT THE CITY AND ITS CITIZENS ONLY TO LOSE IT SO YOU WOULDN'T WANT WE'RE GETTING MONEY, GATIEN. SO WE DON'T HAVE THE POWER DOESN'T MAKE THAT PROPERTY MAJOR PRESERVATIVE POWER PROPERTY BETWEEN BUT I BEFORE WE GO DOWN THIS ROAD, WE'VE GOT TO HAVE SOME TRIGGER TO RELEASE THAT REVERTED. BECAUSE YOU WOULD NOT WANT TO DO ALL THESE THINGS THAT TALKED ABOUT SPENDING MONEY AND THE EFFORT FOR HIM. BE DISPLEASED AND US GET INVOLVED LITIGATION.POSSIBILITY PROBLEMS. MR LAB IS PRETTY SPECIFIC IN TERMS OF WHAT HE WOULD ACCEPT IN TERMS OF GOING FORWARD IF HE LIKES WHAT YOU'VE DONE, AND THAT'S WHAT YOU'RE GONNA DO. IT SHOULDN'T IT SHOULDN'T BE A PROBLEM. MHM. THEN USE THE CONSERVATIVE. TO ENSURE THAT PLACE AND NOTHING UNWANTED. PARTISAN. SO. AMERICA'S NOT QUESTIONS. WHAT'S THE TIMELINE? I THINK WE HAVE COMMON CONSENSUS TO MOVE FORWARD ON THIS. I DON'T BELIEVE THAT THERE'S A THERE'S A POINT TODAY THAT WE CAN'T EVEN DISCUSS THE TIMELINE BECAUSE, AS MR LANCE SAID HE WOULD CONSIDER ONLY AFTER SEEING A FINALIZED PLANT THAT'S BEEN FUNDED HOW LONG THAT'S GONNA TAKE IN TERMS OF ACHIEVING THE FUNDING FOR THAT PARTICULAR DEVELOPMENT. NOBODY CAN SAY RIGHT NOW, AS I SAID IN THE MEETING PUBLICLY TO MR LATTICE SAID, AND, UH EARLIER. IT COULD BE THE 22 23. THAT WILL BE ALREADY CLOSED. 22 23 BUDGET IT MAY BE THE 23 24 COMMUTE 24 25. SO IN ANSWER TO YOUR QUESTION, MR MCMULLIN DIRECTLY. I DON'T THINK WE CAN PUT A TIMELINE ON OTHER THAN THE FACT THAT COUNSEL AND STAFF WILL WORK TO THE DILIGENTLY TOWARD EVERY POSSIBLE ACTION THAT WE CAN I WORK IN THIS THING. IT WILL BE DOING OKAY? FOLKS IT'S UH I DON'T KNOW IT 7/10 THINGS IF YOU NEED A CITY SECRETARY. THE TIMESTAMP OFFICIALLY 7 22 CALLING TO ORDER
[CALL TO ORDER]

[3. CITIZENS' INPUT]
INPUT PURSUANT TO SECTION 5 51.7 OF THE TEXAS GOVERNMENT CODE. ANY MEMBER OF THE PUBLIC HAS THE OPPORTUNITY. TO ADDRESS THE CITY COUNCIL CONCERNING ANY MATTER OF PUBLIC BUSINESS OR ANY POSTED AGENDA ITEM. HOWEVER THE ACT PROHIBITS THE CITY COUNCIL FROM DELIBERATING AN ISSUES NOT ON THE PUBLIC AGENDA, AND SUCH NON AGENDA ISSUES MAY BE REFERRED TO CITY STAFF RESEARCH AND THEN THE FUTURE ACTION. ALL PERSONS ARE SUBJECT TO COUNCIL ADOPTED RULES AND LIMITATIONS PERMITTED BY LAW. AND THE CITY COUNCIL OF THE CITY OF DUNCANVILLE HAS DETERMINED THAT THE TIME LIMIT OF TWO MINUTES IS IMPOSED ON THOSE INDIVIDUALS THAT WISH TO SPEAK. THAT TWO MINUTE TIME LIMIT IS ALSO IMPOSED ON THE WRITTEN COMMENTS THAT I RECEIVED SO CITY SECRETARY WILL TIME MY READING OF THOSE COMMENTS AND HOPEFULLY I'LL BE ABLE TO GET THEM ALL IN WITHIN TWO MINUTE TIME LIMIT. INDIVIDUALS HAVE COME FORWARD TO THE TO THE TO THE LECTERN. THERE ARE THERE IS A TIMER THERE AS WELL FOR YOUR INFORMATION SO YOU CAN KEEP TRACK OF THE TIME AND CITY SECRETARY IS WATCHING THAT TIME AS IT PROCEEDS AS WELL. I HAVE SEVERAL WRITTEN COMMENTS[01:35:01]
HERE. ALRIGHT I'M SORRY. WRITTEN CARDS. INDIVIDUALS WISH TO SPEAK . WHAT I'M GOING TO DO IS READ THE WRITTEN COMMENTS THAT HAVE BEEN SUBMITTED FIRST BY EMAIL TO THE CITY SECRETARY, AND THEN WE WILL GO TO THE INDIVIDUALS THAT ARE PRESENT WHO WISH TO SPEAK IN PERSON. FIRST ONE IS FROM GILBERT CAVIL OR CAVALLO. 703 SAN JUAN DRIVE, DUNCANVILLE. IT'S A SHAME THAT BUT HOOK BAR AND GRILL WAS FINED $200 AND PUT ON THE 90 DAY PROBATIONARY PERIOD BECAUSE THE NEW NOISE OR NEW NOISE ORDINANCE I'VE BEEN THERE MANY TIMES AND ENJOY BEING AT THIS ESTABLISHMENT. I HAVE SEEN OLD PEOPLE AND YOUNG HERE ENJOY LISTENING TO MUSIC OUTSIDE AS WELL. WAY PAST 10 O'CLOCK DO NOT PUNISH THE GOOD ESTABLISHMENTS LIKE MUD HOOK AND OUR COMMUNITY OVER THIS NEW NOISE ORDINANCE. NEXT ONE IS ALSO BY MISTER KOVAL. CITY COUNCIL NEEDS CHANGE AND AMENDED CITY ALLOWANCES FOR COMMERCIAL ESTABLISHMENTS TO EXTEND HOURS TO HAVE QUOTE UNQUOTE LOUD EVENTS ON CERTAIN NIGHTS. WHICH COUNCIL MEMBER MR COONS RECOMMENDED THAT WAS THROWN OUT.SIXTH ITEM IS FROM BRITTANY HALL , 10 TO 3 STEWART AVENUE, DUNCANVILLE. HAS BEEN BROUGHT TO MY ATTENTION. THE MOTOR BAR WAS FINE FOR A NOISE COMPLAINT, WHICH WAS UNREASONABLE AND EMBARRASSING ON THE CITY. DUNCANVILLE IS BEHALF. SHAME ON YOU. I HAVE LIVED HERE FOR OVER 20 YEARS AND I'VE SEEN LITTLE TO NO PROGRESSION WHEN IT COMES TO BRINGING BUSINESS ENTERTAINMENT TO THE CITY. THE OWNER OF BULKHEAD MUD HOOK HAS HIT GROWING RUNNING. HAS HIT THE GROWING RUNNING AND IS UPGRADING THE CITY. UNLIKE THOSE WHO WE PAY TAXES, TOO. WE HAVE TO GO TO CEDAR HILL AND DISORDER TO EAT AND SHOP FLAT OUT AND EMBARRASSING. THE BEST THING DUNCANVILLE HAD BEFORE MONTAUK WAS DUNCAN TWO HIGH SCHOOL FOOTBALL GAMES THAT WON'T CUT IT. DOWNTOWN DUNCANVILLE LOOKS OLD AND INTERESTING, AND I WANT TO REQUEST MONEY TO BE PUT INTO FEEDING THE NEW AND YOUNG POPULATION AND LEAVE THE OLD SCHOOL IN THE PAST. THE CITY NEEDS TO EVOLVE AND CHANGE AND STOP BULLYING ENTREPRENEURS TRYING TO MAKE THE CITY BETTER.
ONE WEEK OR ATTACKING OWNERS OF AIRBNB S NEXT. THE ONLY BAR IN DUNCANVILLE IS AN ISSUE CITY COUNCIL. WE MUST DO BETTER. NEXT ITEM IS FROM BENJAMIN BANE. 10 TO 1 THAT STREET. PLEASE HAVE MAYOR GORDON READ MY COMMENT. SOME OF YOU MAY BE HERE IN SUPPORT OF BRIAN KEYSER AND MUD HOOK. YOU MAY HAVE BEEN LED TO BELIEVE THAT SOME OF THE COMMUNITY ARE TARGETING BUT HOOK AND TRYING TO RUN HIM OUT OF TOWN. I DON'T BELIEVE THAT IS THE CASE. IT CERTAINLY IS NOT FOR ME AND MY FAMILY. THE FACT IS, THERE HAS BEEN AN ONGOING ESCALATION OF LOUD AND DISTURBING NOISE AT NIGHT FOR AT LEAST A YEAR. IT HAS GOTTEN TO THE POINT THAT MY EIGHT YEAR OLD SON ASKS ME EVERY NIGHT. IF MUD HOOK IS GOING TO HAVE MUSIC TONIGHT, HE CANNOT SLEEP AT NIGHT DUE TO THE CONSTANT BASE COMING THROUGH THE WALLS. THE NOISE HAS REACHED THE LEVEL OF AFFECTING MANY CITIZENS AND NEIGHBORHOOD INSIDE THEIR HOMES. SO MUCH SO THAT ONE OF MY NEIGHBORS THAT LIVES OVER ONE QUARTER MILE FROM ONE HOOK AS STATED THAT HE IS HAVING TO SLEEP WITH HEADPHONES ON IN ORDER TO GET TO SLEEP ON NIGHTS WHEN THE MUSIC IS LOUD. I BELIEVE THE ISSUE. WITH NOISE COMING FROM MUD HOOK AS A RESULT OF A BUSINESS THAT HAS OUTGROWN HIS FACILITY. HIS BUSINESS HAS EXPANDED PRIMARILY TO OUTDOORS IN AN EFFORT TO SERVE MORE PEOPLE. THIS MAKES THIS BUSINESS ENTIRELY AT THE WEATHER'S MERCY. I BELIEVE A POSITIVE SOLUTION WOULD BE FROM WHAT HOOK TO RELOCATE TO THE NEWLY RENOVATED WHEATLAND PLAZA, WHERE HE WOULD HAVE ADEQUATE INDOOR SEATING FOR HIS PATRONS AND EVENTS, REGARDLESS OF THE WEATHER. THIS WILL PUT BRIAN'S RESTAURANTS ALL IN THE SAME COMPLEX, WHICH WOULD BENEFIT ALL HIS BUSINESSES, DRAWING MORE TRAFFIC WILL IN PLAZA. THERE IS AMPLE PARKING FOR FIRST FRIDAY. I BELIEVE THIS IS A PERFECT OPPORTUNITY FOR THE D. C D. C TO HELP LOCAL BUSINESS EXPAND HERE IN DUNCANVILLE. TO SUPPORT WHAT HOOKER WHEATLAND PLAZA. IT IS MY SUGGESTION THAT WE REVERSED THE PARADE ROUTE TO END THAT WE LEARNED PLAZA. THIS WILL HELP DRAW ATTENTION CITYWIDE TO THAT AREA THAT HAS BEEN NEGLECTED FOR YEARS. NEXT ITEM IS FROM DENISE WIND TO 47 MARY BOOK TRAIL. I WOULD LIKE TO MARRY TO READ MY COMMENTS, MAYOR AND CITY COUNCIL PLEASE MOVE FORWARD AND OFFICIALLY DESIGNATE THE LAND PROPERTY OF PRESERVED THROUGH A WRITTEN ORDINANCE. THE COMMUNITY SPOKE PYTHON LOUDLY HYPHEN LAST MARCH IN SUPPORT OF THIS THE COMMITTEE HAS DONE THE WORK PUT IN THE HOURS AND DRAFTED NORTON'S FOR THIS PURPOSE. I WOULD LIKE TO THANK MISS FARRELL BENAVIDES FOR TAKING SERIOUSLY THE CONCERNS OF CITIZENS IN MY NEIGHBORHOOD REGARDING ILLEGAL OPERATION OF A TVS SHE WENT ABOVE AND BEYOND, AND INSTILLED HOPE THAT I REQUEST OR NOT FALLING ON DEAF EARS. WE HAVE HAD A FULL WEEK OF RELATIVE PEACE AND RECOMMENDED DUNCANVILLE POLICE DEPARTMENT FOR THE FOLLOW UP AND COMMITMENT TO MAKING OUR STREETS SAFER. I WOULD ALSO LIKE TO MENTION THE PROPOSED ORDINANCE DESIGNATING THE CHARLES F. LAB NATURE PRESERVE. WE'RE ON THE STEERING COMMITTEE WERE ENTRUSTED WITH THE PRECIOUS TASK AND THEY WORKED VERY HARD RESEARCHING, DRAFTING, DISCUSSING REWRITING AND COMING TO CONSENSUS ON THE ORDINANCE. YOU NOW HAVE. I ENCOURAGE YOU TO PUT IT ON THE AGENDA INVOKED TO ADOPT THE ORDINANCE. WORK NEEDS TO BE STARTED TO PROTECT THE DELICATE ECOSYSTEM FROM THE RAVAGES OF VEHICLES, AND THEY CAN'T BE DONE WITHOUT A DESIGNATION. WE ALSO NEED TO MOVE FORWARD, ESTABLISHING THE NATURE CONSERVANCY AGAINST SUPPORT FROM ESTABLISHED ORGANIZATIONS. PARDON ME. SUCH AS THE AUDUBON SOCIETY, TEXAS PARKS AND WIFE AND OTHERS. HUNDREDS OF THOUSANDS OF DOLLARS ARE TO BE HAD ONCE WE CAN PROCEED WITH FUNDRAISING AND APPLY FOR GRANTS, BUT THEY'RE NOT AVAILABLE WITHOUT THE PROPER STATUS. THANK YOU FOR YOUR COMMITMENT TO THE TERMS OF THE DEED, THE WISHES OF MR LAD AND HIS FAMILY AND THE NATURAL CULTURAL AND EDUCATIONAL BENEFIT THIS NATURE PRESERVE WILL PROVIDE FOR THE CITY.NEXT ITEM IS FROM TED WILLIAMS, 8660 AVENUE, DUNCANVILLE REQUESTING MAYOR TO READ COMMENTS ONE THROUGH 12, PLEASE. ONCE POSTED BY CITY SECRETARY DROP SEAT AND YOU CAN SEE ALL OF MS WILLIAMS COMMENTS. NEXT ITEM IS FROM ALAN CONNOLLY , 1214 WELLINGTON DRIVE. MY NAME IS ALAN CONNELLY AT 1 TO 14 WELLINGTON DRIVE. I'VE BEEN A DUNK OF A RESIDENT FOR 20 YEARS. 16 OF THOSE YEARS I RAN VERY SUCCESSFUL RESTAURANTS IN DUNCANVILLE. I FEEL THE NEED TO TALK ABOUT THE BIGGER PICTURE OF WHAT THE CITY SHOULD BE CONCERNED ABOUT. WE SHOULD BE BUILDING FAMILIES, STRONG FAMILIES, NOT THINGS THAT WILL HURT OR WEAKEN FAMILIES. YOU SHOULD KNOW THAT EVEN FORTUNATE TO HAVE A LOT OF FRIENDS HERE.
NONE OF THEM ARE RACIST OR HOMOPHOBIC OR ANTI BUSINESS OR OUR PRINCE. I'M SORRY. QUOTE UNQUOTE HATERS, CLOSE QUOTE. THEY'RE COMPLETELY OPPOSITE OF THAT, AND THEY GENERALLY CARE ABOUT THIS CITY. YET WE LIVE IN A WORLD WHERE PEOPLE HIDE BEHIND THE KEYBOARD AND USE NAME CALLING TO GET WHAT THEY WANT. THOSE INTIMIDATION TACTICS HAVE BEEN OVERPLAYED AND THERE ARE NO
[01:45:05]
LONGER EFFECTIVE. IT IS MY HOPE THAT OUR LEADERS IN THIS CITY LOOK FOR WAYS THAT MAKE FAMILIES STRONGER AND NOT EXPOSE THEM TO ELEMENTS THAT DON'T THAT THEY BE BRAVE AND COURAGEOUS AND VOCAL AND TAKING A STAND TO NURTURE AND PROTECT OUR CHILDREN FROM THE ELEMENTS THAT WOULD HURT THEM AND LIMIT THEIR POTENTIAL. I AM UNAPOLOGETIC ABOUT MY BELIEFS IN CHRIST AND SALVATION AND REDEMPTION. BUT IT COMES WITH A RESPONSIBILITY TO STAND UP FOR WHAT MATTERS AND AGAINST THOSE THINGS THAT HURT OUR FAMILIES AND OUR CHILDREN IN REAL LIFE TESTIMONIAL THAT YOU CAN RUN A SUCCESSFUL BUSINESS IN DUNCANVILLE WHEN YOU'RE FOCUSES ON SUPPORTING THE HARDWORKING FAMILIES, AND THAT INCLUDES ALL CAPS, ALL PEOPLE. CLOSE ALL CAPS. NOT JUST SMALL NICHE GROUPS, WHICH WILL ONLY DIVIDE US. BUT I'M ALSO UNAPOLOGETIC, FREE MARKET CAPITALIST. AND IF A BUSINESS WANTS TO LIMIT THEMSELVES TO A TRENDY, POLITICALLY CORRECT CAUSE THEY SHOULD BE ABLE TO DO THAT. BUT DO SO PRIVATELY AND FOLLOW THE RULES THAT WE ALMOST FOLLOW, RESPECTFULLY SUBMITTED ALLEN COMEDY. NEXT ITEMS FROM JOE COLE 434 EAST MONA AVENUE, DUNCANVILLE. OPEN QUOTES I LIVE WITHOUT WATER NOW CLOSE QUOTES. THIS IS A QUOTE FROM A CITIZEN IN DUNCANVILLE, WHO HAD THEIR WATER SHUT OFF BECAUSE OF THE WAY THE CITY BILL SEWER USE. THE WINTER AVERAGE BILLING MODEL OF THE CITY USES COSTAS CITIZEN TO BE BUILT $175 FROM 43 CENTS EACH MONTH AND TWO OR START SEWER CHARGES. THE CITY NEEDS TO BUILD SEWER BASED ON SEWER USE BASED ON ACTUAL WATER USAGE IF THE ACTUAL WATER USED TO JUST LESS THAN THE WINTER AVERAGE USAGE AND THEN GIVEN MONTH THIS IS HOW DALLAS, LANCASTER AND MANY OTHER CITIES DO IT. CHANGING THE SYSTEM IS THE RIGHT THING TO DO WOULD PROVIDE IMMEDIATE RELIEF TO MANY HOUSEHOLDS IN THE CITY OR STRUGGLING WITH ECONOMIC PRESSURES FROM EVERY DIRECTION. THANK YOU.THE NEXT ITEM. I HAVE. AS A DUPLICATE OF THE WHAT I HAVE READ FROM BEN AND MR BAIN.
NEXT ITEM. IS FROM CHARLES MCDUFFIE, 1626 SOUTH GREENSTONE LANE, DUNCANVILLE. COUNCILMAN WE HAVE BEEN WAITING YEARS FOR THE BRIDGE LIGHTS AND GREENBRIER STATES TO BE OPERABLE. OPEN PRINTS, MULTIPLE LOCATIONS, CLOSED PARENTS. I KNOW FROM TALKING TO MY NEIGHBORS THAT THERE ARE PLANS THAT HAVE BEEN DISCUSSED. BUT AT WHAT POINT DO PLANTS CAN BECOME A REALITY? THE LACK OF LIGHTS ON OUR BRIDGES, OUR SAFETY CONCERN AND A REFUGE CONCERN. CARS DRIVE BY AND BECAUSE IT'S DARK ON THESE BRIDGES. THEY THREW. THEIR TRASH OUT OF THEIR CAR WINDOWS ONTO THE BRIDGES. WE ASSUME THEY'RE TRYING TO TOSS THE TRASH INTO THE CREEKS, BUT THEY MISS IT AND ALL IT ALL LAYS ON THE BRIDGE IS BROKEN GLASS FOOD ITEMS, ETCETERA. MY NEIGHBORS ARE LIVE ADJACENT TO THE CREEK WORKED TIRELESSLY REMOVING THE TRASH FROM THE CREEK. WE DESIRE AN OUTCOME FOR THE REPAIR OF THESE LIGHTS ONCE AND FOR ALL. PLEASE LET ME KNOW WHAT WILL BE DONE.
WE'RE ALSO VERY CONCERNED ABOUT THE VERY HIGH SPEEDING DOWN GREENSTONE SOUTH OF DANIEL DALE.
IF YOU COULD PLEASE PUT SPEED BUMPS OR RADAR SIGNS AT THE INTERSECTION OF FINE HOLLOW OR GREENSTONE LANE QUESTION, MARK THERE'S ALREADY BE A VERY BAD WRECK AT THIS CORNER, AND THERE'S A FEW AT LOCAL RESIDENTS TO DRIVE LIKE MANIACS THROUGH THE NEIGHBORHOOD. WE'VE ALMOST BEEN RUN OVER IN FRONT OF OUR TRYING TO CROSS THE STREET TO OUR NEIGHBORS. FORMER MAYOR DAVID GREENE WE'VE LIVED HERE FOR YEARS AND FEEL OUR NEIGHBORHOOD AND CITY ARE GOING DOWNHILL. IN A BERNARDO SPIRAL AND BREAKNECK SPEAK. WE OWN FOUR BEAUTIFUL HOMES IN THE CITY AND THE CURRENT STATUS OF DUNCANVILLE EXTREMELY CONCERNING TO OUR FAMILY AND HERITAGE.
PLEASE RESPOND TO ME TO ACKNOWLEDGE YOU HAVE READ THIS AND THAT YOU CARE FOR YOUR CONSTITUENTS. WE HAVE ANY OTHER CITY JOBS FOR YOUR CONSTITUENTS. THAT CONCLUDES THE WRITTEN COMMENTS HAVE BEEN SUBMITTED. NOW GO TO THE COMMENT CARDS THAT I HAVE FOR INDIVIDUALS PRESENT THAT WISHED TO SPEAK, OR SOMETIMES I NEED TO READ THESE CARDS CLOSELY. SOMETIMES THEY DON'T WISH TO SPEAK, BUT THEY INDICATE WHICH AGENDA ITEM THEY ARE IN SUPPORT OR OPPOSITION FOR SO I WILL BE CAREFUL TO MAKE SURE AS I GO THROUGH THESE THAT PEOPLE DO WISH TO SPEAK. 1ST 1ST PERSON IS RUTH CARLSON. THAT HURTS ALL OF OUR CITY AND ALL OF OUR CITIZENS. BOTH BUSINESSES. AND INDIVIDUAL CITIZENS. PLEASE COME TOGETHER WITH THE SPIRIT OF RESPECT AND WORK OUT THE PROBLEMS WITHOUT SOCIAL MEDIA.THANK YOU. THANK YOU. NEXT INDIVIDUAL IS MARK CHRIST, DALE. I'M MARK KREUZ, DALE 12 15 WELLINGTON DRIVE. THE VERY FIRST CITY COUNCIL MEETING. I CAME TO WE WERE TALKING ABOUT THE LAD PROPERTY, AND I HAD CHALLENGED THE COUNCIL MEMBERS TO GO VISIT A PRESERVED UM AFTER THAT, WHEN WE ESTABLISHED THE. THE COMMITTEE. I ENDED UP ON THE COMMITTEE. I'M NOT A BIG FAN OF BEING ON A COMMITTEE OR ON A COMMISSION. UM UNLESS IT'S SOMETHING THAT MOVES FORWARD AND IT HAS AN AGENDA AND THEY FOLLOW THE AGENDA AND THEY GET STUFF DONE. AND THEN I AM. I AM A FAN OF THAT, BUT IT'S TALKING IN CIRCLES. AND WASTING TIME. I DON'T DO GOOD WITH THAT. SO WE'VE DONE A BUNCH OF WORK AND WE WE'VE SUBMITTED AN ORDINANCE WITH THE CITY. FOR THE CITY, AND , UM, I STAND BEHIND THE ORDINANCE. I AGREE WITH IT. I WOULD HOPE THAT YOU WOULD VOTE FOR IT BECAUSE WE DO HAVE AN AGENDA. SO THE NEXT THING ON OUR AGENDA CAN'T BE DONE UNTIL YOU.
YOU MAKE THE LAD. PROPERTY OF RESERVES. THEN WE CAN START GETTING FUNDING. AND IF YOU'RE WORRIED ABOUT LIKE THE PRESENTATION AND ALL THE THINGS HOW DO WE PAY FOR ALL THIS STUFF? YOU DON'T HAVE TO WORRY ABOUT THAT. YOU DON'T HAVE TO. YOU DON'T HAVE TO FIND IT. YOU DON'T HAVE TO PUT MONEY INTO IT. IT'S GOOD, JUST LIKE IT IS AND LET IT GET GOING AND ALL THAT STUFF WILL JUST HAPPEN OVER TIME. THANKS. THANK YOU. NEXT CARD I HAVE IS FROM MARGARET.
GEIGER. IS THAT CORRECT? AND YOUR CAR DOES NOT INDICATE YOUR ADDRESS. SO YOU'RE NEEDED TO SAE MICROPHONE SO YOU CAN GET RECORDED. THANK YOU. THERE YOU GO. MARGARET GEIGER 567 SUMMIT RIDGE DRIVE. OH, I'M SO SORRY. YOU CAN TALK ABOUT THAT IF YOU WANT TO, UH I'M HERE TO TALK ABOUT THE NOISE ORDINANCE. I BROUGHT A COPY OF IT THAT I PRINTED OUT AND IT HAS A LOT OF YELLOW. I GUESS THAT'S ALL THE NEW THINGS. SALARY TIRED EDUCATOR AND ONE OF THE THINGS THAT WE ARE ALWAYS TAUGHT IS DIFFERENTIATED TEACHING. AND I WANT TO USE THAT ANALOGY. THIS IS EXCELLENT. FOR WHAT? I'M AT HOME AND MY NEIGHBOR DOWN THE STREET AT ONE O'CLOCK IN THE MORNING, WANTS TO TURN HIS CAR STEREO ON SO LOUD. IT VIBRATES MY HOUSE. ART. WHAT ABOUT BUSINESSES THAT ARE THRIVING THAT PAY TAXES TO HELP SUPPORT DUNCANVILLE? WE NEED A VERY SIMILAR OR KNIT SIMILAR TO WHAT DALLAS GRAND PRAIRIE JUST SOTO HAVE THAT ALLOW BUSINESSES TO HAVE ENTERTAINMENT AND ENTERTAINMENT DISTRICT. AND YOU KNOW WHAT? I'M SPEAKING ABOUT? MUD HOOK BARN GRILL. THEY DO WONDERFUL THING. I HAVE BEEN A VENDOR AT THEIR FIRST FRIDAY FOR TWO YEARS. IT IS NOT LOUD AND OBNOXIOUS. THAT MUSIC IS NOT LOUD. I HAVE BEEN THERE FOR THEIR LATINO NIGHTS. IT'S NOT LOUD. IT'S. LIVE ENTERTAINMENT. THEY SUPPORT LOCAL ARTISTS.
[02:00:10]
THEY'RE MUSICIANS ARE LOCAL. WHY CAN'T WE SUPPORT PEOPLE OF DUNCAN BILL? IT'S TIME TO GROW UP AND JOIN THE 21ST CENTURY. AND IF I'M AN OLD WOMAN WHO'S RETIRED, WHO AGREES WITH THIS I THINK THE CITIZENS OF DUNCANVILLE SHOULD ALSO SUPPORT AN ENTERTAINMENT DISTRICT AND REVAMP THE NOISE ORDINANCE. LIKE I SAID THAT NOISE ORDINANCE IS GREAT FOR RESIDENTS, BUT IT IT'S A DISSERVICE FOR THE INDUSTRY. I DON'T WANT TO. GO HOME AT NINE O'CLOCK IF I'M WANTING TO BE ENTERTAINED, THANK YOU. THANK YOU. THE NEXT INDIVIDUALS. ALLEN CONNOLLY.ALAN CONNOLLY. 12 14 WELLINGTON . YOU READ MY COMMENT. I DIDN'T KNOW YOU WERE GOING TO DO THAT.
BUT I ONLY CAME UP HERE TO SAY. I'M NOT HIDING BEHIND A KEYBOARD . I MEANT EVERY WORD I SAID, THANK YOU. THANK YOU. NEXT INDIVIDUALS, JUDY SMITHY. THANK YOU AND CITY MANAGER. THE MAYOR AND COUNCIL MEMBERS AND CITY SECRETARY JANE I HAVE. MY NAME IS NEEDED. NAME AND ADDRESS.
PLEASE WAS MY NEXT NAME IS JUDY SMITHY OLIVE AT 18? OH SIX CEDAR HILL ROAD LIVED IN DUNCANVILLE SINCE 1965. AH I'M A LONGTIME MEMBER, ALSO OF THE OF THE BOARD OF DIRECTORS OF THE DUNCANVILLE COMMUNITY THEATER. WE HAVE FULLY EXECUTED, BINDING LEASE THAT WAS DRAWN UP BY THE CITY ATTORNEY EXPECTED FOR FOUR MORE YEARS. WE ABIDE BY IT. WE ARE ALWAYS IN REHEARSAL OR PERFORMANCE, AND WE'RE GRATEFUL FOR THE OPPORTUNITY TO BRING LIVE FIRST STRAIGHT THEATER TO DUNCANVILLE.
FOLKS HERE CAN ATTEND. BEFORE THEY COME TO THE SHOW THAT CAN SPEND THEIR MONEY AT LOCAL RESTAURANTS AND HAVE DINNER WITHOUT HAVING TO DRIVE IN NORTH OF THE TRINITY. OUR NEXT PRODUCTION IS A MURDER MYSTERY. NIGHT MUST FALL. IT STARTS NEXT THURSDAY. THE 29TH OF SEPTEMBER . 30TH OCTOBER 1ST. THERE IS A SUNDAY MATINEE ON THE SECOND AND THEN THE LAST PERFORMANCES OR OCTOBER 6TH, 7TH AND 8TH, AND WE WELCOME YOU ALL TO COME FROM LESLIE. EVENING. THANK YOU.
THANK YOU. NEXT INDIVIDUAL AND IT WAS GRADY SMITHY. GRADY SMITH, E 18 OH SIX. CEDAR HILL ROAD, DUNCANVILLE, TEXAS RESIDENTS SINCE 1950. I SAID ON THAT SITUATION WHERE YOU ALL ARE THERE FOR 22 YEARS. I WANT TO TELL YOU SOMETHING, GUYS, I'M A LITTLE BIT PERTURBED RIGHT NOW.
I UNDERSTAND THERE'S SOME SOME FOLKS IN TOWN THAT THINKS THAT WE ARE DOING AWAY WITH DUNCANVILLE COMMUNITY THEATER. WE WORKED VERY HARD TO FIND THAT THEATER WHEN I WAS FIRST ON THE COUNCIL, STARTING IN 1919 84. WE FINALLY GOT IT FIRE FIGHTING TO THE POINT WHERE SHE'S GOING AND WE CAN LOOK UP. WE'VE GOT A PLACE FOR HIM. WE'VE GOT EVERYTHING GOING FOR HIM. AND YOU KNOW, IF YOU IF YOU HAVEN'T BEEN THERE, YOU'RE MISSING A REAL TREAT. BUT I GOTTA TELL YOU, YOU KNOW THERE'S A LOT OF PLACES YOU CAN YOU CAN YOU CAN YOU CAN EAT IN DUNCANVILLE THAT CAN BE MORE. BUT THEY DON'T HAVE TO TAKE OVER THAT THEATER. IF THEY TAKE OVER THAT THEATER. YOU GUYS ARE IN DEEP TROUBLE UP THERE BECAUSE THERE WILL BE A LOT OF PEOPLE UP HERE THAT DON'T LIKE THAT, IF YOU IF YOU GET IF YOU GET RID OF THEATER NOTHING I WANT TO SAY MAYOR APPRECIATE YOU READING EVERYBODY'S COMMENTS. BUT WHY DID YOU DO THAT? BEFORE YOU LET PEOPLE SPEAK? AND WHY DO YOU DO THAT? ANYWAY JUST PASS THAT AROUND TWO PEOPLE, YOU KNOW SO THEY CAN THEY CAN READ THOSE COMMENTS IN IT WILL TAKE HALF OF YOUR MEETING TIME. THANK YOU VERY MUCH. J. REESE EDWARDS.
THANK YOU, MA'AM. MY NAME IS JERRY SANDWICH. I LIVE AT 2 TO 6 MARGINAL STREET THAT CAN WILL 751 WIN SIX COME ONTO TO ENVIRONMENTAL CAUSES. FIRST OF ALL WHEN YOU EMPLOY YOU TO MAKE A COMMITMENT AGAIN FOR THE LAB PROPERTY, IT SEEMS THAT WE'RE AFRAID OF COMMITMENT. UM, WE'RE
[02:05:01]
AFRAID OF MAKING SURE WE HAVE ALL OUR DUCKS IN ROW. UM YOU KNOW, THE WORLD IS PAVED WITH GOOD INTENTIONS AND GOOD PLANS IF WE'RE AFRAID OF COMMITMENT, THERE WERE ALWAYS GOING TO SELL OURSELVES SHORT. SO I EMPLOY YOU TO NOT BE AFRAID OF WHAT MIGHT HAPPEN IN THE FUTURE. THIS FOCUS ON THE PRESENT AND THE NEW FUTURE SO WE CAN BEGIN A PROCESS OF TURNING THE LAND INTO A SHOWCASE FOR OUR COMMUNITY. DON'T BE AFRAID OF THE LEGALISM BUREAUCRATIC RED TAPE AND MAKE A COMMITMENT IN THE NEXT MONTH TO MAKE A PRESERVED BY TITLE, NOT BY CONCEPT, BUT BY TITLE SO EMPLOYED WITH THE NEXT MONTH NOW , WITHIN THE NEXT SIX MONTHS, I EMPLOY YOU TO ALSO MAKE A THE ORDINANCE FOR US TO BELIEVE, AND THEY HAVE LANDSCAPING. I DON'T KNOW IF YOU KNOW, BUT WE HAVE JUST HAD OUR OUR DECADE ANNUAL DROUGHT. AND SAID, LOOK AROUND DUCKING VALUE WITH THE PEOPLE.THEY'RE SPENDING 50% PERCENT OF THE WARRIORS THAT KEEPING IT GREEN LAWN. NOW THAT CAN BE AVOIDED IF YOU WILL HAVE A NAIL ORDINANCE WHERE IF YOU HAVE A PERMIT BASED SYSTEM WHERE YOU CAN HAVE UM THERE WASN'T GLASSES , GRASSES AND FLOWERS THAT WERE NOT ONLY DECREASE THE WATER USED IN TIMES OF DROUGHT LIKE WE'RE BRINGING THIS SUMMER, BUT ALSO BEAUTIFY, UM A LAWNS AND OUR CITY, BOTH FOR BUSINESSES AND COMMUNITIES AND SYSTEMS LIKE ME WHO WANT TO DO THAT YEAR ROUND EMPLOYEE TO CONSIDER HAVING AN ABOVE 10 FT INCH ORDINANCE AND ALSO HAVE A PERMIT BASED ON IT SO WE CAN HAVE GRASSES AND FLOWERS ON THE IRAN BASIS. THANK YOU FOR YOUR TIME AND CONSIDERATION. THANK YOU. HOW MANY BRIDGES. EMILY BRIDGES, OLEANDER STREET, DUNCANVILLE 75137. BUT YOU KNOW WHERE I'M GOING WITH MY COMMENTS. I WOULD LIKE TO PUSH FORWARD WITH THE ORDINANCE ON THE LAB PROPERTY TO DESIGNATE A PRESERVE. I'M GOING TO ECHO. WHAT'S ALREADY BEEN SAID IS WE CAN DO FUNDING YOU MENTIONED IN THE BRIEFING THAT IT WOULD TAKE TWO, POSSIBLY THREE YEARS BEFORE IT COULD EVEN BE BUDGETED. AND WHEN IT IS APPROVED, WE COULD START RAISING THAT MONEY NOW, BUT WE CAN'T PUT MONEY AT THIN AIR. WE HAVE TO HAVE A PRESERVE IN ORDER TO DO THAT. I ALSO WANTED TO ADD THAT THE DIRECTOR OF WILD AND FREE HOMESCHOOL CO OP FROM SOUTH DALLAS HAS REACHED OUT TO ME, AND THEY WANTED A TOUR. ON LAST THURSDAY, THEY WILL BE COMING WITH THEIR GROUP OF 30, POSSIBLY 40, PARENTS AND CHILDREN DOWN THERE ON THURSDAY TO ENJOY THE LAND, AND THEY'RE LOOKING TO DO A LOT OF VOLUNTEER EFFORTS AS WELL AS MANY PEOPLE IN THE COMMUNITY. BUT IT HAS NOW REACHED OUT OUTSIDE OF OUR LITTLE CITY IN THE OTHER CITIES , AND THEY WANT TO KNOW WHAT THEY CAN DO TO HELP AS WELL. AND AS ALWAYS, LITERALLY IS TERRIBLE IN OUR CITY, AND I WISH WE COULD DO SOMETHING TO COMBAT THAT A LITTLE BIT MORE. THANK YOU.
NEXT ITEM OF HAFIZ RON THOMPSON. HI RON THOMPSON 603 KATHRYN KOLBERT MAYOR, CITY COUNCIL STAFF. THANK YOU FOR THE CHANCE FOR US TO COME UP HERE AND SPEAK LOUDLY AT YOU. I'M NOT GONNA DO THAT. UM I'M HERE TO SPEAK ON THE LAD ORDINANCE. UM ONE OF THE THINGS I THINK IT'S IMPORTANT FOR. I GUESS YOU ALREADY RECOGNIZE. YOU KNOW WHAT OUR WORK PRODUCT IS. YOU KNOW WHAT OUR ABILITY IS TO ACTIVATE THE COMMUNITY, AND IT'S CLEAR WHAT OUR PASSION IS, UM, THE LAST THING WE'VE BEEN ABLE TO DEMONSTRATE AS OUR ABILITY OF FUNDRAISE AND ONE OF THE REASONS FOLKS ARE REALLY WANTING THIS TO HAPPEN RIGHT AWAY IS BECAUSE THAT'S THE BRAKING MECHANISM.
RECOGNIZE THERE'S A LOT OF CARTS BEFORE HORSES ISSUES HERE BUT WITHOUT A PRESERVE. WE CAN'T RAISE FUNDS FOR A PRESERVE. AND SO AS YOU CONSIDER THE ORDINANCE IN FRONT OF YOU, I WOULD LIKE FOR YOU TO THINK ABOUT THIS AND LET YOU KNOW THAT THE FOCUS ON THE COMMISSION AND OUR NEWLY ORGANIZED PHIL NATURE CONSERVANCY. WE'RE ON YOUR TEAM. AND WE'RE HERE TO HELP YOU BECAUSE WE KNOW YOU'RE GOING TO GIVE US SOMETHING SPECTACULAR WHEN IT'S DONE. THANK YOU. THANK YOU. RICE MILL. UM. RICE AND ISLAND 6 23 SOUTH ALEXANDRA AVENUE. THIS IS REGARDING THE LAD PRESERVED PRESENTATION. EACH OF YOU HAVE A COPY OF IT'S IMPORTANT TO NOTE THAT IT SHOULD BE VIEWED AS IF IT WERE A MENU OF ALL THE POSSIBLE THINGS THAT MIGHT BE FOUNDED TO PRESERVE HAVING HUNDREDS OR EVEN THOUSANDS OF ACRES. THE MASTER PLAN DRAFT
[02:10:06]
THAT MR LAND HAS REQUESTED MUST FIRST AND FOREMOST REFLECT THE NEEDS OF THE CURRENT AND FUTURE INHABITANTS OF THE LAND. THAT WE ON THE COMMITTEE ARE SEEKING TO PROTECT WE WILL NEED TO CHOOSE JUDICIOUSLY A FEW ITEMS FROM THIS MENU TO ENSURE THAT OUR EYES AREN'T BIGGER THAN WHAT LAD LAND CAN STOMACH. 42 ACRES IS A VERY SMALL AREA AND THE LAND IS ALREADY SUFFERING FROM AN ONSLAUGHT OF INVASIVE SPECIES THAT ARE REDUCING THE BIODIVERSITY. WHEN YOU COUPLE THAT WITH THE CONTINUAL INFLUX OF POISONS RUSHING THROUGH THE CREEK. LIKE MICROPLASTICS AND LITTLE BITS OF STYROFOAM, THE EXCESSIVE AND ILL TIMED MOWING AND THE CLIMATE INSTABILITIES THAT OUR DAILY BECOMING MORE APPARENT IT BECOMES OBVIOUS THAT THE SITUATION IN THE LAND IS PERILOUS. ONE REASONABLE SIZED PARKING LOT THAT OCCASIONALLY FEEL STICK CAPACITY WILL SPEAK CLEARLY ABOUT OUR STRONG CONSERVATION ETHIC, MUCH BETTER THAN MULTIPLE LOTS THAT WILL LIKELY OFTEN STAND EMPTY BECAUSE THE FEW SPECIES THAT WILL REMAIN IN A. AND OVERLY DEVELOPED PRESERVE ARE THOSE SAME FEW SPECIES THAT CAN BE SEEN ANYWHERE. AND EVERYWHERE BECAUSE THEY HAVE ALREADY CONQUERED AND IMPOVERISHED THE REST OF THE WORLD. THE CITIZENS OF DUNCANVILLE HAVE ASKED FOR A NATURE PRESERVE THAT WILL PROVIDE SAFE HARBOR FOR THE WIDEST ASSEMBLAGE OF WILD SPECIES. BECAUSE DIVERSITY CREATES STABILITY. SO LET'S SHOW OUR CHILDREN THAT BALANCE AND HARMONY ARISE FROM THE BLENDING OF MANY DIFFERENT VOICES. THANK YOU.THE NEXT INDIVIDUAL HABITS, PATRICIA EBERT. PATRICIA HUBERT 115 SOUTH GREENSTONE 75116. THE LAD NATURE PRESERVE. CAN'T WAIT TO PUT UP. THE SIGN WILL ADD IT TO THE LIST OF DESTINATIONS FOR DUNCANVILLE. THANK YOU. THE FINAL COMMENT CARD TO HAVE A SHANNON ROBERTS. HELLO SHANNON ROBERTS, 906 ROCK CANDY YELLING NOW, SO 906 ROCK CANYON AND I'M HERE AS PART OF THE LAB GROUP, SO I'M PART OF THE DUNCANVILLE NATURE CONSERVANCY. AND WE BELIEVE THAT WE HAVE MET WHAT MR LAD AND HIS FAMILY AND VISION FOR THE USE OF THE LAND. FOR THE CHART BY THE CHARTER. I IMPLORE YOU ALSO TO LOOK AT THAT ORDINANCE. WE BELIEVE IT MEETS THE NEEDS AND AS MANY PEOPLE HAVE SAID, WE CAN'T MOVE FORWARD WITH FUNDING UNTIL IT IS LABELED A NATURE PRESERVE, AND THE CITIZENS HAVE SPOKEN, AND WE BELIEVE LIKE THE PASTOR SAID. WE WANT TO MAKE A BETTER DUNCANVILLE. WE WANT TO MOVE FORWARD. WE WANT TO GROW. THERE WERE SO MANY BENEFITS. IT'S SUCH A BEAUTIFUL PLACE, AND WE WANT TO PRESERVE IT AND THEN MAKE IT EVEN MORE. AND SO, UM, BEG YOU TO DO THAT AND NOT TO WASTE ANY MORE TIME. IT'S BEEN SITTING THERE FOR 25 OR 30 YEARS. AND SO WE ARE READY TO DO FUNDING AND IF NOT IS THERE FUNDING ANYPLACE ELSE THAT IT CAN COME FROM? AND AT A ABSOLUTE WORST CASE SCENARIO, PLEASE DON'T MAKE IT BE TWO YEARS IN A BUDGET. IT WOULD ABSOLUTELY HAVE TO BE NEXT YEAR, BUT I THINK WE HAVE A LOT OF PEOPLE HERE THAT ARE READY TO GO. LOTS OF COMMUNITY SERVICE SCOUTS AND ALL OF US AS VOLUNTEERS. AND SO WE HOPE THAT YOU WILL CONSIDER THE ORDINATES VERY SERIOUSLY. AND WE THANK YOU VERY MUCH. THANK YOU. THAT

SECOND BY COUNCIL MEMBER COUNTS COUNCIL, PLEASE VOTE ON CLOSING THE PUBLIC HEARING. YEAH. THANK YOU. PUBLIC HEARING IS OFFICIALLY CLOSED UNANIMOUSLY. TIMESTAMP 8 38 38. THANK YOU.AND IS OUR PRACTICE NOW? ANY QUESTIONS TO THE APPLICANT OR TO OUR STAFF MAY BE GIVEN BY CITY COUNCIL AT THIS TIME. MR MCBURNETT. THANK YOU, MAYOR. UMN FAVOR OF THIS, BUT I'D ALSO LIKE OUR COUNCIL TO CONSIDER LOOKING AT THE ORDINANCE BECAUSE WE HAVE THESE COME THROUGH QUITE A BIT, AND I THINK THERE'S A FASTER, BETTER PROCESS. THANK YOU. THANK YOU. SAYING NO ADDITIONAL CUT.
OKAY MR. CONTRERAS I JUST WANT TO, UH I AGREE WITH COUNCILMAN MCBURNETT. THAT OVER THE PAST EIGHT OR NINE MONTHS. WE'VE HAD A NUMBER OF THESE THAT HAVE COME FORWARD. AND BEING THAT THEY ARE CONSIDERED TO BE AN ACCESSORY STRUCTURE. I KNOW THE ORDINANCE CURRENTLY SAYS THAT THEY ARE REQUIRED TO GET S U P BUT THEY'RE NOT MUCH DIFFERENT THAN ANY OTHER ACCESSORY STRUCTURE, AND I'M NOT SURE WHY FOLKS HAVE TO PAY. WHATEVER AMOUNT THEY PAY TO COME BEFORE THE PANSY TO GET APPROVAL FOR A LEGAL CARPORT. SO I WOULD AGREE THAT WE SHOULD PROBABLY HAVE THAT DISCUSSION WITH THE CITY MANAGER TO SEE IF WE CAN REVIEW THAT. THANK YOU, MR COONS. ONE MOVED TO PROOF.
SECOND. THE COMMENTS. WE HAVE MOTION TO APPROVE BY MR KOONTZ AND WE HAVE A SECOND, MR CONTRERAS. COUNCIL, PLEASE VOTE. UNANIMOUSLY APPROVED, MR HARVEY ABSENT. THANK YOU. AND CITY MANAGER COMMENTS BY MR CONTRERAS AND MR MCBURNETT DULY NOTED. YES, SIR. WE WILL BRING THIS BACK IN A DISCUSSION WITH COUNCIL WITH HISTORY AND THEN SOME RECOMMENDATIONS. YOU KNOW, ONE THING IS LOOKING AT THAT. PARTICULAR. FASHION THAN WE HAVE. IT ALSO SPECIFIES MATERIALS. AND BY THE 80 WHAT 87TH LEGISLATIVE SESSION BY THE TEXAS LEGISLATURE, THERE IS NO THERE IS NO PROVISION FOR A CITY TO NOT PERMIT ANY TYPE OF BUILDING MATERIAL. SO WHEN IT'S LOOKED AT THIS, IN TERMS OF THE ORDINANCE THAT BUILDING MATERIALS COULD BE LOOKED AT AS WELL. NOW I WILL ADD AS AN ADJUNCT TO THIS THERE IS SOME MOVEMENT. THE CITY CITY ATTORNEY PROBABLY GONNA SHUT ME DOWN, BUT I'M GOING TO DO THIS ANYWAY. THERE IS SOME LEGAL NO, NO, THERE IS SOME MOVEMENT AMONG SOME OF THE LEGISLATORS AS THEY GO INTO THE NEXT LEGISLATIVE SESSION TO REPEAL THAT LAW THAT WAS PUT INTO EFFECT IN THE LAST LEGISLATIVE SESSION TO WHERE CITIES COULD NOT. PRECLUDES ANY TYPE OF BUILDING MATERIAL, SO OUR ORDINANCE IS NOT YET BEEN CHANGED. IT STILL HAS THAT OCCLUSION IN IT. SO WE ARE. IN FACT, WE WERE GIVEN SOME ADVICE TO SAY FROM THE LEGISLATURE FROM IT FROM REPRESENTATIVES AND SENATORS. WE'RE NOT SURE HOW THIS PARTICULAR LAW IS GOING TO MOVE FORWARD. IT COULD BE REPEALED. IT COULD NOT BE REPEALED. BUT I THINK WE NEED TO STAND BY THAT PARTICULAR ASPECT OF THE INCLUSION OF BUILDING MATERIALS FOR ANYTHING THAT'S BUILT IN OUR CITY TO SEE WHAT HAPPENS IN THE NEXT LEGISLATIVE SESSION. BECAUSE THERE ARE STRONG POSSIBILITY IT WILL BE REPEALED. AND I LEARNED THAT ABOUT A WEEK AND A HALF AGO. THANK YOU FOR ALLOWING ME TO INTERJECT THAT.
ITEM. FIVE E. CONSIDERING ORDINANCE AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER TWO ADMINISTRATION BY REPEALING ARTICLE ONE IN GENERAL SECTIONS , 2-12-22-3. RESERVED FOR FUTURE USED BY ADDING NEW ARTICLE FIVE BOARDS AND COMMISSIONS TO PROVIDE FOR A LIST OF DIFFERENT BOARDS, APPOINTMENTS, QUALIFICATIONS, ESTABLISHMENT, MEMBERSHIP AND OTHER DUTIES PRESENTED BY CITY SECRETARY DOWNS. ALRIGHT ON JULY, 21ST CITY COUNCIL HAD A SPECIAL MEANING TO DISCUSS OUR BOARDING COMMISSIONS AND CHANGES WERE RECOMMENDED BY CITY COUNCIL.
ORDINANCE ORDINANCE. 2454 HAS BEEN CREATED FOR ALL BOARD AND COMMISSIONS THIS ALLOWS FOR STAFF INSTEAD, CITIZENS TO HAVE ONE PLACE TO VIEW OUR BOARDING COMMISSION PROJECT PROCESS AND REGULATIONS. IT ALSO PROVIDES A CONSISTENCY FOR APPOINTMENTS AND THE QUALIFICATIONS FOR EACH
[02:30:02]
BOARDING COMMISSION MEMBER. THE BOARDS THAT HAVE BEEN CREATED OR THE ARTS COMMISSION, THE COMMUNITY ENGAGEMENT ADVISORY BOARD MULTICULTURAL COMMISSION WITH SUB BOARDS, AND THE APPLICATION HAS BEEN UPDATED IN CITY HALL AND ON THE CITY WEBSITE. SO IF ANY CITIZENS WOULD LIKE TO APPLY FOR THESE BOARDS, WE ARE NOW ACCEPTING APPLICATIONS. ANY QUESTIONS? YOU HAVE ME AND MR HAGAR HERE TO RESPOND TO THOSE MR CONTRERAS. WELL, I'M GOING TO WAIT A MOMENT BECAUSE I BELIEVE COUNCILMAN COONS MAY HAVE SOME QUESTIONS. GO AHEAD. OKAY. OKAY, WELL I HEARD FROM A CITIZEN. UH HUH. THAT WAS ON ONE OF THESE BOARDS. THAT'S BEEN, UM DONE AWAY WITH UH, SOME COMMENTS THAT I WANT TO PASS ON. PARTICULARLY TO THOSE BOARDS THAT WE KNOW THAT I'VE HAD A LONG HISTORY OF, UM FAILING TO HAVE HAVE A. THE QUARREL TO BE ABLE TO MEET A QUORUM AND IT'S BEEN SOMETHING THAT'S BEEN JUST, YOU KNOW, PUSHED THROUGH FOR THE YEARS, ACCEPTING THAT THOSE MEETINGS ARE CONSTANTLY CANCELED. BUT YET WE'VE NEVER REALLY HAD A DISCUSSION ABOUT ANY SOLUTIONS. SO ONE OF THE THINGS THIS PERSON STATED TO ME WAS HAVING BEEN ON ONE OF THESE BOARDS AND STRUGGLING THROUGH SITTING WAITING FOR MAJORITY OF OR A QUORUM TO SHOW UP. WAS THAT, UM THERE BE SOME FLEXIBILITY AND THOSE PARTICULAR BOARDS THAT WE'VE BEEN HAVING SOME PROBLEMS WITH RELATIVE TO WHAT CONSTITUTES A QUORUM. UM SO THAT'S A QUESTION THAT THE CITY ATTORNEY CAN ADDRESS. BUT I'LL GO AHEAD AND MAKE MY SECOND STATEMENT THAT WAS PASSED ON TO ME, AND I THINK IT'S A GOOD IDEA OR AT LEAST GOOD FOOD FOR THOUGHT THAT ALSO ON THOSE BOARDS WHERE WE HAVE TRADITIONALLY WITH P. N Z SITE CONTROL BOARD BOARD OF ADJUSTMENT FOR B. WE SET SPECIFIC DATES. EACH MONTH THAT THEY MEET. AND SOME OF THESE BOARDS IT'S BEEN SUGGESTED. WOULD DO BETTER. IF THEY HAD THE ABILITY AT THEIR MEETING. TO COME TO A CONSENSUS AS TO WHO WOULD BE AVAILABLE FOR THE NEXT MEETING SOMETIME. A MONTH OR SO DOWN THE ROAD RATHER THAN STICKING TO A PARTICULAR DATE, BECAUSE THAT DOESN'T SEEM TO BE WORKING. ACCORDING TO THIS INDIVIDUAL, SO I'M I'M ALL ABOUT LISTENING TO WHAT PEOPLE THAT HAVE HAD THESE EXPERIENCES HAVE THE GIVE US IN THE WAY OF INPUT , AND I'D LIKE TO HAVE SOME CONSIDERATION ON THESE BOARDS TO AT LEAST HAVE SOME FLEXIBILITY ON WHAT CONSTITUTES A QUORUM SO THAT I DON'T THINK WE WANT TO HAVE TWO PEOPLE CONSTITUTING A QUORUM, BUT DEPENDING ON WHAT WHAT IS SET UP FOR EACH ONE OF THESE NEW BOARDS AS WELL AS THE MULTICULTURAL COMMISSION. I'D LIKE TO HAVE SOME CONSIDERATION FOR THOSE TWO POINTS. THANK YOU.THANK YOU, MR COUNTS. SO FIRST OF ALL, I SHOULD HAVE SPOKE FIRST BECAUSE HE TOOK EVERYTHING I WAS GOING TO SAY, BUT I DO WANT TO HEAR THE CITY ATTORNEY'S RESPONSE. IT SOUNDED LIKE THERE WAS SOME QUESTIONS THERE FOR THE CITY ATTORNEY ABOUT QUORUM. THE PLANNING AND ZONING COMMISSION AND BOARD OF ADJUSTMENT IN THE C R. D. C. C E. D. C HERE. AS REQUIRED BY STATE LAW TO BE 50% PLUS I CAN BARELY HEAR YOU CITY . I'M SORRY. THANK YOU. REQUIREMENTS FOR P N Z BOARD OF ADJUSTMENT AND THE ECONOMIC DEVELOPMENT CORPORATION AND THEIR QUARRELS ARE SET BY STATE LAW. SO AND IN THAT CASE, YOU HAVE TO HAVE A WORD OF ADJUSTMENT FOR MORE MEMBERS HAVE TO BE PRESENT. AH. SINCE WE HAVE SEVEN MEMBERS AND Z TAKES FOUR MEMBERS TO BE PRESENT. AH AND SO , UH, AND WITH OUR ECONOMIC DEVELOPMENT CORPORATION OF BYLAWS THAT ARE ADAPTED UNDER ITS ARTICLES OF INCORPORATION, GOVERNANCE, QUORUM. THE REST ARE ADVISORY. AH IN NATURE AND YOU CAN SET THE QUORUM. FOR WHATEVER YOUR TOLERANCES TO HAVE A MEETING. IF YOU AS A PRACTICAL MATTER IF YOU GET LESS THAN 50% THEN ARE YOU GOING TO ACCEPT THE RECOMMENDATIONS THEY MAKE TO YOU TO CONSIDER AND HAVE A DISCUSSION WHEN IT'S LESS THAN THE WHOLE BOARD. THE THOSE ARE ISSUES THAT ARE WITHIN YOUR DISCRETION TO ESTABLISH. SO, MR COONS. SO HOW EXACTLY HOW HOW ARE. HOW IS IT NOW? SO, FOR EXAMPLE, SO, FOR EXAMPLE, PARKS BOARD WHAT? WHAT? WHAT DEFINES A QUORUM. HALF PLUS ONE. SO IF WE HAVE A BOARD OF EIGHT, WE NEED FIVE PEOPLE THERE. IT'S ALWAYS

HALF PLUS ONE. UM I DO BELIEVE MR HAGAR ON THE MULTICULTURAL BOARD. WE'VE WE WROTE IT DOWN IN THERE ON WHAT WOULD CONSIST OF A QUORUM. BECAUSE WE HAVE THE SUB BOARDS. IT WOULD BE LESS FOR A QUORUM. IS IT IN LIKE TWO EACH? YEAH THE WAY I WROTE IT IS BASICALLY YOU HAD A DISCUSSION AS YOU WANTED THERE TO BE A PHOENIX BOARD IN AFRICAN AMERICAN BOARD FEMALE BOARD AND THEN THE ENTIRE BOARD. AND SO WE HAD SUBCOMMITTEES OF THE LATINA EXPORT THE AFRICAN AMERICAN SUBCOMMITTEE IN THE WOMEN'S SUBCOMMITTEE SO THEY CAN MEET TO DISCUSS SPECIFIC ISSUES ABOUT THEIR RESPECTIVE GROUPS AND EITHER I WOULD ASK YOU THIS. DO YOU WANT THEIR RECOMMENDATIONS TO COME DIRECTLY TO COUNSEL OR DO YOU WANT THEM TO GO TO THE ENTIRE MULTICULTURAL COMMISSION? SINCE YOU'VE HAD THIS PROBLEM. MY RECOMMENDATION MIGHT BE FOR YOU TO CONSIDER THAT THEY MAKE RECOMMENDATIONS DIRECTLY TO THE COUNCIL. FOLLOWING AGAIN, THAT'S UP TO Y'ALL FOLLOWING AS WE RECALL IT CHAIN OF COMMAND IF THOSE SUBCOMMITTEES WANT TO MAKE CHANGES, AND IT SHOULD FOLLOW UP TO THE MULTICULTURAL THAN A MULTICULTURAL, TOO. TO US. NOW MY QUESTION. WOULD YOUR COMMENTS HAVE MERIT AND ARE VALID THE ISSUE THEN WE HAVE BEEN DISCUSSING THIS BOARDS AND COMMISSION ORDINANCE FOR WHILE THREE MONTHS NOW AND WITH SEVERAL MEETINGS AS WELL. TO GO THROUGH THIS SO WITH THOSE THAT CITIZENS INPUT, WHICH WHICH HAS MERIT AND UNDERSTANDING THAT I THINK IT'S BEST FOR US AS A COUNCIL TO GO AHEAD AND APPROVE THIS ORDINANCE, BUT TAKE INTO CONSIDERATION THOSE COMMENTS AND ANYTHING THAT COULD BE CHANGED AND MODIFIED. CAN WE DO SO IN AMENDED LATER IF WE NEEDED TO, BUT WE SPENT A LOT OF TIME ON THIS ORDINANCE. AND I THINK IT'S TIME TO GO AHEAD AND PUT IT INTO EFFECT WITH UNDERSTANDING CONSIDERATION. WE MAYBE IN THE FUTURE. THANK YOU FOR THAT MAYOR . I AGREE THAT THAT WOULD PROBABLY BE SUITABLE FOR THE TIME BEING, BUT I JUST WANT TO MAKE, UH REMINDER THAT WE'VE BEEN STRUGGLING WITH, FOR INSTANCE, IN MULTICULTURAL BOARD. WE'VE BEEN STRUGGLING WITH THEM AND QUORUM SINCE SINCE THEIR EXISTING BEGINNINGS, RIGHT SO WE HAVEN'T EVER HAD DISCUSSIONS. SO WITH YOUR WITH YOUR NOTE. TO THIS VOTE TONIGHT TO ADDRESS THAT. UM I WOULD HOPE THAT WE WOULD FOLLOW UP AND ADDRESS IT SO THAT WE, ESPECIALLY IF WE SEE AFTER WE PASS THIS THAT WE'RE STILL HAVING PROBLEMS WITH GETTING GETTING A QUORUM. AND, UM AS TO THE OTHER POINT, I WOULD ALSO LIKE TO AND THAT FUTURE DISCUSSION HAVE THE CONVERSATION ABOUT THE CONSENSUS SINCE WE HAVEN'T SETTLED THAT TONIGHT FOR THOSE PARTICULAR BOARDS THAT HAVE TROUBLE UM, I'M SORRY. I'M GOING BACK TO THE TIME ISSUE THE DATE AND TIME TO ALLOW THEM TO HAVE THE FLEXIBILITY TO DETERMINE WHEN THEIR MEETINGS ARE GOING TO BE PROVIDED THEY ARE STAYING WITHIN A 30 DAY PERIOD. CITY MANAGER, UH, RECEIVING DIRECTION FROM COUNCIL ON THAT PARTICULAR ASPECT AND TAKING NOTES. WE WILL ATTEMPT TO PROVE THIS TONIGHT AND SOME AS YOU CAN EXAMINE THESE SUGGESTIONS AND COME BACK TO US WITH SOME TYPE OF REMEDIAL INFORMATION AS NECESSARY TO PROTECT THE ATTORNEY WAS GOING TO SAY SOMETHING, BUT I'M SORRY YOU DID HAVE THE RIGHT TO APPROVE THE ORDINANCE WITH THE AMENDMENT OF ONLY REQUIRING THOSE THAT ARE REQUIRED BY LAW TO HAVE A QUORUM TO HAVE A QUORUM. BREXIT. YOU WOULD HAVE TO DEFINE WHAT QUORUM IS. 50 PLUS POINTS MAJORITY PLUS ONE WELL, THAT'S THAT'S COMMON LAW. THE COMMON LAW IS 50 PLUS ONE.IT'S GENERALLY ACCEPTED ENGLISH COMMON LAW. SINCE THE TIME OF WILLIAM THE CONQUEROR IN 10 66.
SO THAT THAT'S GENERALLY WHAT'S ACCEPTED IF YOU WANT SOMETHING DIFFERENT THAN THAT, AND THAT'S GENERALLY WHAT'S REFLECTED IN LOCAL GOVERNMENT. REQUIRES THE COUNCILS FOR EXAMPLE, I HAVE TO HAVE 50% PLUS ONE. AFFIRMATIVE VOTE IS 50% PLUS ONE, SO THAT'S GENERALLY ACCEPTABLE IF YOU WANT SOMETHING LESS THAN 50% PLUS ONE, WE CAN VISIT THEM. I WOULD CAUTION YOU ABOUT SETTING THE MEETINGS AND ALLOWING THE BOARDS AND COMMISSIONS TO SET THEIR OWN MEETING DATES. AND THE SCHEDULE WOULD BE MY RECOMMENDATION TO YOU SO THAT YOU BELIEVE YOU'RE ALL HAVE SIGNED UP TO BE LIAISON , SO YOU WOULD KNOW WHEN TO SHOW UP. BUT THERE ARE VARIOUS ORDINANCES THAT WE HAVE WRITTEN THAT REQUIRES CERTAIN NOTICES TO BE GIVEN FOR THEM TO APPEAR. AND SO THAT'S WHAT DRIVES FOR THE BOARD OF ADJUSTMENT, FOR EXAMPLE. WE TRIED TO SET THOSE FOR THE FIRST THURSDAY OF THE MONTH. UH SO THAT WHEN WE GET SOMEONE REQUESTING A VARIANCE, WE DRIVE THAT BOAT, SO THAT'S
[02:40:05]
SOMETHING WE NEED TO VISIT WITH THE BOARDS ABOUT AND I WOULDN'T HAVE ANY PROBLEM WRITING SOMETHING FOR YOUR ORDINANCE. SO THAT BOARDS NO ONE THEY'RE GONNA MEET BECAUSE PEOPLE ARE BUSY.AND SO IT'S A GOOD IDEA TO HAVE A SET MEETING TIME. YOU CAN ONLY IMAGINE YOURSELVES, FOR EXAMPLE, OR YOU DIDN'T KNOW WHEN THE COUNCIL WAS GOING TO MEET, BUT JUST WHENEVER WE GIVE YOU 72 HOURS NOTICE OKAY? AND I'M MAYOR. I'M PERFECTLY ACCEPTING OF MOVING FORWARD WITH THIS.
WITH CONSIDERATION TO SOME OF THESE, UM EFFORTS TO HELP THOSE GROUPS THAT HAVE STRUGGLED FOR SO LONG. HAVE A BETTER CHANCE OF BEING SUCCESSFUL IN REACHING QUORUM. AND. HAVING THEIR MEETING DATE SET TOWARD THEY CAN ALL BE THERE. SO, UM I'M FINE WITH THE RESPONSE. I JUST WANTED TO PASS. THOSE. UM COMMENTS ON THAT CAME FROM A CITIZEN. UNDERSTOOD THANK YOU NEED TO UNDERSTAND AS WELL THAT THE ELIMINATION OF THE TERM QUORUM FOR THOSE PARTICULAR BOARDS AND COMMISSIONS THAT DON'T HAVE A QUORUM STIPULATED BY LAW. ELIMINATING THAT WORD FROM WHATEVER THERE IS JUST LIKE SAYING YOU CAN VOTE. IF YOU SHOW UP, YOU CAN VOTE, AND THAT'S THE WAY IT'S GOING TO BE WITHOUT THE USE OF THE WORD QUORUM IN THAT THAT PRESENTS SOME DIFFICULTY, AND THAT'S GOING TO BE VERY DIFFICULT THING FOR OUR ATTORNEY, TOO, RIGHT? BUT SOMETHING TO CONSIDER TAKING IT FORWARD FROM THERE, SO I'M LOOKING AT MY BOARDER, MR MCBURNETT. THANK YOU, MAYOR. I WANT TO COME IN CITY SECRETARY DOWNS FOR THE WORK IS DONE BECAUSE SINCE MY TIME ON THE COUNCIL THIS THING HASN'T BEEN CONSISTENT. WE FINALLY GOT SOMETHING THAT'S MOVING US FORWARD TOWARDS CONSISTENCY, SO I WANT TO. I REALLY APPRECIATE BECAUSE I KNOW IT'S BEEN A LOT OF HARD WORK, SO I'M GONNA MAKE THE MOTION TO APPROVE. THANK YOU. WE HAVE MOTION TO APPROVE THEIR SECOND. I'M SORRY, MR CRUNCHY. HAD A QUESTION FIRST, SIR. THANK YOU, MARY. I JUST HAD ONE AND I'M READY TO PROVE THIS AS WELL. JUST ONE RECOMMENDATION FOR CITY OUR SIZE. TO REDUCE THE ARTS COMMISSION FROM 9 TO 7. THAT WAS THE ONLY RECOMMENDATION. CITY MANAGER. IF YOU WOULD JUST TAKE THAT INTO CONSIDERATION AS WE MOVE FORWARD WITH THIS SO AH! ANY FURTHER DISCUSSION, AND MR MAC THE CITY ATTORNEY DO YOU WANT IN MY TO UNDERSTAND THAT YOU WANT US TO CHANGE IT FOR A FRIENDLY AMENDMENT? NO OKAY, WE'RE GOING TO APPROVE IT AS WRITTEN. CITY MANAGER HAS BEEN GIVEN SOME DIRECTION FOR MAKING SOME MODIFICATIONS AND COMING BACK WITH SOME AMENDMENTS TO IT AT A LATER DATE. SO CHAIR WILL ACCEPT THE MOTION TO APPROVE. SO MOVED . SECOND WE HAVE MOTION TO APPROVE BY COUNCIL MEMBER COULD SECOND BY COUNCIL MEMORY. CONTRERAS COUNCIL PLEASE VOTE. THANK YOU UNANIMOUSLY APPROVED.
WITH MR HARVEY ABSENT. THANK YOU. GOOD EVENING. GOOD EVENING, MAYOR AND COUNCIL. MY TURN. I'M SORRY TO YOUR TA JUST SECOND. ADAM F CONSIDERING ORDINANCE CREATING CLASSIFIED POSITIONS UNDER CIVIL SERVICE AND THE POLICE AND FIRE DEPARTMENTS PROVIDED FOR A PAY SCALE UNDER CIVIL SERVICE. REPEALING OR ORDINANCES CONFLICT HERE WITH AND PROVIDING A SEVERABILITY CLAUSE PROVIDING REPEALING CLASS AND MR SIEGEL HR DIRECTOR, THE FLOOR IS YOURS, SIR. THANK YOU, SIR. GOOD EVENING, MAYOR AND COUNCIL BEFORE YOU IS AN ORDINANCE FOR THE CIVIL SERVICE CLASSIFICATION. UNDER TEXAS LOCAL GOVERNMENT CODE CHAPTER 1 43 POINT OH, 21. ANY CHANGE OR AMENDMENT TO THE CIVIL SERVICE STRUCTURE MUST BE APPROVED BY ORDINANCE BY THE GOVERNING BODY.
IF YOU RECALL DURING THE BUDGET SEASON, THERE WERE TWO NEW POSITIONS THAT WERE CREATED IN THE SYSTEM. POLICE CHIEF GIVING US TO ASSISTANT POLICE CHIEFS AND POLICE AND A DEPUTY FIRE MARSHAL POSITION IN THE FIRE DEPARTMENT SINCE THERE ARE TWO NEW POSITIONS IN THE CLASSIFIED SERVICE. WE BRING THIS ORDINANCE TO YOU FOR APPROVAL. YOU CAN SEE THE NUMBER OF POSITIONS IN EACH RESPECTIVE DEPARTMENT. AND THEN ALSO, WE PUT IN ALL OF THE NEW SALARIES FOR THE POSITIONS IN THE CLASSIFIED SERVICE BASED ON THE COST OF LIVING ADJUSTMENT WITHIN THE BUDGET. ANY QUESTIONS? I WILL JUST NOTE THANK YOU FOR INCLUDING THE ENTIRE THAT PAY SCALES FOR BOTH POLICE AND FIRE. IT'S VERY GOOD TO HAVE THAT INFORMATION DOCUMENTED BECAUSE SOMETIMES WE'RE NOT REAL SURE EXACTLY WHERE THE STEPS ARE AND HOW CIVIL SERVICE OPERATES. AND AS WELL SHOWING THE APPROVED SALARIES FOR INCOMING POLICE AND FIRE FOR BRAND NEW INDIVIDUALS COMING IN LIKE, YOU KNOW, AS WE SAY HERE, POLICE OFFICER NO PREVIOUS EXPERIENCE COMING IN STARTING PAY OF $63,418 A YEAR. I THINK THAT'S VERY, VERY COMPETITIVE. WE KNOW THAT THINGS
[02:45:08]
ARE IN FLUX IN TERMS OF STARTING SALARIES THROUGHOUT THE ENTIRE METRICAL. IN FACT, THE ENTIRE NATION CORRECT IN TERMS OF BRINGING INDIVIDUALS INTO OUR FIRST RESPONDERS POSITIONS, SO IT'S VERY IMPORTANT TO UNDERSTAND THAT WE WERE DOING OUR VERY BEST. I WANTED TO GO ON RECORD FOR THE STAFF AND YOU AND EVERYTHING THAT'S BEEN DONE AND FOR WE AS A COUNCIL TO DO OUR BEST. TO PROVIDE COMPETITIVE SALARIES FOR RETENTION AND ALSO FOR RECRUITMENT. I THINK THOSE TWO FACTORS GO TOGETHER. AND SO SEEING THESE NUMBERS ARE TO ME. I CAN'T SPEAK FOR EVERYBODY ELSE IN COUNCIL BUT LOOKING AT THE FIREFIGHTER COMING INTO 65 POLICE OFFICER COMING TO 63.THOSE ARE STRONG AND VERY COMPETITIVE SALARY, SO I THANK YOU FOR THAT, AND FOR OUR CITIZENS, WE WILL DO OUR VERY BEST TO CONTINUE TO PROVIDE VERY COMPETITIVE SALARIES FOR RETENTION AND RECRUITMENT FOR OUR FIRST RESPONDERS. MR CONTRERAS. UM YES, AND I AGREE TO WE TALKED ABOUT THIS A LOT. THE NEED TO MAKE SURE FIRST RESPONDER. EXCUSE ME. OR TAKING CARE OF TO THE EXTENT THAT THEY HAVE THE INCENTIVE TO STAY HERE BECAUSE WE GET MORE COMPETITIVE WITH OUR PAY. I DO HAVE A QUESTION. UM I THINK IT'S CLEAR BUT I WANT TO MAKE SURE THAT WHAT WE'RE VOTING ON TONIGHT IS TO APPROVE BASICALLY A SIX YEAR PLAN THAT SHORT OF COST OF LIVING INCREASES. UM ISSUED. EFFECTIVELY WHAT COUNCIL MEMBER COUNCILMAN, WHAT YOU'RE HERE TO APPROVE IS THE ENTIRE ORDINANCE BECAUSE WE HAVE NEW POSITIONS IN THE CLASSIFIED SERVICE FOR POLICE AND FIRE. WE HAVE TO PROVE THAT AND THE PAY THAT GOES ALONG WITH EACH AND INDIVIDUAL, EACH INDIVIDUAL STEP WITHIN THE RESPECTIVE DEPARTMENT, BUT THAT TABLE THAT YOU JUST TOOK OFF THE SCREEN THAT'S SHOWING US WHAT THE THESE PAYS WILL BE THROUGHOUT THE SIX YEAR PERIOD.
WE'RE VOTING ON THAT. THAT IS CORRECT. OKAY BUT THE COST OF LIVING INCREASES ARE NOT INCLUDED. WELL. GO AHEAD. OK CITY MANAGER HAD A COMMONPLACE SO WE HAVE ACTUALLY, THIS IS JUST WHAT WE CURRENTLY HAVE. BASED ON COST OF LIVING. HOWEVER WE ARE IN THE PROCESS OF GOING TO BE BRINGING BACK TO YOU OUR COMPENSATION STUDY. SO THIS DOES NOT. THIS IS NOT THE RESULTS OF THE COMPENSATION STUDY THAT HAS BEEN CONDUCTED. WE ARE FINALIZING THAT INFORMATION WILL BE BRINGING THAT BACK TO YOU TO LET YOU KNOW. MARKET WISE, ANY RECOMMENDATIONS TO ACTUALLY PAY PLAN? THIS IS JUST ADDING THE NEW POSITIONS TO THE PAY PLAN, WHICH IS THE DEPUTY FIRE MARSHAL AND THE SECOND ASSISTANT CHIEF. OKAY. WELL, THANK YOU FOR THAT CLARIFICATION. ANY FURTHER DISCUSSION. CHAIR LIEUTENANT MR MCBURNETT MOTION TO APPROVE BOTH GROUPS. MR MCBURNETT SECOND, PLEASE SECOND FROM COUNCILOR ROBERTO CRUZ. PLEASE VOTE. UNANIMOUSLY APPROVED, MR HARVEY ABSENT. THANK YOU. THANK YOU. THAT CONCLUDES OUR ITEMS FOR INDIVIDUAL CONSIDERATION. MOVING
[6. STAFF AND BOARD REPORTS]
ON TO ITEM G. OOPS, WAIT A MINUTE. SIX. SIX STAFF AND BOARD REPORTS RECEIVED THE MONTHLY FINANCIAL REPORT AS OF JULY. 31ST 2022 MANAGING DIRECTOR OF FISCAL SERVICES OF THE NAPM OR MORE FLOOR IS YOURS. GOOD EVENING, MAYOR, COUNCIL MEMBERS AND CITY MANAGER. I'M HERE TO YOU TO PRESENT THE JULY FINANCIAL REPORT FOR THE CITY OF DUNCANVILLE. AND I'M HERE TO SHARE WITH YOU THAT THE CITY IS IN A STRONG FINANCIAL POSITION AS WE TAKE A LOOK AT THE JULY FINANCIAL REPORT FOR THE GENERAL FUND. AS YOU CAN SEE, WE HAVE ACCUMULATED APPROXIMATELY $30 MILLION OUT OF $34.3 MILLION BUDGET ALREADY IN GENERAL FUND AND EXPENDED. 25 MILLION OUT OF $36 MILLION BUDGET FOR GENERAL FUND THAT GIVES US A STRONG FUND BALANCE WITH OUR MEETING OUR RESERVE REQUIREMENT OF ABOUT 4.2 MILLION AND LEAVING US. AN EXCESS OF RESERVE REQUIREMENT OF 15.8 MILLION. UH NEXT, WE TAKE A LOOK AT OUR USE OF FUND BALANCE . THESE ARE PROJECTS THAT YOU HAVE FUNDED WITH ONE TIME. FUNDING FOR 2022. YOU CAN SEE THAT IT'S 2.7 MILLION ONLY SPENT ABOUT 165,000 OF THOSE FUNDS TO DATE. THE UTILITY FUND. IS DOING WELL AS YOU CAN SEE IF WE COMPARE IT TO LAST YEAR. THE ACTUAL REVENUES FOR THE UTILITY FUND LAST YEAR WE RECEIVED ABOUT $2 MILLION MORE THAN WE DID. UH PRIOR YEAR FOR THIS FUN WE'VE ALSO EXPENDED 14.3 MILLION.[02:50:02]
WHICH WERE LITTLE REALLY ON ON THEIR TARGET ON THIS FOR THIS TIME OF THE YEAR. BUT WE HAVE A LOWER AMOUNT OF X. REVENUES OVER EXPENDITURES FOR THIS PARTICULAR FUND, SO THIS PUTS AT ABOUT 14 MILLION FUND BALANCE RIGHT NOW FOR THIS TIME OF THE YEAR. THE C I P FUND. YOU CAN SEE, THIS IS WHAT RCMP PROJECTS FOR THE UTILITY FUND. WE ARE STILL WE'RE NOT EXPECTING TO SPEND THE $8.8 MILLION FOR CAPITAL PROJECTS SO AS YOU CAN SEE, AS WE'RE ENDING IN THE YEAR ENDING THE YEAR THAT AMOUNT WE WILL ASSESS WHERE WE ARE AS FAR AS PROJECTS IN THE UTILITY FUND AND KIND OF MODIFY IT FROM THERE. YOU HAVE THE ECONOMIC DEVELOPMENT FUND, WHICH , IF YOU NOTICE THIS IS FUN.IT'S DOING WELL, BUT WE ALSO HAVE EXPENDED A LITTLE BIT OVER THE TARGET FOR THIS FUND, BASICALLY BECAUSE OF PROJECTS THAT THE COUNCIL APPROVED FOR DEVELOPMENT IN THE CITY. OTHER THAN THAT, THERE'S JUST THIS FUN IS SPINNING ACCORDING TO BUDGET AND THEN WE HAVE THE FIELDHOUSE FUND. AS YOU CAN SEE, THE FUND BALANCE FOR THIS FUND HAS GONE HAS GONE DOWN AS FAR AS THE NEGATIVE FUND BALANCE. SO WE HAVE TRACKED A LITTLE BIT OF REVENUE FOR THIS FUND AT 218,000 REVENUES OVER EXPENDITURES. IN YOUR PACKAGE. YOU HAVE ALL THE OTHER FUNDS, WHICH ARE YOUR SPECIAL REVENUE FUNDS. UH FOR THE CITY THAT WE OPERATE REVENUES THAT COME IN FOR DIFFERENT SPECIAL PURPOSES FOR THE CITY. AS WELL AS YOU HAVE CAPITAL PROJECTS AND DEBT SERVICE FUNDS THAT ARE PROVIDED IN YOUR PACKAGE THAT CAN SEE HOW THEY'RE TRACKING FOR THE YEAR.
AND THEN THE LAST SLIDE SHOWS YOU YOUR OTHER ENTERPRISE FUNDS, WHICH IS MADE UP OF YOUR DRAINAGE AND YOUR SANITATION FUND. THESE ARE THE OTHER TWO ENTERPRISE FUNDS. THAT ARE WITHIN THE CITY THAT OPERATE ON BASICALLY CHARGES FOR SERVICES ON A PROPRIETARY BASIS. THAT ONE. POINT HERE, SO GO BACK THIS ONE SLIDE. 1 13. SO IT IS THIS FUN THAT'S GOING TO BE IMPACTED BY THE RATE INCREASE BY REPUBLIC IS THAT CORRECT? THE SANITATION FUND. YES SIR. THAT'S 1 19. OKAY JUST ONE COMMENT ASIDE. I WANT TO COMMIT. I DIDN'T CATCH THE NUMBER OF THE SLIDE FOR THE FOR THE D. C D. C BUT I WANT TO COMMEND MR GARCIA AND MR MANSELL FOR AGGRESSIVELY PURSUING GRANTS FOR BUSINESSES IN OUR CITY. AND PARTICULARLY IF YOU WANT TO SEE SOME IMPROVEMENT RIGHT BEFORE YOUR EYES GO TO THE BOWLING ALLEY. THE GRANT THAT WAS PROVIDED TO THEM FOR EXTERIOR.
UM IT'S REALLY A GREAT LOOKING PLACE NOW. IN FACT, YOU'RE SOME CITIZENS PULLED ME ASIDE AND SAID, HAVE YOU SEEN THE BOWLING ALLEY? WHAT MAN? NO NOT RECENTLY SAID GO, AND SO YOU KNOW ABOUT 68 DAYS AGO, I DID GO BY AND IT LOOKS GREAT. AND THAT IS A RESULT OF WHAT OUR MONEY IS FOR.
OUR GRANTS ARE GOING FORWARD IN D. C D. C SO IT'S VERY PURPOSEFUL. IT'S VERY AGGRESSIVE , AND IT'S VERY GREAT FOR OUR COMMUNITY. SO THANK YOU, MR MANSELL AND MR GARCIA FOR WHAT THEY'RE DOING. UH WITH THAT MANY COMMENTS FROM MR SMITH FROM HIS THAT MARK THANK YOU SEEM DONE.
906. YEAH YEAH, YEAH, WE ARE HERE, COMPLETING ALL OF OUR BUSINESS. WE ARE OFFICIA
